HEARING EXAMINER DECISION
PETITION NO. SV-PL20150002301 — WCI Communities, LLC requests a variance from
LDC Section 5.06.02 B.14.b, which allows one boundary marker sign with a maximum sign
face area of 24 square feet at each property corner of a residential development, to instead
allow one v-shaped boundary marker sign with a maximum sign face area of 36 square feet
on each of the two sign faces, for the proposed LaMorada residential development project
located on the southeast corner of the Immokalee Road and Woodcrest Drive intersection,
in Section 25, Township 48 South, Range 26 East, Collier County, Florida.
DATE OF HEARING: January 14, 2016
STAFF RECOMMENDATION: Approval.
FINDINGS:
Based on the applicant's written petition, testimony at the hearing of the applicant and the
recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section 5.06.08
B of the Land Development Code has been met and the petition is approved.
ANALYSIS:
Other than representatives of the applicant, there were no members of the public in
attendance for this item and there were no objections received by staff
DECISION:
Petition SV-PL20130002213, filed by D. Wayne Arnold, AICP of Q. Grady Minor and
Associates, P.A., representing WCI Communities, LLC, with respect to the property hereinafter
described, is hereby approved for a variance from Section 5.06.02.B.14b of the Land
Development Code to allow one v-shaped boundary marker sign with a maximum sign face area
of 36 square feet on each of the two sign faces, for the proposed LaMorada residential
development project located on the southeast corner of the Immokalee Road and Woodcrest
Drive intersection, in accordance with the Proposed Site Plan attached as Exhibit "A", and as
subject to the condition(s) set forth below.

LEGAL DESCRIPTION: Tract FD-1, the Plat of LaMorada, recorded at Plat Book 59,
Pages 1 to 15, the public records of Collier County, Florida.

CONDITIONS:
1. All other applicable state or federal permits must be obtained before commencement of
the development.
2. There shall be no additional on-premises signs, as referenced in LDC Section
5.06.02.B.6, on Immokalee Road.

any way create any rights on the part of the applicant to obtain a permit from a state or federal
agency and does not create any liability on the part of the county for issuance of the permit if the

agency or undertakes actions that result in a violation of state or federal law.
APPEALS:
This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as
amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners
or the Board of Zoning Appeals, as appropriate. Appeals must be filed within 30 days of the date
the Hearing Examiner Decision is rendered.
