Adjournment APPROVAL OF MINUTES Mr. McQuillen moved, seconded by Mr. Stevens and carried unanimously, that the minutes of June 6, 1986, be approved. REVIEW OF CONTRACT FOR MODEL AERONAUTICS, INC. Dan Loubier stated that Model Aeronautics, Inc. has utilized the property on Manatee Road for 6 years, and have done improvements on the road and some landscaping. He added that they use the property primarily to fly their model airplanes. He indicated that the contract came up for renewal this year and it has been reviewed by the County Attorney who made minor changes; Model Aueronautics, Inc. has reviewed the new agreement and approved it . He said that staff recommendation is that the Board recommend it for approval to the BCC Mr. Stevens asked if Model Aeronautics has had a similar contract for the past 6 years? Mr . Loubier answered affirmatively. Mr . Stevens asked if this gives them exclusive use of the property? Mr . Loubier replied 4:) Page 2 PARKS AND RECREATION ADVISORY BOARD AUGUST 21 , 1986 Q "No, " that it gives them use of the area. Mr. Stevens stated that the contract indicates that it gives them the right to remove anyone that does not belong to the organization, and the contract leases County property specifically for use by a private club. Mr. Monaco stated that it includes a 60 day notice under which they can be removed, and Mr . Loubier stated that that was one of the new provisions that the County Attorney implemented. Mr. Monaco stated that his interpretation is that when Model Aeronautics, Inc . uses the area, it shall be restricted to their members. Mr . Stevens stated that, as he sees it, they have exclusive use of it under the lease, 24 hours a day, and it is public property that is going to be limited to a privileged few for a $1 . 00 a year for the use of 30 acres, and this aspect should be clarified. After a long discussion, Mr. Loubier stated that if the Board desires, he can have the County Attorney review the contract and point out the Board' s concerns and perhaps rewrite any article that should be rewritten. Mr . Burton said that the intent of the article should be clarified. Mr . Stevens stated that he would like to see a clarification that it is not for the exclusive use of this club 24 hours a day for five ®` Page 3 PARKS AND RECREATION ADVISORY BOARD AUGUST 21, 1986 (;) years. Mr . Peek stated that the club would want certain parts restricted because they made improvements. Mr . Monaco stated that it should be clarified and the members of the organization should be contacted and if they feel that it is too restrictive, perhaps they should appear before this Board to clarify what their 1 concerns would be. Mr. Burton asked if it is legal to lease the pro- perty to five different people at once? Mr. Monaco stated that it could be done but it could not interfere with the uses provided. Mr. Stevens moved, seconded by Mr. Burton and carried unanimously, that the contract be resubmitted to the County Attorney for clarification. CHANGE ORDER NO. 2 IN AMOUNT OF $3, 915 TO BUNN CONSTRUCTION TO ENLARGE THE SEPTIC TANK AND DRAINFIELD AT NORTH NAPLES COMMUNITY PARK - RECOMMENDED FOR APPROVAL Mr . Peek stated that subsequent to the construction plans being completed and processed, the requirements for the size of the tank and drainfield were changed by the Health Department , and they are being increased to comply with the current regulations. I CONTRACT FOR COLLIER SPORTS OFFICIALS ASSOCIATION FOR FISCAL YEAR 1986-87 - RECOMMENDED FOR APPROVAL Mr . Loubier stated that this contract has existed for the past 6 years with Collier Sports Officials Assn. He added that this is a renewable contact which the 1 County Attorney has reviewed as well as the CSO offi- cials who are in agreement . He indicated that staff ' s recommendation is that the contract be recommended for approval . Mr. McQuillen moved, seconded by Mr. Burton and AP carried unanimously, that the contract with the Collier Sports Officials Association for the purpose of pro- viding officials for County recreation and athletic programs be recommended for approval . UPDATED RESOLUTION REGARDING ADVISORY BOARDS Kevin O' Donnell, Public Services Administrator, stated that the Board of County Commissioners recently passed a resolution pertaining to all the advisory boards. He indicated that few major points are that no person shall serve on more than two boards simulta- neously and if any member decides to run for political 1 i ` Page 5 1 1 I PARKS AND RECREATION ADVISORY BOARD AUGUST 21 , 1986 (;) office, he would then be expected to resign; every member is expected to attend at least 7536 of the meet- ings and failure to do so without an excused absence would result in the position being vacant . He noted that the Parks & Recreation Advisory Board comes up for review in 1988 , and by February 15 , 1988 the County Manager is required to submit to the BCC a report sub- ; mitted by the Chairman outlining whether or not the Advisory