Advisory Board and the Parks and Recreation Financial
Advisory Committee met on this date at 2: 06 P.M. in Building
"F" of the Collier County Courthouse Complex with the
following members present :

MINUTES OF JANUARY 20 , 19P2
The minutes of January 20, 1082 , were approved by a
general consensus of the Advisory Board .
DISCUSSION ON SPECIAL TAXING DISTRICTS AND IMPACT FEES .
County Manager Norman stated that the three major items
with reference to an impact fee were parks , transportation,
and public facilities, adding that parks lended itself as the
first priority to consider for an impact fee program . He
stated that impact fees have to be under the guidelines of
the Supreme Court which are geared only to future residents .
He stated that there are two types of facilities which would
fall under an impact fee , adding that one would be district
or community parks that would serve a population within a
three mile radius and the other would be county-wide parks .
He stated that the Board has directed Staff to work on a
proposal for a program for actual implementation of taxes
with regards to the dollar amount involved. Mr. Norman
questioned who would pay for the parks and would there be
enough interest involving construction and/or operation of
said parks . He reported that some meaningful graphics had
been prepared which would relate to the program that has been
approved to the limitations of the Comp Plan.
Community Development Administrator Virta referred to an
overhead chart stating that the areas identified apply to

district or community parks and serve a three mile radius .
He stated that the five major areas for parks would be South
Naples, East Naples, Golden Gate , Central Naples and North
Naples, adding that there is a possibility that Lely will
provide a site , further stating that Deltona Corporation is
providing 29 acres in the Marco Island area . He referred to
the chart indicating the 3 sites , plus Tmmokalee , in terms of
acquisition , stating that the sites are based on geographical
boundaries .
Fred Keyes stated that , as an alternative , if the sites
were broken into four or five areas , then each district could
be approached In an attempt to pass a referendum for that
particular area. He further noted that the issue is a
(2 county-wide taxpayers problem , adding that it is not going to
be incumbent upon the person that is going to pay for the
future .
County Manager Norman stated that the impact fee
proposal could be levied for any improvement that is needed
to serve today' s population, adding that there is a need that
has not been met whether it addresses a county-wide taxpayer
or a new resident . He stated that if the parks situation was
handled on a county-wide basis and then an impact fee was
imposed , there would still be a need to define the needs of
the parks as well as the area that would be served in order
that any taxes that are levied could be deducted before a fee

is charged to new residents to cover the impact fee they are
making on future improvements. Mr . Norman expressed his
concern that he wanted to be sure that the parks situation
was consistent with the Comp Plan and would also be something
that everyone could live with as far as what to do after the
land was purchased , adding that some areas should have an
option to create a taxing district . He referred to the chart
stating that there is R5% that does not have a park , further
noting that this percentage would still be paying but would
have no benefits.
Mr . Breeden questioned if there was a better idea than
an impact fee , to which Mr. Blunt stated that the land would
have to be acquired first which could come under a bond
issue , but would never work on an impact fee. Mr. Keyes
stated that the impact fees could be an alternative way to
get the five million .
County Manager Norman stated that before an impact fee
would stand up in court , the land for parks would have to be
acquired or there would have to be an assured program like
bonds being sold .
Mr . Chris Blunt stated that the question for the Ad Hoc
Committee is which way would be better , county-wide or
neighborhood-wide .
County Manager Norman stated that one step should be to
acquire the land , adding that the next step could be tax it

in order to build and then a taxing district could be created
in order to operate the parks .
Mr . Rollie Rice questioned whether a taxing district
would have organizations that would control what happens in
that district concerning parks .
County Manager Norman stated that there are two kinds of
taxing districts , one being an independent tax district which
is by election and the other being one that can be created by
the Board of County Commissioners. He stated that from a
practical point of view, a county-wide referendum to build
and a taxing district to operate is not the solution , adding
that his concern is to get over the first hurdle of acquiring
the land .
(:) Fred Keyes stated that there is a need to decide whether
the parks would be in a county-wide district or whether there
would be five independent districts.
Mr. Plummer stated that he felt the chance of getting
passage on a park in a certain area would be much better than
county-wide .
Mr . Rice stated that the Chamber of Commerce is looking
for projects to support , adding that they have indicated that
they will give full support for a plan regarding parks.
Mr. Keyes stated that it has been established that there
are two approaches, one being a referendum county-wide and
one being independent. He then questioned whether the

Planning Department could come up with more defined areas if
a decision was made to go with the five districts, adding
that he felt it would he easier to go with separate
districts.
Anne Goodnight moved , seconded by Leigh Plummer and
carried unanimously, that separate dependent taxing districts
be established for the parks program .
There was a general discussion regarding the Planning
Department making various proposals concerning districts .
Mr . Norman stated that there should be district boundaries
set before the idea is sold .
Mr. Keyes appointed a committee consisting of Leigh
Plummer , Chris Blunt, and Dan Breeden to meet with the
Planning Department to set boundaries for a final district
map to be brought hack to the next meeting .
There being no further business to come before the
Advisory Board or the Ad Hoc Committee , the meeting was
adjourned by order of the Chair at 1: 15 P.M.
