The following members attended. Adjournment ROLL CALL All members were present and a quorum was established AGENDA APPROVAL Dr. Trecker motioned, Mr. Streckenbein seconded to approve the agenda as amended with the addition of a discussion item "legal opinion regarding public funds for water treatment" as item #6c. The motion carried unanimously. APPROVAL OF 12/14/15 MEETING MINUTES Mr. Streckenbein motioned, Mr. Shepherd seconded to approve the 12/14/15 meeting minutes as amended. The motion carried unanimously. 1 Pelican Bay Services Division Water Management Committee Meeting January 19,2016 AUDIENCE COMMENTS Mr. Henry Bachman commented on PBSD water management easements and his belief of PBSD's violation of state statute forbidding"use of public funds for private benefit." THE CONSENSUS OF THE COMMITTEE WAS TO DISCUSS ITEM#6C IMMEDIATELY FOLLOWING AUDIENCE COMMENTS AS IT RELATED DIRECTLY TO HENRY BACHMAN'S COMMENTS COMMITTEE MEMBER SCOTT STRECKENBEIN LEFT THE MEETING AT 1:53 PM LEGAL OPINION REGARDING PUBLIC FUNDS FOR WATER TREATMENT Mr. Dawson recommended that the PBSD obtain a legal opinion from County Attorney Klatzkow as to the specific water management responsibilities of the PBSD. Mr. Dawson suggested that the PBSD is clearly mandated as the responsible party for the water quality of Clam Bay, and therefore it would follow that the PBSD must also be responsible for the lakes of Pelican Bay which all flow into the main water system and ultimately flow into Clam Bay. Mr. Dawson suggested that a legal opinion would clarify PBSD responsibilities for residents with different opinions on this issue, including those who believe that the PBSD is misappropriating public funds for private benefit. Dr. Trecker suggested that MSTBU funds are not public funds and are clearly identified to be used for the benefit of Pelican Bay residents only. He discussed the uncertainty of whether these MSTBU funds can be used for work on Pelican Bay private land. Dr. Trecker suggested that the PBSD water management of all Pelican Bay lakes, including private lakes, would benefit all Pelican Bay residents. Dr. Trecker provided a one page summary of his views on this issue which was added to the record. Ms. O'Brien suggested asking County Attorney Klatzkow to provide a list of documents he would require in order to provide a legal opinion on this issue. Mr. Dorrill reported that the PBSD holds the Pelican Bay master drainage permit. Agnoli, Barber& Brundage has been tasked to provide an audit trail of all of the Pelican Bay construction and operating water management permits; findings are expected to be provided next month. Mr. Cravens suggested that the committee waits to receive the Agnoli, Barber permit results and then discusses conclusions at a future meeting. The other committee members agreed. PLANNING FOR WQ WORKSHOP: DR. TRECKER'S VIEWS, SUGGESTIONS AND GOALS Dr. Trecker discussed his goals, objectives, and suggested format and program for the workshop. He provided a detailed outline for discussion points to be divided among Mr. Cravens, Mr. Dorrill, Ms. O'Brien, and himself. All of these ideas were included on a three page document which was added to the record. Copies of the brochure"Our Lakes in Pelican Bay" will be distributed at the workshop. Mr. Dorrill suggested including a discussion of the fertilizer used by PBSD and what types of fertilizer are recommended. WO WORKSHOP ROOM SET-UP 2 Pelican Bay Services Division Water Management Committee Meeting January 19,2016 The Committee discussed ideas for the Water Quality Workshop room set-up and agreed upon the following: (1) One table for the key PBSD speakers Mr. Cravens, Mr. Dorrill, Ms. O'Brien, and Dr. Trecker. (2) One table for the five other members of the Water Management Committee and the Clam Bay Committee. (3) Each audience member would be limited to one time at the podium for a question or comment. (4) Each audience member would be limited to three minutes. Lisa, Attached is estimated cost. The total area is based on the assumption of 2 feet width for 5,030 linear feet. The actual width could vary slightly, but this should be a good approximation. The unit cost is estimated at$30 per sq.yd.which is approximately the FDOT current unit cost,and is higher than the$24.67 cost from Quality Enterprises bid tab. As you had requested prior to the Christmas holidays,we should probably survey several locations to confirm the existing top of rock elevation to see if there are any variations. J a iewe y A. Based on a few site visits last week and our meeting on site Friday morning Dec. 11, it appears that the water level on the west side rises with tidal fluctuation,which deposits soil (dark Agenda Item#9 Page 2 of 3 mud)on the rock rip rap. In several locations the soil saturation and mud also occurs behind the rock at the edge of the grass bank and the grass is not growing all the way to the edge of the rocks. We checked the water level a few days during last week just prior to and after high tides but at each occurrence the water level did not reach the top of rock. I don't see that erosion is occurring because there is not evidence of the bank washing out, nor of any sand washing down from higher on the bank. There is a layer of fabric beneath the rock that is there to minimize and deter erosion and keep the dirt in place on the bank. It appears that the water rises at peak tides and stains most of the rocks up to or near the top of rock elevation. The soil is saturated in areas behind the rock which is too wet for the grass to root in that area. There are a couple of solutions that would improve the aesthetics and stabilization of the area behind the rock. One is to install a row of salt tolerant grass such as paspalum that would be more acclimated to brackish water. This species could be difficult to maintain and monitor, and to keep from growing between the rocks which might produce an irregular grass edge. Another option that might require less maintenance is to install a layer of rock higher up on the bank to provide a consistent grass edge. Fabric would not be necessary in this area. The rock could be placed on the bank where needed to blend in with the existing rock. Please let me know if you would like to explore these options and/or survey any of the existing bank elevations.
