LDRSC Minutes 10/30/2014 Land Development Review Subcommittee of the Development Services Advisory Committee Minutes October 30 , 2014 October 30, 2014 MINUTES OF THE COLLIER COUNTY DEVELOPMENT SERVICES ADVISORY COMMITTEE LAND DEVELOPMENT REVIEW SUBCOMMITTEE Naples, Florida, October 30, 2014 LET IT BE REMEMBERED, the Collier County Development Services Advisory Committee Land Development Review Subcommittee in and for the County of Collier, having conducted business herein, met on this date at 3:00 PM in a REGULAR SESSION at the Growth Management Division Building, Room 609/610 2800 N. Horseshoe Drive, Naples, FL with the following persons present: Clay Brooker. Esq. Robert Mulhere, FAICP 61 Eleanor Taft, Esq. ALSO PRESENT: Caroline Cilek, LDC Manager Stefanie Nawrocki, Planner 1 October 30, 2014 Any person in need of a verbatim record of the meeting may request a copy of the audio recording from the Collier County Growth Management Division, Department of Planning and Zoning. 1. Call to Order Mr. Brooker called the meeting to order at 3:10p.m. and a quorum was established. 2. Approve Agenda Mr. Mulhere moved to approve the Agenda. Second by Ms. Taft. Carried unanimously 3—0. 3. Approve prior meeting minutes: September 24,2014 Mr. Mulhere moved to approve the minutes of the September 24, 2014 Subcommittee meeting as presented Second by Ms. Taft Carried unanimously 3—0. 4. Amendment Discussion a. 5.05.14 Cannabis Farms and Medical Marijuana Dispensaries Ms. Cilek provided the following proposed amendment for review. LDC SECTION(S): 1.08.02 Definitions 2.03.03 Commercial Zoning Districts 5.05.14 Cannabis Farms and Medical Marijuana Dispensaries The proposed amendment seeks to introduce regulations regarding the production and dispensing of medical marijuana. It seeks to allow medical marijuana dispensaries through the conditional use process established in LDC Section 10.08.00 within the C-4 and C-5 zoning districts. In addition, site design and safety standards are established to protect the health, safety, and welfare of the general public from associated secondary effects. Ms. Cilek reported polls indicate the amendment will not receive 60 percent of the required vote, and the Subcommittee could choose not to review the proposed amendment should they so desire. The Subcommittee determined to review the proposed amendment Ms. Cilek noted: • The proposed amendment was the result of a directive from the Board of County Commissioners,no guidelines for developing the amendment were provided however the GMD Administrator advised Staff to craft an amendment that was `restrictive" in nature. • In developing the guidelines, Staff researched other jurisdictional requirements throughout the country and in the State of Florida where most of the guidance was obtained. • Staff intends to incorporate the prohibition of"mobile units" and/or delivery services into the proposed amendment. The Subcommittee noted: • It may be beneficial to allow the activity in the C2 and C3 zones as a conditional use because as currently proposed,there are few locations, if any available for the use. 2 October 30, 2014 • The concept of utilizing proposed separation requirements as based on those for sexually oriented businesses. • The County should ensure any security measures required under the proposed amendment have been provided by those undertaking the business. • For those parties reviewing the amendment, it may be beneficial to develop a map identifying where the use would be allowed, or in lieu of this, a calculation on how many acres in the County are available for the use. • Staff should consider contacting other jurisdictions who have adopted similar ordinances to ascertain their experiences on any rules implemented regulating the activity. Public Speakers Bill McDonald Collier County Sheriff's Office noted the business is a"cash business." Federal Law does not allow the use of banks for holding of funds garnered from the activity. He recommended the installation of security cameras at multiple locations (entrance area, transaction point, safe location, etc.) to deter crime and increase the potential for solving them should they occur. Additionally, an audible alarm system be required during "non business hours. Staff noted they would contact Mr. McDonald for assistance in developing any additional detailed security measures that may be incorporated into the proposed amendment. Pat Barton,Drug Free Collier expressed concern on the "unintended consequences" of Amendment 2 should it pass. Based on statistics from California, the average user of medical marijuana are males 20-36 with a history of drug abuse, and receiving treatment for"pain." Amendment 2 as proposed is too lenient as it is absent of restrictions for age and does not specify the types of debilitating conditions present in a patient before permission to use the substance is granted. 5. Outline Recommendations to DSAC The Subcommittee noted consideration should be given to permitting as a conditional use in the C2, C3 and C4 zones and for a map to be developed which depicts how much commercial land, in numbers of acres are available for the use. 6.