Board should continue, and in March the Chairman is required to make a presentation to the BCC in regards to the report . He said that the resolution outlines what the report should contain, including whether the Advisory Board is serving the purpose for which it was created, etc. RECOMMENDATION OF SOUTHERN TURF NURSERIES AS CONTRACTOR FOR SPRIGGING OF LEIGH PLUMMER PARK ON MARCO ISLAND IN THE AMOUNT OF $6,000 - RECOMMENDED FOR APPROVAL Mr. Smith stated that the bids were let and were to be opened on July 30, 1986, for the sprigging of Leigh Plumber Park on Marco Island, but no bids were received. He indicated that the Purchasing Department informed him if quotes could be obtained, this item could be pre- sented to the County Commission for approval. He pointed out that Amerson Sales, Inc. and Southern Turf Nurseries said they submitted bids, however, Amerson C Page 6 PARKS AND RECREATION ADVISORY BOARD AUGUST 21 , 1986 1 received theirs back and Southern Turf Nurseries ' was never received. He said that at this point he is seeking approval from this Board to present these quotes to the Purchasing Director so he can present them to the BCC to get the project approved. Mr. Burton moved that Southern Turf Nurseries be selected as the low bidder for the sprigging of Leigh Plumber Park. Mr . Monaco stated that there were no bids, and Mr. Burton said that there are 3 quotes. Mr. Smith stated that he obtained 3 quotes. Mr. Burton stated that Southern Turf is the best known and most used in the southeast for this type of work. Mr. Monaco asked what the work entailed? Mr. Burton replied that it involves taking individuals grass plants, drilling them into the ground and the roots grow down and across, and this is the type of grass that works for parks. Mr. Burton added that the County will supervise the work. 1 Mr. McQuillen moved, seconded by Mr. Stevens and carried 3/0 (Mr. Burton abstaining) , that the 3 quotes be presented to the BCC and that Southern Turf Nurseries be recommended as low bidder for the contract for sprigging of Leigh Plumber Park in the amount of $6,000. Page 7 PARKS AND RECREATION ADVISORY BOARD AUGUST 21 , 1986 OLD BUSINESS Update of the Community Parks Mr. Peek stated that a memo dated August 14th was issued setting forth the position of the various contractors with the needs of the park sites. He said that the critical date as far as an unpdate concerns the estimated completion date of the Golden Gate and North Naples Parks, which is set for December 1st . He indi- cated that the big problem had been that Bunn Construction was not adhereing to their schedule, and had not since April , thereby causing all the other sub- contractors to fall behind schedule. He indicated that Bunn Construction did not have the number of people needed to work within their timeframe, adding that in June there were several meetings and Bunn Construction hired another contractor, Boran, Craig & Barber, to take over their obligations, who in about a four week period of time has made significant progress. He said that there are still a number of things to be done for the buildings to be complete, but at least the other sub- contractors will not be held up. Mr . O ' Donnell stated that the County has a Liquidated Damages provision in the contract with Bunn Construction which is $200 a day for each park, and the Page 8 PARKS AND RECREATION ADVISORY BOARD AUGUST 21, 1986 , 4000 other subcontractors have asked for extensions of time. Mr . Peek stated that $400 a day is being deducted from his contract . Mr. Burton asked how many weeks Bunn Construction is behind at this point? Mr. Peek replied from June 18 until last week. Mr. Burton asked what happens to the money that Bunn is fined? Mr. Peek said that part may be claimed as damages by the other contractors, and if it turns out to be a net fallback to the County, it may be used for other items for the particular parks, but at this point he is not sure. Mr. Peek added that the other contractors have been very cooperative and at this point none have made any claims. He indicated that McAsphalt , who is doing the paving, has asked for addi- tional monies for potholes and minor repair. Mr. Peek stated that the Immokalee Park is on sche- dule with a completion date of December 1st ; the Marco Island Park ground breaking is August 26, 1986, notice to proceed will be issued today and the contractor expects to start work next week; estimated completion being mid-May. He said that on East Naples, his firm is proceeding with the design to be completed by October 15th, and various permits have been applied for because about 28 acres are categorized as a wetland area; bids :11;) Page 9 9 1 . PARKS AND RECREATION ADVISORY BOARD AUGUST 21 , 1986 will be let October 15th, bid opening November 15th and construction beginning January, 1987 , adding that these date are contingent on receiving the permits. Mr . Monaco asked if any ceremonies are planned for the opening of these