AGENDA APPROVAL Mr. Cravens motioned, Dr. Chicurel seconded to approve the agenda as submitted. The motion carried unanimously. APPROVAL OF 9/24/14 MEETING MINUTES Mr. Cravens motioned,Mr. Dawson seconded to approve the 9/24/14 minutes with the following corrections: on Page 1, Mr. Dawson should be listed under"Also Present" along with Dave Cook and Jim Hoppensteadt; on Page 2, in the March 18 meeting minutes,the second line should read, "motion makers and both results; in the April 8 minutes, the starred last line should be "temetry"; on Page 3, at the top of the page,the heading should read "May 14 Workshop Minutes" and Ted Raia, Brad Cornell and Maura Krause should also be listed as Clam Bay Stakeholders; in the 10th line from the top it was Dr. Dabees who suggested that Mr. Hall should craft the language; on Page 4, near the bottom, the sentence beginning, "A letter of modification" should then read. "to the permit for the flushing cuts for the new sampling stations." Under Clam Bay Copper, the second line should read, "upper, inner and outer Clam Bay"; on Page 5, at the top, after the words "measurements taken", the words "several years ago" should be added and the word "upper" should be changed to "inner" in that line; under Suggested edits for RFP, the second line should read, "to include faunal and vegetative communities." The motion then carried unanimously. AUDIENCE COMMENTS Ms. Linda Roth was concerned about the percentage of silt content in the permit application. UPDATES ADDING OYSTERS IN CLAM BAY Mr. Hall is consulting with an expert to determine the steps to move this project forward. 2 Clam Bay Committee of the Pelican Bay Services Division April 23, 2015 Meeting Minutes KAYAK SAFETY IN OUTER CLAM BAY Mr. Dorrill is awaiting a response from the County's Parks and Recreation Department. QUOTES FOR TIDAL GAUGES The County's Purchasing Department decided to put this item through the formal bidding process as the vendor raised its price. WATER QUALITY DATA INTO STORET Data from the first quarter of 2015 is expected to be entered into STORET soon. CLAM BAY MONITORING WORK ORDER FOR TURRELL-HALL Mr. Hall's contract has been extended, and a work order was authorized. VENDORS SELECTED VIA RFP The County selected five vendors to contract for environmental services including Clam Bay monitoring. CHANGE ORDER FOR TURRELL-HALL This change order was authorized previously for the additional work Mr. Hall is to do, which will include shore bird monitoring before and after a dredging event. WQ ANALYSIS REPORTS/PARAMETERS FOR CLAM BAY & BERM SITES Mr. Cravens motioned, Mr. Dawson seconded to recommend to the full Board that testing on the berm sites would be for the parameters and times required by the South Florida Water Management District permit. The motion carried unanimously. QUOTES/BIDS FOR BATHYMETRIC SURVEYS A bathymetric survey of Clam Pass and the interconnecting waterway was done recently at a cost of$8,500. Dr. Dabees explained the problems occurring within the Pass, and stressed the need for the permits that will allow them to take action when it is necessary. The results of the survey would be available by the next meeting. USACE PERMIT APPLICATION MANAGEMENT PLAN SUBMITTAL Mr. Hall is scheduling a site visit with the appropriate agencies. 3 Clam Bay Committee of the Pelican Bay Services Division April 23, 2015 Meeting Minutes PUBLIC COMMENTS TO DATE The Army Corps of Engineers received some public comments and if the Corps determines these comments are valid then they would submit a request for additional information for which Mr. Hall would prepare a response. Mr. Hall would advise the Army Corps of Engineers that the Management Plan recently submitted per the BCC's direction is intended to be an integral part of the permit application. FDEP PERMIT MODIFICATION APPLICATION MAXIMUM DREDGE CUT IN SECTION A Humiston and Moore Engineers submitted information to the FDEP that clarified the maximum dredge cut of Section A. 5 PERCENT SILT CONTENT The Committee discussed creating an internal document indicating the intent that when sand is placed on the beach north and south of the Pass, it would contain no more than 5 percent silt content; however,the permit modification application would not be changed. ADJOURNMENT Mr. Cravens motioned, Dr. Chicurel seconded to adjourn. USACE PERMIT APPLICATION UPDATE Mr. Hall reported that the Army Corps of Engineers received public comments regarding the permit application and a site visit would be scheduled with the Army Corps of Engineers, Fish& Wildlife and National Marine Fisheries. If any of the public's comments or concerns were validated during the site visit, the agencies would request additional information and Mr. Hall would prepare the appropriate response. FDEP