LDR Subcommittee Minutes 02/01/2016 February 1, 2016 MINUTES OF THE COLLIER COUNTY DEVELOPMENT SERVICES ADVISORY COMMITTEE LAND DEVELOPMENT REVIEW SUBCOMMITTEE Naples, Florida, February 1, 2016 LET IT BE REMEMBERED, the Collier County Development Services Advisory Committee —Land Development Review Subcommittee in and for the County of Collier, having conducted business herein, met on this date at 3:00 PM in a REGULAR SESSION at the Growth Management Division Building, Room 609/610 2800 N. Horseshoe Drive, Naples, FL with the following persons present: Blair Foley Robert Mulhere (Excused) Clay Brooker ALSO PRESENT: Stephen Lenberger, Sr. Environmental Specialist Caroline Cilek, LDC Manager Jeremy Frantz, Sr. Planner Richard Henderlong, Principal Planner Ray Bellows, Planning Manager John Kelly, Planner 1 February 1, 2016 Any persons in need of the verbatim record of the meeting may request a copy of the audio recording from the Collier County Growth Management Division —Planning and Regulation building—Contact Mr. Evy Ybaceta at 239-252-2400. 1. Call to order Mr. Brooker called the meeting to order at 3:03pm and a quorum was established. 2. Approve agenda Mr. Foley moved to approve the Agenda. Second by Mr. Brooker. Carried unanimously 2—0. 3. November 12, 2015 meeting minutes correction Staff reported the County Attorney's Office requested Form 8B filed by Mr. Espinar be attached to the minutes. Mr. Foley moved to approve the November 12, 2015 corrected minutes. Second by Mr. Brooker. Carried unanimously 2—0. 4. Review Amendments Staff reported Subcommittee Member Robert Mulhere was not present but submitted an email dated January 28, 2016 which stated he had reviewed the proposed amendments and did not have any comments noting they were minor and sensible in nature. a. LDC Sections 2.03.03 and others—Correcting Cross-References , Conflicts and Scrivener's Errors LDC Sections: 1.08.02 Definitions, 2.03.03 Commercial Zoning Districts,2.03.06 Planned Unit Development Districts, 2.03.08 Rural Fringe Zoning Districts, 3.05.10 Littoral Shelf Planting Area(LSPA), 4.06.02 Buffer Requirements, 4.06.05 General Landscape Requirements and 5.06.00 Sign Standards and Regulations By Land Use Classification Staff reported the proposed amendment is to correct scrivener errors, incorrect cross-references, remove a duplicate permitted use in C-5 Zoning District, and address a missing cross-reference. Mr. Foley moved to recommend the proposed amendment be approved the proposed amendment as presented. Second by Mr. Brooker. Carried unanimously 2- 0. b. LDC Sections 3.02.10 and 5.03.06—Updating NGVD/NAVD Submittal Requirements LDC Sections: 3.02.10 Standards for Subdivision Plats, 5.03.06 Dock Facilities Staff reported the change is to replace outdated references to the National Geodetic Vertical Datum of 1929 (NGVD) with references to the North American Vertical Datum of 1988 (NAVD) in the above referenced sections. The change proposes to eliminate the requirement to provide both NAVD and NGVD for finished elevations and to use NAVD only given Federal Agencies and the County's Flood Damage Prevention Ordinance requires floor elevations using the NAVD standard. This would eliminate confusion as the LDC currently requires finished elevations on final plats to demonstrate both NAVD and NGVD. 2 February 1, 2016 Mr. Foley moved to recommend for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment as presented. Second by Mr. Brooker. Carried unanimously 2- 0. c. LDC Sections 3.05.07—Identification of Preserves (this item was heard before item 4.a) Staff reported the proposed change is to clarify that preserves are to be identified at the time of the first development order that requires the approval of a site plan. They noted the requirement to identify the location of preserves "at the time of first development order" is intended to apply to the first development order that requires approval of a site plan (including a conceptual site plan) and not to include land use petition submittals such as comprehensive plan amendments and straight rezones. Subcommittee discussion occurred on the language "The preserve shall be identified at the time the first development order submittal that requires approval of a site plan or development order" noting it would be beneficial to clarify the preserve identification is required at the time of "application" for the referenced site plan or development order, i.e. the language to read"first application submittal for a development order" or similar language. Mr. Foley moved to approve the concept subject to Staff revising the language as discussed above and returning the item to the Subcommittee for final consideration. Second by Mr. Brooker. Carried unanimously 2- 0. d. LDC Sections 6.06.03 and 10.02.11 —Submittal of Streetlight Plans Staff reported the proposed change is to alter the professional requirements for submitting streetlight plans from an"electrical engineer"to an"engineer" and delete the provision requiring an electrical engineer to install streetlights. They noted it will provide consistency with Section 10.02.04 B.2.e.iv which provides the applicant's engineer may design streetlight plans on private streets at the time of construction plan and final subdivision plat application submittal. Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment as presented. Second by Mr. Brooker. Carried unanimously 2- 0. e. LDC Sections 9.04.04—Specific Requirements for Minor After the Fact Encroachment Staff reported the change is to address a conflict between the criteria established in the administrative minor after-the-fact encroachment provisions. Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment as presented. Second by Mr. Brooker. Carried unanimously 2- 0. f. LDC Sections 10.02.03—Requirements for Site Development, Site Improvement Plans and Amendments thereof 3 February 1, 2016 Staff reported the proposed amendment is to expand the Site Development Plan—Insubstantial Change (SDPI)process to allow existing buildings, subject to the architectural standards of the LDC,to make architectural modifications through the SDPI process. Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment as presented. Second by Mr. Brooker. Carried unanimously 2- 0. g. Code of Laws Section 2-1156—Planning Commission Powers and Duties LDC Sections: Chapter 2—Administration, Article VII—Boards, Commissions, Committees and Authorities, Division 20—Planning Commission, Section 2-1156— Establishment; Powers and Duties Staff reported the proposed amendment it to update the powers and duties of the Planning Commission listed in the Collier County Code of Laws and Ordinances for consistency with Ordinance No. 99-95 regarding Preliminary Subdivision Plats. Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment as presented. Second by Mr. Brooker. Carried unanimously 2- 0. Requirements for SDPI Mr. Foley reported it would be beneficial to review the requirements for SDPI (Site Development Plan Insubstantial) especially those uses involving redevelopment parcels. Ms. Cilek reported there have been discussions on this item including recent changes proposed to LDC Section 5.05.08 (Architectural Standards) facilitating the redevelopment of existing parcels. 5.