Parks? Mr . Loubier answered affirmatively. MISCELLANEOUS Mr. O' Donnell stated that Ms. Marilyn McGinty was appointed Superintendent of Recreation effective August 20, 1986, and that he is in the process of screening applications for the Director 's position. He said that he would like the Chairman of the Advisory Board to sit on the interview panel, adding that 35 or i0 40 applications have been received and he hopes to narrow it down to the top six who will be interviewed. Mr . Loubier asked that the Parks & Recreation Advisory Board should schedule a special meeting in early September to review the recreation program packet that has been put together, adding that this has to be expedited as soon as possible because some of the programs are slated to begin in October and it has to be presented to the County Commissioners for approval . Grounds Maintenance Contract | Attached is an Executive Summary which , upon PARAB approval , will be } � � placed on the Board of County Commissioners' Agenda for September �m�� 23 , This contract is for the vendor who has been performing ' grounds maintenance work at the t th Courthouse for the past year and has done a good job . Item IV. B . Entrance Signs for Community parks Attached is an Executive Summary which , upon PARAB approval , will be placed on the Board of County Commissioners' Agenda for September 23 , 1986 ” Theses will be entrance signs for the five community parks and will be purchased as the individual parks are completed . Item IV. C. Change Order for North Naples and Golden Gate Community Parks for substituting bermuda sod for bermuda sprigging . Attached is an Executive Summary which , upon PARAB approval , will be placed on the Board of County Commissioners' Agenda for September 23, 1986 . These Change Orders have resulted due to delays in construction of the community parks , primarily the buildings . It has become necessary to sod the athletic fields at North Naples and Golden Gate in order to have them playable for the anticipated opening in December . Item IV. D. Change Order for North Naples , Golden Gate and Immokalee Community Parks for security lighting . C) Attached is an Executive Summary which , upon PARAB approval , will be placed on the Board of County Commissioner' Agenda for September 23, 1986 . An on-site inspection was performed by the Public Services Administrator who expressed concerns pertaining to security lights around the building . Many areas are dark and could cause security problems , therefore , by adding additional lights vandalism could be reduced . Item IV. E . Request from Gulf Coast Little League for maintenance on their facility . Attached is a memo explaining Gulf Coast Little League's request to perform maintenance on the Lely Little League Complex for fiscal year 1986/87 . Item IV. F . Discussion of Administrative offices at Golden Gate Park . A brief discussion will be held to discuss the plans of the Parks and Recreation Administrative staff moving their offices to the Golden Gate Park . Item V . A . Update of Community Parks Mr. Bob Furlong will be present at the meeting to discuss this item �-� and to answer any questions . j �r 14m ft �^ Item V. B . Review Contract for Model Aeronautics, Inc . This item was discussed at the August PARAB meeting and a few concerns were raised about the public utilizing the property. A response from the County Attorney's office is attached discussing �m� the proposed changes. 10 ` 1 . 1 1 4:: RECOMMENDATION TO AWARD BID #86-1025 GROUNDS MAINTENANCE OBJECTIVE: To award a contract to supply grounds maintenance of specified County owned property for Fiscal year 1986/87. y CONSIDERATIONS: Sealed bids for Bid #86-1025 Grounds Maintenance were opened on September 5, 1986. The bid included the following County owned property: Government Center Grounds, Marco Island Library, Golden Gate Library, North Naples Library, Central Library. and the Marco Island Sub-station. Legal Notice appeared in the II Naples Daily News on August 22, 1986. Invitations to bid were sent to 27 vendors. A summary of bids received is as follows: Goodwin Lawn Care $ 3, 300 per month Sparky' s Maintenance, Inc. 3, 420 per month White Cricket Lawn Care 4, 196 per month Delta Environmental Group, Inc. 4, 545 per month Nature' s Branch Landscaping, Inc. 5, 858 per month Harbor Lawn Maintenance 7, 983 per month The County Parks and Recreation Department has reviewed the bids and recommend the contract be awarded to Goodwin Lawn Care for one year at $3, 300 per month for a total of $39, 600. The Parks and Recreation Advisory Board ( PARAB) on September 18, 1986 reviewed and approved the awarding of the contract. Goodwin Lawn Care is currently performing maintenance of the above specified grounds for the 1985/86 fiscal year. Also, as new 1 facilities on the Courthouse Grounds are landscaped, the Parks and Recreation Department reserves the right to negotiate an addendum to the contract and submit to the Board