PERMIT MODIFICATION The FDEP permit modification application was submitted and is expected to be authorized following the 90-day review period. ADDING OYSTERS TO CLAM BAY Mr. Bachman motioned,Mr. Hirniak seconded to recommend to the full Board approval for the 15 oyster recruitment sites in Clam Bay at a total cost not to exceed $1,500. The motion carried unanimously. WATER QUALITY DATA INTO STORET/WIN Mr. Hall explained the ongoing problems associated with STORET software and that STORET would be replaced in 2017 by WIN software, which is web-based. Mr. Hall would enter data from 2012 through the first quarter of 2015 into STORET and any data after the first quarter of 2015 would be held and entered into WIN as soon as the software is available. 2 Clam Bay Committee of the Pelican Bay Services Division May 27,2015 Meeting Minutes TIDAL GAUGES The tidal gauges were ordered and delivery is imminent. Installation of the gauges would follow. EXOTIC REMOVAL (ADD-ON) The grant that Coastal Zone Management received to remove exotics was provided to the Committee. WATER QUALITY PARAMETERS MEASURED BY COUNTY LAB Mr. Bachman moved, Mr. Hirniak seconded that a recommendation be made to the full Board that the PBSD go back to the parameters and 12-month testing of the berm sites to be consistent with the management plan. The motion carried unanimously. COPPER IN CLAM BAY The Committee reviewed the April copper data done by Benchmark Labs. MONTHLY UPDATES ON TIDAL AND COPPER DATA The Chairman requested tidal and copper data be provided to the Committee on a monthly basis and Mr. Dorrill would evaluate the possibility of providing this. BATHYMETRIC SURVEY Dr. Mohamed Dabees reviewed the results of the recent bathymetric survey. OTHER Dr. Trecker was interested in whether adequate samples were collected to account for outlier parameters related to conductivity. ADJOURNMENT Mr. Bachman moved, Mr. Hirniak seconded to adjourn. MARINE&ENVIRONMENTAL CONSULTING 3584 Exchange Avenue, Suite B •Naples, Florida 34104-3732 • (239) 643-0166 • Fax (239) 643-6632 MEMORANDUM TO: PBSD c/o Neil Dorril FROM: Tim Hall DATE: July 28, 2015 RE: Site visit with USACE and NMFS Neil, Arielle and I met with Mark Sramek and Brianne Mcguffie on the 23rd of July to conduct a site visit of the Pass and waterway. Brianne is the project reviewer for the US Army Corps of Engineers and Mark is with the habitat management division of the National Marine Fisheries Service. Jeff Howell for the Fish and Wildlife Service cancelled and was not at the site visit. We had an updated seagrass survey that we shared with the reviewers and they spent the most time in Section C and at the throat of the Pass verifying that there were no submerged resources within the proposed dredge footprint and generally reviewing the on-the-ground conditions. Both were satisfied with the descriptions that we had provided and agreed with our assessments that there was little potential for any impacts to submerged resources. The proposed buffers from the mangroves and seagrasses seemed to satisfy them. Both indicated at the end of the site visit that they did not have any further questions and didn't see why the project could not go forward as proposed. MARINE & ENVIRONMENTAL CONSULTING 3584 Exchange Avenue, Suite B •Naples, Florida 34104-3732 • (239) 643-0166 • Fax (239) 643-6632 MEMORANDUM TO: PBSD Clam Bay Committee do Neil Dorrill FROM: Tim Hall DATE: August 21, 2015 RE: August 26 Meeting updates Neil, Since I will have limited time at the upcoming meeting I thought it might be easier to provide a written summary of the status of various projects so that my time on Wednesday could be used answering any questions you or the Committee might have. STORET Data from 2012 through 2014 has been submitted to FDEP. As of today (August 21) we are waiting on their acknowledgement that there are no more issues and files can be uploaded into the database. Data from January through April 2015 will follow once we have the OK that current submittal has been uploaded. Data from May on (when we switched from 5 to 9 monitoring stations in the Bays) will be held until new system (WIN) is in place which will supposedly replace STORET. OYSTER RECRUITMENT Oyster condos have been deployed for almost two months. We will be retrieving them in a couple of weeks in association with the mangrove monitoring. Preliminary field review showed that we have had some recruitment on stations south of the Pass though stations north of the Pass have not been checked yet. BIOLOGICAL MONITORING Seagrass surveys along the permit transects has been completed. Seagrass coverage this year was higher than last year. New seagrass bed was also observed on shoal immediately south of the County Boardwalk. This updated information