described herein is made this 5~ day of January, 1998 by TRG NAPLES, INC. (herein
referred to as SELLER), and the Board of County Commissioners of Collier County,
Florida as the governing body of Collier County and as Ex-Officio the Governing
Board of Collier County Water-Sewer Distrct its successors and assigns, (herein after
referred to as BUYER),
WITNESETH
That said SELLER, for and in consideration of the sum of Ten Dollars ($10.00)
and other good and valuable consideration to said Seller in hand paid by the said Buyer,
the receipt whereof is hereby acknowledged, has granted, bargained, sold, transferred,
setover and delivered, and by these presents does grant, bargain, sell, transfer, set over and
deliver unto the Buyer, and the Buyer's heirs, successors and assigns forever, the sewer
utility along the Pine Ridge Right of Way (Sewer Only), together with non-exclusive
appurtenant easement rights for the operation, installation and maintenance of said
facilities, situate, lying and being in Collier County, Florida, to wit:

The Seller, for itself and its successors, hereby covenants to and with the Buyer
and its successors and assigns that it is the lawful owner of the said goods and chattels
herein referred to as utility facilities; that it has the good right, title and authority to sell

of all persons whomsoever. Seller and Buyer are used for the singular or plural as the
context requires.

This is to inform you that the above referenced project has been granted preliminary approval on
January 30, 1998 by Engineering Review in compliance with Collier County Land Development
Code, Section 3. All water and/or sewer facilities approved, accepted and required to be
maintained by Collier County shall be conveyed to the County pursuant to the provisions set
forth in Collier County Ordinance No. 97-17, as amended.
You are reminded that it is your responsibility to petition the Development Services Director for
final approval of the improvements upon the expiration of the minimum one (1) year
maintenance period. After satisfactory completion of all final inspections., the Board of County
Commissioners shall grant final approval of the required improvements establishing County
responsibility for maintenance of the required improvements if it is the Board's desire to accept
and maintain the facilities.

KNOW ALL PERSONS BY THESE PRESENTS: that TRG Naples, Ltd, 2828 Coral Way,
Penthouse Suite, Miami, Florida 33145, and Hartford Fire Insurance Company, Hartford Plaza, Hartford,
CT 06115, are held and firmly bound unto Collier County, Florida, in the total aggregate penal sum of
Eleven Thousand Five Hundred Fifty-Five & 95/100 Dollars ($11,555.95) in lawful money of the United
States, for the payment of which sum well and tntly to be made, we bind ourselves, our heirs, executors,
administrators, successors, and assigns, jointly and severally, firmly by these presents. Owner and Surety
are used for singular or plural, as the comext requires.
THE CONDITION OF THIS OBLIGATION is such that whereas, Owner entered into a certain
Utilities Facilities Construction Contract, dated the 24th day of November, 1997, a copy of which is hereto
attached and made a part hereof, and
WHEREAS County has a material interest in the performance of said Contract; and
WHEREAS County has adopted Ordinances and Resolutions (hereinafter "Land Development
Regulations") concerning Owner's obligation to County regarding the construction conveyance and
warranty of water and wastewater facilities at the La Costa Naples constructed within the unincorporated
area of Collier County;
NOW, THEREFORE, if Owner shall well, truly and faithfully perform its obligations and duties
to County under said Land Development Regulations and all the undertakings, covenants, terms,
conditions, and agreements of said contract during the origina! term thereof, and any extensions thereof
which may be granted by Owner, with or without notice to the Surety and during the guaranty period
established by. County, and thereafter, and ff Owner shall satisfy, all claims and demands incurred under
such contract, and shall fully indemnify and save harmless County form all costs and damages which it
may suffer by reason of failure to do so, and shall reimburse and repay the County all outlay and expense
which County may incur in making good any default, then this obligation shall be void, otherwise to
remain in full force and effect.
PROVIDED, FURTHER, that the said Surety, for value received hereby, stipulates and agrees
that no charge, extension of time, alterations or additions to the terms of the contract or to work to be
performed there or the specifications accompanying same shall in any way affect its obligation on this
Bond, and it does hereby waive notice of any such change, extension of time, alterations or addition to the
terms of the contract or to the work or to the specifications.
PROVIDED, FURTHER, that it is expressly agreed that the bond shall be deemed amended
automatically and immediately, without formal and separate amendments hereto, upon amendment to the
Contract not increasing the contract price more than 20 percent, so as to bind the Owner and the Surety to
the full and faithful performance of the contract as so amended. The term "Agreement," wherever used in
this bond, and whether refemng to this bond, the Contract or other documents shall include any
alterations, addition or modification of any character whatsoever.

On November 5, 1997, a pressure test was conducted on the 6" sewage force main at the
above referenced project. The test was attended by the representatives of the Owner,
Contractor, Collier County Utilities, and the Engineer of Record.
During the course of the two (2) hour test, no loss of pressure or leakage was noted in the
main.
This is to certify that the forcemain at the above referenced project has satisfactorily
passed the required pressure test.

period of at least one year from the date of acceptance of Collier County Board of
County Commissioners:

Located and described as a portion of land lying in Section 13, Township
49 South, Range 25 East, Collier County, Florida.
The undersigned party further agrees that they will at their own expense, repair
and replace all such defective work and ali other work damaged by said defective work
under this warranty-guarantee. It is further understood, that the consideration for the
giving of this warranty and/or guarantee is required by the general conditions and
specifications under which this contract was let.