of County Commissioners for approval . FISCAL IMPACT: Cost of $39, 600 to be paid for out of 1986/87 budget. Budget Impact : Fund: 001 General Courthouse Grounds Maintenance Agency: 113 County Manager Organization: 6333 Courthouse Grounds Maintenance. Funds in the amount of $48, 000 are budgeted for this contract. CONSIDERATIONS: Sealed bids for Bid # 86-1016 Park Entrance Signs were opened on August 27, 1986. Legal Notice appeared in the Naples Daily News on August 6, 1986. Invitations to bid were sent to fourteen ( 14) vendors. Bids required prices for delivery only and delivery and installation. On September 18, 1986 this recommendation was approved by the Parks and Recreation Advisory Board ( PARAB) . FISCAL IMPACT: This contract in the amount of $10, 525 is to be paid out of 1985/86 budget. SUBSTITUTING BERMUDA SOD FOR BERMUDA SPRIGGING OF ATHLETIC FIELDS AT NORTH NAPLES AND GOLDEN GATE COMMUNITY PARKS OBJECTIVE: To obtain approval of two change orders totaling 53, 382. 80 to McGovern Construction Corporation ( Sitework Finishes) for deletion of sprigging of grass to sodding grass on athletic fields. CONSIDERATIONS: In October of 1985 bids were opened for construction of both North Naples and Golden Gate Community Parks with estimated construction time completion was nine months. Due to construction delays primarily with the building contractor, sprigging the athletic fields has proven to be impractical at this time due to the following conditions: 4 1. The growing season is almost over. 2. Cooler weather will cause planted sprigs to become dormant and not fill in areas in sufficient time. 3. The ninety day grow-in period would further delay the opening of the parks beyond the first week in December as anticipated and the grow-in period could take longer to complete because of weather conditions. Change Order #5 for Golden Gate and Change Order #2 for North Naples for McGovern Construction in the amounts of $31,277. 42 and $23, 880. 98, respectively, are for the following: ,. On September 18th the Parks and Recreation Advisory Board ( PARAB) reviewed and approved the change orders. These change orders will increase the present contract of McGovern Construction per the following schedule: Golden Gate from $225, 489. 53 to $254,991. 35 North Naples from $197, 548. 26 to $221, 429. 24 FISCAL IMPACT: This change order in the amount of 53, 382. 80 to be paid out of fiscal year ' 86. Adequate monies are available for Golden Gate in the amount of $29, 501. 82 in account #306-113-6382_-6310,_.Parks. and Recreation Capital Improvement -Golden --- -= cqemy Gate Community Park. Monies for North Naples are available in reserves and staff recommends transferring $28, 250. 06 from 306-113-9010-9930 into 306-113-6383-6331. RECOMMENDATION: The Design Team, County Engineer, Parks and Recreation staff and PARAB recommends that the Board of County Commissioner approve the requested change orders totaling $53, 382. 80 to McGovern Construction. Brennan again is requesting the County Parks and d Recreation Department to perform maintenance on the Lely League Complex for fiscal year 1986/87 . to give you some history of the GCLL in relations to this Let me try request . Prior to 1983 , the League played their regular season games on school sites that this department maintained , P rimarily Avalon , Shadowlawn , and Tommie Barfield on Marco Island . The little league and our girl 's softball programs basically run at the same time and both leagues must share the same facilities . Weigel, Assistant County Attorney ��J (}\� RE: County Property Under 1986 Lease With Collier Model Aeronautics Club Upon a review of the above-referenced Lease Agreement in regard to your inquiry concerning use of the subject property aby the public when not used by the Lessee therein, my comments as follows : 1 . The use and restrictions on use of the premises are described in Articles V and X of the Lease. The obligations imposed upon Lessee clearly become more difficult to observe and certain of the requirements may defy Lessee compliance if the public were - to use the area when Lessee is not using it and otherwise not around. 2 . The standard insurance requirements that comprise Article VIII of the Lease fall upon the Lessee upon the unstated basis that the Lease does not provide for the demised premises to be held open for public use (See Articles V and VI) . I submit that the provisions, as drafted, are in the County' s interests and would require modification if the public obtains use rights under this Lease, as Lessee ' s insurable interests , risks and costs are , consequently redefined by the insuror. 3 . The concept of the Lease is to provide this particular Lessee the potential use of the subject premises at any time between 8 : 00 A.M. and darkness daily; this flexibility of use effectively removes the ability of the public to use the property during daylight hours at any random, stated or fixed time during such hours . 1 4 .