was used during the agency site visit on July 23. Mangrove monitoring will be starting Monday August 24. Shorebird monitoring to stay current for the anticipated permit and biological opinion requirements is ongoing. TIDAL GUAGES Interim gauges are still deployed. Brackets for new gauges should be installed in Upper and Inner Clam Bay by the Wednesday meeting. Issues with my foot have slowed me down a bit getting them deployed. I am still shooting to have them all out by the end of the month. COPPER SAMPLING Data from June and July was submitted in tabular format on an aerial for review. June readings were very good while July showed some increases in levels across the board, most likely due to heavy rain events pushing remnant copper through the system from the development areas. PERMITTING The permit modification from FDEP was issued on August 11. The USACE and NMFS conducted a site visit on July 23. At the end of the site visit both representatives indicated that they were satisfied the material and exhibits we submitted were a good representation of the system and had no issues with the project proposal. As you know,last year we did not fly this aerial as a result of the confusion from Kyle leaving and Marion coming on board. We instead utilized the Collier County aerial photography(which is now being flown every year though in January instead of July)along with some oblique aerials from July that we also had available. If the PBSD Board is agreeable with utilizing the existing County aerials and flying the entire system obliquely,then I believe we should request a permit modification to the hand-dug channel operations permit to allow for that instead of the large rectified aerial that has been required and flown for the past 15 years or so. You are granted much power and responsibility via multiple Ordinances, together with the Letters of Agreement/Understanding, negotiated by concerned PB leaders and the Board of County Commissioners. In the best interest of the Community, the Board must preserve and retain the powers and rights of the PB MSTBU. Do not allow others to diminish them. The Functions, Powers and Duties of the PBSD Board are listed in Ordinances 2002- 27, 2006-05, 2013-19, 2013-61. The Amended Memorandum of Letter of Agreement/Understanding for the BCC and the County Manager with the PB MSTBU Board is a component of the above Ordinances. It clearly defines the authority and responsibility of the PBSD Board. It states that: 1. The Functions, Powers and Duties of the PBSD Board are listed in the Ordinances. 2. The BCC shall accept the direction of the PBSD Board in its policy decisions relating to the PB MSTBU, to the maximum extent allowed by law, unless and except when there is some overriding governmental reason to do otherwise. 3. All ultimate policy making powers are reserved unto the BCC, sitting as ex-officio Board of the PB MSTBU pursuant to Florida Law. (That's the reason some decisions made by the PBSD Board require BCC approval) 4. The County Manager shall accept the direction of the PB MSTBU Board in its exercise of decision and control of the day to day operations, to the maximum extent allowed by law, unless and except when there is some overriding governmental reasons to do otherwise. 5. All ultimate administrative and ministerial powers related to the operations of PB MSTBU are retained by the County Manager, under the policy direction of the BCC, sitting as the ex-officio Board of the PB MSTBU. The salaries of the PBSD Administrator and staff are paid by the PB MSTBU. Their duty is to implement the decisions made by the PBSD Board (some decisions require BCC approval, e.g., annual budget, Clam Pass). The Administrator is wrong in saying that the Board cannot make decisions, and that it is only an advisory committee to the BCC, intimating it is the same as the Coastal Advisory Committee, Parks and Recreations Advisory Committee, Library Advisory Committee, etc. The PBSD Administrator is a liaison between the PBSD Board and the County Manager. He is to report periodically to the County Manager on the activities of the PB MSTBU. "Report to" does not mean "answer to"; he answers to the PB MSTBU Board who hires him and pays his salary. His contract is with the PB MSTBU. The PBSD Administrator, hired by the PBSD Board, has no decision making authority. He cannot represent the Board without the Board's direction. PBSD Board members must publically refute the PBSD Administrator whenever he makes the assertion that "PBSD is only an advisory committee to the BCC without authority of decision making." Pelican Bay Blvd. is a County Road, all County citizens especially those residing in the neighborhoods of the road have the right to be involved in the reconstruction of the road and median.
