Right of Entry PROJECT: Vanderbilt Dr./Finger Streets PARCEL: Conner Park INSTR 5234442 OR 5246 P Folio: 27637800009 RECORDED 3/2/2016c8;55 PG 3897 DW1GHT E. - AM PAGES 1 COLLIER CO U�y FLERK OF THE CIRCUIT COURT DOC @70$0.70 LORIDA REC$10.00 RIGHT OF ENTRY KNOW ALL MEN BY THESE PRESENTS that COLLIER COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, whose post office address is 3335 East Tamiami Trail, Suite 101, Naples, FL 34112, hereinafter known as "Grantor", for and in consideration of Ten Dollars ($10.00) and other valuable consideration to them in hand paid, does hereby grant unto BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS THE EX-OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, whose post office address is 3335 Tamiami Trail East, Suite 101, Naples, Florida 34112, its successors, assigns, agents, or contractors hereinafter known as "Grantee", the temporary license and right to enter upon the lands of the Grantor, described as: LOTS 1 and 2, BLOCK V, Conner's Vanderbilt Beach Estates, UNIT No. 3, according to the Plat thereof, recorded in Plat Book 3, Page 89, Public Records of Collier County, Florida, to place or remove wastewater utility infrastructure and other equipment, appurtenant thereto. Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument and their respective heirs, legal representatives, successors or assigns, regardless of the number and gender in which used, shall be deemed to include any other gender or number as the context or the use thereof may require. THIS PROPERTY IS NOT GRANTOR'S HOMESTEAD ALL RIGHT AND PRIVILEGE herein granted shall remain in full force and effect for a period of one (1) year from the completion of the work pertaining to installation of the wastewater lines on the lands of the Grantors described above. This Right of Entry shall have full force and effect until the expiration of the contractor warranty for the construction relating to this project is completed, including, but not limited to final inspections, acceptance and payment of the contractor. ADDITIONALLY, the rights and interest granted hereunder are conditioned upon the reasonable exercise thereof by Grantee. Grantee agrees not to unreasonably interfere with Grantor's use of the lands described above, and agrees to provide Grantor with advance notice when exercising its rights hereunder. Grantee further agrees that it shall, at Grantee's cost, repair any surface damage caused to Grantor's property as a result of Grantee's exercise of its rights hereunder, in accordance with the Collier County Utility Standards.
