AUDIENCE COMMENTS None 1 Pelican Bay Services Division Clam Bay Committee Meeting December 15, 2015 QUOTES FROM VENDORS FOR CLAM BAY MONITORING The committee reviewed the quotes received from three vendors for Clam Bay monitoring: Earth Tech $114,400, Kevin Erwin $179,473 and Turrell-Hall $169,277. Vendors Passarella and CBI chose not to bid. The FY16 budget for Clam Bay monitoring is $133,000. The quotes by the three vendors contained especially large discrepancies for the tasks (1) tidal flow monitoring, (2) water quality, and (3) annual estuary monitoring. The committee discussed whether Earth Tech needs further clarification as to what is required since this vendor's bid was significantly less than the other two bids. It was noted that one major contributing factor to Earth Tech's low bid is their significantly lower hourly rates. Adam Northrup, Collier County Procurement Specialist, suggested a meeting with Earth Tech to clarify each task and discuss expectations. If Earth Tech determines that they cannot provide the services required for the quoted amount of$114,400, then the PBSD may (1) go forward with making the award to the second lowest bidder, or (2) start the process over and send out request for quotes to the five approved vendors which may include additional clarifications in the description of tasks. Ms. O'Brien motioned, Mr. Hirniak seconded to recommend to the full PBSD Board a conditional award to Earth Tech for the Clam Bay monitoring subject to a subsequent meeting to be set up by our Procurement Specialist Adam Northrup to clarify Earth Tech's proposal. Mr. Dorrill will discuss this issue further with Dave Cook. REQUEST FOR OSPREY PLATFORM The committee reviewed a request from a resident asking for the PBSD to erect an osprey nesting platform just north of the Marker 36 Restaurant. Mr.Dorrill will provide cost information from the last platform erected a few years ago. MONTHLY REPORT ON COPPER AND TIDAL RATIOS The committee reviewed the monthly report on copper readings and tidal ratios. DRAFT DOCUMENT TO SOLICIT COSTS FOR CLAM BAY MONITORING FROM ELIGIBLE VENDORS Staff sent out requests for quotes for Clam Bay management plan activities to the five eligible vendors contracted for environmental and biological services by Collier County. The platform has been a center of interest for all of the residents of Pelican Bay and is probably one the most photographed objects in Pelican Bay. I have noticed that there is another pair of ospreys trying to nest on one of the large beach houses between Marker 26 and the Ritz.I would like to request that the Committee consider erecting a second platform between Marker 26 and the first beach house to the north of the restaurant. Last year an osprey attempted to build a nest on the top of a palm tree beside the south beach restaurant.The tree had been struck and!tilled by lightning.Needless to say,the attempt was a failure.Perhaps the Committee will put up a nesting platform for them.Ospreys are tolerant of other ospreys nesting near them.The pair on the existing platform between the restaurants won't be offended. I realize you are aware of the recent history and ecological concern in maintaining one of the most fragile natural inlets on the west coast of Florida. This application is not a new project,but a renewal of a maintenance permit previously in place for 10 years. in the interim, Collier County adopted a comprehensive management plan for Clam Pass in January of 2015,at the same time the state permit was approved. Recent conversation with Tim Hall, our biological consultant indicated we may be eligible for a nationwide hopper dredge exemption from National Marine Fisheries. However, to date we have only received a log number from U.S. Fish and Wildlife Agency; no communication or public comments. Failure to receive a new permit by February 1, 2016 will most certainly result in conflicts with sea turtle nesting season,resulting in further delays until November 2016. This is a critical period for the system as we end the rainy season and begin the arrival of cold fronts with increased directional wave action. The reduction in fresh water inflows and sustained winds associated with winter cold fronts cause immediate threats to the ebb-shoal and flushing efficiency of the inlet. I am sensitive to your response to our previous request for a status meeting in October,but feel at this point nothing is happening. OBJECTIVE: To facilitate the environmental and