Committee met on this date at 9 : 15 A.M. in Building "F" of
the Courthouse Complex with the following members present :

MINUTES OF JANUARY 4 , 10.92
Mr . Egon Hill moved , seconded by Mr . Dan Breeden and
carried 7/0, that the minutes of January 4, 1982 be approved
as presented .
DISCUSSION REGARDING LAND ACQUISITION AND COST FACTOR OF
FUTURE PARK SITE.
Chairman Keyes indicated that County Attorney Pickworth
had been invited to discuss inverse condemnation, which
occurs by designating the land as recreational open space .
County Attorney Pickworth stated that the problem with
changing the land use designation of each property before the
government requires it or takes any formal steps to acquire
it , would be held to be a taken by the court , adding that the
owner could force the County to pay just compensation for the
property. He said that the only exception to this would be
if the property were ligitimately classified as a
recreational open space , adding that the only type of
property that falls into that category is a place like the
Grand Canyon . He reported that most property that is located
in such a place for a park would probably have a use for
something other than a park.
Mr. Dan Breeden said that at no time has the Parks and
Recreation Ad Hoc Committee ever downgraded any of this
property. He questioned if this property that is now zoned

Agriculture were to have a park constructed would this be
downgrading the property? He stated that at no time has the
Committee ever offered condemnation , adding that someone is
needed to present this to the zoning board so that the work
already done will, not be wasted .
County Attorney Pickworth stated that changing the land
use classification has nothing to do with the functions of
the Parks and Recreation Committee , adding that the committee
should be looking at the various sites , evaluating them, and
making a recommendation to the County which sites should be
acquired for parks. He reported that problems occur when
land use classification is interfered with , prior to the
government taking any formal action to acquire the property.
He concluded by stating that a step at a time must be taken
and the business of changing the property to recreational
open space is the wrong step at the wrong time.
Chairman Keyes indicated that the Commissioners have
authorized a referendum in the fall , adding that he would
like to have a specific site for a certain number of dollars
in order to sell the voters .
County Attorney Pickworth stated that he would suggest
that once the site has been decided on, the landowner could
be approached , to which Chairman Keyes stated that the
Committee has been prohibited from approaching the owners.

County Attorney Pickworth reported that the only other
suggestion would he to notify the Board that certain sites
have been selected and someone is now needed to contact the
landowners in order to determine the purchase price of the
property.
Mr . Leigh Plummer stated that there could be a
referendum on a bond issue for approximately 5 million to
cover the sites in order to receive the money before changing
the Comprehensive Plan or the zoning .
County Attorney Pickworth stated that technically you do
not have to change the Comprehensive Plan .
Mr . Rollie Rice stated that in talking with the public ,
the ultimate questions asked were, will there be a park if
the referendum is passed and where will it be located .
To Chairman Keyes question, County Attorney Pickworth
stated that the landowners that do not have an immediate need
for the land could indicate in a letter that they would be
willing to hold the land until such time as the County is
ready to purchase same. He stated that a site for a park
could be identified as well as the purchase price and the
development price for said site for the referendum , adding
that the site could either be bought or condemned .
Mr. Rice stated that there are 19 pieces of property
that need to be appraised , adding that this would be very
expensive for the County.

Mr. Hill stated that in order to get a bond issue the
sites did not need to be identified , adding that the sites
could simply be indicated by stating the number for each
district.
County Attorney Pickworth stated that his only
suggestion is to continue the process but delete land
classification on the property.
There was a general discussion regarding how much money
would be needed to purchase the park sites , with the general
consensus being five million. Mr . Rice indicated that this
figure might take care of the land but a cost factor is
needed for construction of the parks, adding that he did not
want to wait 8 years for another referendum before
construction could begin. Mr. Breeden indicated that there
could be extra money added initially to begin construction on
at least one park .
A general discussion developed regarding the cost of
land for parks for each district. Mr. Rice stated that there
was a cost factor breakdown plus the maintenance in his
report which should be looked at before final judgement is
made in reference to a figure for the referendum . He stated
that if a referendum was passed in September and the bonds
were sold , it would take at least two years before
construction could begin , adding that within that time there
will be a 20-40% cost factor in developing , due to inflation.

He indicated that it would be a year before all four sites
were ready to be let for bids. He stated that the cost
figures should be updated and advanced three to five years
and brought back to the next meeting .
Terry Clark , Planner , stated that there should be a
figure for acquisition and a figure for development .
To Chairman Keyes question, Mr. Rice stated that a
figure could be put on each district for land with a
construction figure added which would be a basic park ,
further stating that a site could then be selected and a park
constructed in each district according to those figures .
Mr . Leigh Plummer moved , seconded by Mr . Hill and
carried 7/0, that the committee ask the County Commissioners
to put on the referendum in November a proposal for a 5
million dollar bond issue for acquistion and initial
development of land for parks only in the four districts ,
excluding the City of Naples .
ADJOURNMENT
There being no further business , the meeting was
adjourned at 10: 15 A.M. by order of the Chair .
