A RESOLUTION CALLING REFERENDUM ELECTION IN COLLIER /- " COUNTY, FLORIDA, ON MARCH 11 , 1980, SUBMITTING TO ' • THE ELECTORS OF THE COUNTY FOR THEIR APPROVAL OR DISAPPROVAL, THE PROPOSAL THAT IN ADDITION TO ALL OTHER TAXES REQUIRED BY LAW, A ONE CENT (1 cent) TAX UPON • EVERY GALLON OF MOTOR FUEL AND SPECIAL FUEL SOLD IN . COLLIER COUNTY SHALL BE IMPOSED FOR THE PURPOSE OF PAYING THE COST OF ACQUISITION, CONSTRUCTION, AND RECONSTRUCTION, AND MAINTENANCE OF ROADS AND STREETS, ' PURSUANT TO FLORIDA STATUTES 336.021 ; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Florida Statutes Chapter 336.021 provides, as follows: (1) Any county in the state may, in the,,discretion of its governing body and subject to a referendum, impose, in addition to all other taxes required by law, a 1 cent tax upon every gallon of motor fuel y and special fuel sold in such county and taxed under the provisions _ of Chapter 206, for the purpose of paying the costs and expenses of establishing, operating, and maintaining a transportation system and related facilities and the cost of acquisition, construction, recon- struction, and maintenance of roads and streets. The governing body of the county may provide that the referendum be worded to limit the number of years such tax will remain in effect. Such tax should be collected in the same manner as all other gas taxes pursuant to Chapter 206 and be returned to the county where collected. The provisions of the s5. 206,29, 206.50, 206.625, and 206.64 shall be applicable to the tax herein levied. II(2) The additional gas tax collected pursuant to subsection (1) shall be transferred to a "local transportation gas tax trust fund",, which ------ fund is created for distribution as provided for in subsection (1). (3) It is expressly recognized and declared by the Legislature that the establishment, operation, and maintenance of a transportation system and related facilities and the acquisition, construction, reconstruction, and maintenance of roads and streets fulfills a county purpose and that i payment of the costs and expenses therefor may be made from county general _ . j: funds, special taxing district funds, or such other funds as may be auth- orized by special or general law. Counties are authorized to expend the funds received under this section in conjunction with the state or federal government in joint projects. WHEREAS, the increased use of the presently existing roads and streets by the ' increasing number of County residents, visitors, businesses and industries has caused 1 g in numerous instances an overcrowding and congestion on major roads; and, l� WHEREAS, it is deemed to be in the best interest of all residents, visitors, .- businesses and industries to have an adequate road system in Collier County, which is not choked with traffic congestion, pollution, and accidents; and, WHEREAS, the road improvements required for the growth which is forecasted to 4 ki continue in Collier County cannot be adequately financed through the existing revenue system; and • • January 8, I • • WHEREAS, it is recognized that the adoption of this additional one cent (lcent) tax will provide a portion of the funds necessary to maintain the current mobility and provide a safe and efficient roadway system in Collier County. NOW, THEREFORE, BE•IT ORDAINED BY THE BOARD OF COUNTY COMIMISSIONERS OF COLLIER COUNTY, FLORIDA, THAT: Section 1. In accordance with Florida Statutes, Chapter 336.021 , and other applicable law, a referendum election is hereby called and shall be held in Collier County, Florida, on Tuesday, March 11, 1980, for the purpose of submitting to the qualified electors of Collier County a proposal that in addition to all other taxes required by law, a one cent (1 cent) tax upon every gallon of motor fuel and special fuel sold in Collier County and taxed under the provisions of Chapter 206, Florida Statutes, shall be imposed for the purpose of paying the costs and expenses of - establishing, operating and maintaining a transportation system and related facilities and the cost of acquisition, construction, reconstruction, and maintenance of roads and streets. Section 2. There shall he at least thirty (30) days notice of the referendum election by publication in a newspaper of general circulation in Collier County. The publication shall he made at least twice, once in the fifth week and once in the third week prior to the week in which the referendum election is to be held. Notice shall be given in substantially the following form: NOTICE OF REFERENDUM NOTICE IS HEREBY GIVEN that a referendum election will he held throughout Collier County, Florida on March 11, 1980, for the purpose of determining the following question: SHALL A ONE CENT TAX ON EVERY GALLON OF MOTOR FUEL AND SPECIAL FUEL SOLD IN COLLIER COUNTY AND TAXED UNDER THE PRO- VISIONS OF CHAPTER 206, FLORIDA STATUTES, BE IMPOSED FOR A PERIOD OF THIRTY'(30) YEARS IN ADDITION TO ALL OTHER TAXES REQUIRED BY LAW FOR THE PURPOSE OF PAYING THE COST OF ACQUISITION, CONSTRUCTION, RECONSTRUCTION, AND MAINTENANCE OF ROADS AND STREETS WITHIN COLLIER COUNTY, AS PROVIDED BY FLORIDA STATUTES CHAPTER 336.021? The polls will be opened at the voting places on the day of said referendum election '' from 7:00 A.M. to 7:00 P. M. on the same day. All qualified voters residing within Collier County may vote in said referendum election. section 3. The Board of County Commissioners of Collier County recognizing the need for additional monies ,to maintain and provide a safe and efficient roadway system within the unincorporated areas of Collier County plans to use its portion of the funds realized from this levy solely for the costs of acquisition, construction, recon- struction, and maintenance of roads and streets. Section 5. This referendum election shall be held and conducted in accordance with the applicable provisions of the general law. , , Comnissioner Brown offered the foregoing Resolution and moved its adoption, seconded by Commissioner Pistor and upon roll call the vote was: AYE: Commissioners Brown, Pistor, Wimer, Archer and Wenzel.