biological studies on an as-needed basis for Collier County departments. CONSIDERATIONS: In January of 2015,the Board of County Commissioners approved the Clam Bay Natural Resource Protection area Management Plan (item 1 IA, I/13/2015), which { provides guidance for future management activities within the Clam Bay Natural Resource { Protection Area. The objectives of this plan are to: 1. Maintain and protect the native floral and faunal communites in Clam Bay NRPA. 2. Ensure tidal and freshwater flows within Clam Bay NRPA. 3. Monitor and maintain water quality within Clam Bay NRPA. 4. Monitor archaeological sites within Clam Bay NRPA. 5. Ensure recreational activities are environmentally compatable with the Clam Bay NRPA. In order to accomplish these objectives, it is necessary to solicit services from experts in biological and environmental studies/monitoring. The scope of work and related services resulting from this contract are not considered architectural, engineering, landscape architectureal or surveying and mapping, and therefore, the solicitation process does not fall under the Competitive Consultant Negotiation Act(CCNA)requirements. The RFP was developed and designed to meet the needs of both PBSD and various County Departments: Pelican Bay Services Division: Activities may include, but are not limited to monitoring of the efforts of prior restoration activities, preparation for dredging activities, water quality analysis,monitor seagrass,anatize and report tidal data,etc. Other County Departments: Activities may include, but are not limited to wetland . delineation,wetland quality,mitigation,endangered species surveys,etc. RFP *15-6397 for Environmental &Biological Studies was publicly advertised on 2/24/2015. We have been trying to follow up on the hand dug channels to see if there is a blockage or if it might be some other issue. Right now it looks like the hand dug channels are working as intended, but the water levels up in this area have been higher than normal and we are seeing a lot of leaf loss and signs of stress in the younger trees. The City is taking actions to slow down boat speed in Doctors Pass &Moorings Bay. Excerpt from the "Agenda Memorandum": On Friday, December 4, 2015, FWC Fisheries and Wildlife Biologist Scott Calleson informed staff that the review of the Collier County manatee protection plan was now tentatively scheduled to begin in 2016. On January 4, 2016, City staff conferred with FWC staff regarding informational and regulatory options available to the City in this matter. It was determined that: (1) The City may apply for a permit to install informational signs on the current pilings in Moorings Bay. The informational signs may indicate "YOU ARE RESPONSIBLE FOR YOUR WAKE — RECKLESS/CARELESS OPERATION STRICTLY ENFORCED". On January 4, 2016, the required Florida Uniform Waterway Marker Application was completed and submitted. The PBSD Board has considered a similar course of action as the City's. This is a big red flag because it is likely that McAlpin will be given responsibility to contract for any boat-type dredge equipment as being cost effective to contract with a dredge operator for Clam Pass along with the county's beach nourishment projects...we know from past experience that McAlpin, and others see the ebb shoal as bonus sand that the permit does not specifically provide specific limits on how much excavation is allowed for passage to get equipment into Clam Pass. 4) Despite the PBSD having mapped surveys of seagrass areas that are more recent than 2013 and my having provided the codes for seagrass and tidal creeks to Tim Hall and the PBSD prior to finalization of the Clam Bay NRPA Management Plan Update, the graphics in the Corps proposed permit does not have the most recent maps of surveyed seagrass areas and the FLUCCS. map does not include codes or delineated areas of seagrass and does not include tidal creeks delineated areas. 5) Lastly, the bucket drawings are showing plans for cuts at specific stations in Sections B and C to be generally 100 foot widths AND the area between Sta. 13.00 to 15.00 looks like it could possibly be 200 plus foot widths. Such widths constitute creation of a sink area for collection of sand. Such designs are common for dredging of inlets as sand sources, but is counterproductive to improve tidal flushing of an inlet because it reduces the strength of the tidal ebb flow, thereby reducing its ability to scour out sand from the inlet.
