Adam Carney, Attorney for Mr. Smith was present and motioned for a continuance until the December hearing as he was recently assigned the case and wanted to interview witnesses and review the Ordinance in order to present a proper case on behalf of his client. The witnesses are necessary as a selective enforcement defense may be brought forth. Deputy Savel and Corporal Anthony were present and objected to the continuance. A copy of the Ordinance is available for today's hearing. Mr. Smith testified it has come to his attention he was issued a written warning on the violation by the Code Enforcement Office, which he did not receive. The issue is ongoing as he parks on the grass in the right-of-way because of poor drainage which floods his property. Collier County has failed to address the drainage issues in the neighborhood and other residents park vehicles on the grass and do not receive citations. Some enforcement resolution needs to be addressed by the County for a long term solution. Corporal Anthony testified the warnings were via phone conversations and is not relevant to the case. The case revolves around a citation issued for a parking violation. They are prepared to present their case today. Special Magistrate Garretson informed Mr. Carney, in regards to selective enforcement; parking in the grass along the side of roadways (cases) have been heard before. She granted him a brief recess to review the Ordinance. The case was recalled at 10:23 a.m. Mr. Carney reiterated his Motion for a Continuance noting there are drainage issues in the area directly associated with the case. Corporal Anthony testified Mr. Smith has been given a verbal warning on the parking violation in the past and has become confrontational. One of the issues is the numerous items on Mr. Smith's property encumbering the parking area. Special Magistrate Garretson CONTINUED the case to give the parties (County/property owners) an opportunity to resolve the issue so it does not become a reoccurring violation. 3 November 6, 2015 IV. Ranger Maunz testified: • The photo he took that day does not show a launch sticker on the trailer. • The trailer on site that day appears to be a different trailer than that shown in Mr. Gooding's photo. • The launch sticker is required to be posted on the winch post of the trailer. • He speculates Mr. Gooding had a different trailer, without a boat launch sticker on site the day in question. Bill Monetta testified he was present with Mr. Gooding at the boat launch the day of the incident and verified the trailer in question had the required launch sticker on it. He does not own a trailer and Mr. Gooding only owns one trailer.
