MINUTES OF THE COLLIER COUNTY DEVELOPMENT SERVICES
ADVISORY COMMITTEE LAND DEVELOPMENT REVIEW
SUBCOMMITTEE
Naples, Florida, September 8, 2014
LET IT BE REMEMBERED, the Collier County Development Services Advisory
Committee Land Development Review Subcommittee in and for the County of Collier,
having conducted business herein, met on this date at 8:30 AM in a REGULAR SESSION
at the Growth Management Division Building, Room 609/610 2800 N. Horseshoe Drive,
Naples, FL with the following persons present:

1. Call to Order
Chairman Brooker called the meeting to order at 8:34am and a quorum was established.
2. Amendment Discussion Continued
a. 5.05.05 Automobile Service Station—Changes regarding location and number of fuel pumps.
Ms. Cilek provided a copy of the revised Draft for review.
Mr. Mulhere queried if the recommended change of the term fuel pump to fuel position was
incorporated into the draft.
Ms. Cilek reported Staff has determined it would be prudent to utilize the term fuel pump as it is
consistent with other jurisdictions and recognizable to the general public.
Chairman Brooker queried on an explanation on the rationale for the threshold of 8 fuel pumps as a
more appropriate measure to address impacts of Benzine emissions may be volume of distribution.
Ms. Cilek reported research indicates the threshold is consistent with other jurisdictions in Florida
and the nation.
Ms. Cilek reported the definition of"airline measurement"has been clarified to specify the
residential lot line, not the structure. It is intended to include the area available for use by residents
of a property, but does not include distances to buffers, preserves, conservation easements, etc.
Mr. Mulhere reported lighting requirements should be addressed holistically in the LDC for all uses
in proximity to residential uses, not just automobile service stations.
Staff and the Subcommittee reviewed the draft amendment and the following responses to
Subcommittee recommendations from the previous meeting:
• Provide additional background information. Staff response - The Change and Reason
sections have been revised to incorporate more background information.
• Define what large gas stations are. Staff response - The amendment provides a distinction in
the process for automobile services stations with over 8 fuel pumps.
• Rename "fuel pump" to "fuel position" Staff response - "Fuel pump" is a common and
recognizable term used by the general public and it is important to use terms that will be
understood by lay persons.
• Define "airline measurement."Staff response -This has been amended.
• Include more recent studies/data. Staff response —A 2011 EPA study regarding school siting
guidelines has been included as well as standards imposed by other communities, including
some in Florida.
• Recommendation to address site design provisions within LDC section 5.05.05 be included
in the future and the appropriate design professionals, including but not limited to the
following: lighting, landscaping, banding for canopies/canopy, signage percentage changed
and bathrooms to be locate inside the structure.
• All public comments form the meeting have been included.

Specific text recommendation
The Subcommittee recommended 5.05.05.C.2 line S from "...the following shall be considered... "
to "...the following may be considered..."
Speakers
Dalas Disney Architect/DSAC member noted under Section 5.05.05.N consideration should be
given to requiring generators be on site for post storm recovery services for all gas stations. If
Benzine vapors are a major concern, it should be addressed by the State of Florida, not locally. High
intensity lighting is a concern for other uses such as automobile dealers and should be addressed for
all commercial uses with appropriate design standards being developed.
Tom Hardy, RaceTrac wanted to ensure architectural considerations are given for the design of
stations, including banding and branding options, flexibility in designs of pump islands, etc.
Ms. Cilek reported the Board of County Commissioners direction did not address reviewing
architectural standards; however, a recommendation could be made for this to be addressed
including interior restrooms, lighting, landscaping, etc.
Lee Van Gelder, Collier County Sheriff's Office wanted to ensure consideration is given to the
design criteria to mitigate opportunities for crime and improve safety such as landscaping
considerations, berms around the perimeters of properties creating a"fatal funnel," etc.
Mr. Mulhere moved to recommend the Board of County Commissioners direct Staff to work with
representatives of the Collier County Sheriffs Office review the CPTED (Crime Prevention
Through Environmental Design) to address any environmental standards in the Land
Development Code for improving security and safety of properties. Second by Mr. Brooker.
Carried unanimously 3—0.
3. Outline Recommendations to DSAC
The Subcommittee discussed possible recommendations to the full DSAC Committee.
Mr. Mulhere moved to recommend the Development Advisory Service Committee recommend the
Board of County Commissioners approve the proposed amendment subject to addressing site design
provisions within LDC Section 5.05.05 in this amendment cycle, and if not in this cycle, direct staff to
include them in the next amendment cycle including the following:
a. Lighting—address lighting comprehensively as it relates to commercial uses adjacent to
residential uses.
b. Landscaping
c. Branding and banding color schemes for canopies.
d. Increase the allowed signage percentage from eight percent to ten percent of the canopy front.
e. Bathrooms to be located inside the automobile service station building.
Without a second, the motion was not considered.
Chairman Brooker reported he was not in favor of the proposed motion as the C-4 zone allows many
high intensity uses such as pharmacies, fast food establishment, hospitals, supermarkets, etc. absent of
the distance requirement proposed for automobile service stations. It would not be equitable to single

out a particular commercial use such as an automobile service station while other uses may create
similar impacts on residential properties.
Ms. Taft agreed and doesn't believe Benzine emissions are a major issue in relation to automobile
service stations, and expressed concern on the rationale for the 8 fuel pump threshold and how the
distance requirement is defined in the draft amendment.
Mr. Mulhere noted the proposed amendment has been prepared at the direction of the BCC and
expressed concern it may be adopted absent of any Subcommittee recommendations. It may be prudent
to craft a motion to ensure, if it is to be adopted, the concerns raised by the Subcommittee are addressed.
Chairman Brooker moved to recommend that the proposal as drafted not be adopted, but the
comments and issues that have been raised(during Subcommittee discussions) are worthy of
consideration. If the amendment were to be drafted it should not include zoning districts C-4, C-5,
and Industrial whereby it would be more worthy of consideration. Second by Ms. Taft. Carried
unanimously 3—0.
4. Next Meeting for other LDCA's
The next meeting will be held on September 24, 2014 at 10:00am
