A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, MEMORIALIZING THE BOARD'S
APPROVAL OF A TRANSPORTATION POST PROJECT
MAINTENANCE AGREEMENT WITH THE FLORIDA DEPARTMENT
OF TRANSPORTATION FOR THE MAINTENANCE OF BRICK
PAVERS INSTALLED ON STATE ROAD 84 (RD ID 03030001) FROM
MILEPOST 4.084 TO 5.493 UPON COMPLETION OF FINANCIAL
PROJECT#195416-4-52-01.
WHEREAS, the Florida Department of Transportation ("FDOT") has undertaken a road
construction improvement project on SR 84 in Collier County, and as part of the project FDOT
installed brick pavers on SR 84 from milepost 4.084 to 5.493 within the medians to match
existing roadway design and to stabilize narrow portions of the medians; and
WHEREAS, the FDOT and the Collier County Board of County Commissioners
("Board") wish to enter into a Transportation Post Project Maintenance Agreement whereby,
upon completion of the project, the County will provide limited maintenance of the brick pavers,
including weed control, cleaning and replacement, as needed, and the FDOT will continue to
mow and edge the intersection improvements and maintain all other aspects of the State Road
maintenance program; and
WHEREAS, the FDOT requires the Board to provide a resolution memorializing the
Board's approval and consent to the Maintenance Agreement; and
WHEREAS, the Board of County Commissioners finds that it is in the public interest to
enter into the Maintenance Agreement and assume post project maintenance, as described herein,
following the completion of the project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,that:

1. The Board of County Commissioners approves and authorizes its Chairman to sign the
attached Post Project Maintenance Agreement for Financial Project#195416-4-52-01.
2. The Collier County Clerk of Court will forward a certified copy of this resolution to
FDOT along with the attached Post Project Maintenance Agreement for execution by
FDOT.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring

TRANSPORTATION POST PROJECT MAINTENANCE AGREEMENT
BETWEEN
FLORIDA DEPARTMENT OF TRANSPORTATION
AND
COLLIER COUNTY
This is an Agreement, by and between the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION (hereinafter, the "DEPARTMENT") and COLLIER COUNTY (hereinafter,
"LOCAL AGENCY") for the maintenance of post-project landscape improvements described
below.
WITNESSETH
1. WHEREAS, the LOCAL AGENCY is authorized to undertake a project within the
DEPARTMENT'S geographical limits; and
2. WHEREAS, said project is identified and known to the parties as Financial Project#195416-4-
52-01, brick paver installation on SR 84 (Rd ID 03030001) from milepost 4.084 to 5.493 for a
total of 7,442 Linear Feet, at the following locations;

4. WHEREAS, the LOCAL AGENCY by Resolution No. 2014-101 , dated 5/27/14 a
copy of which is attached hereto and made a part hereof, has consented to and approved the
Agreement and has authorized its Chairman or designee to execute said Agreement.
NOW, THEREFORE, in consideration of the premises, the parties agree as follows:
1. It is understood and agreed by the parties that upon completion of the project, the LOCAL
AGENCY shall be responsible, at its cost, for maintenance of said project in accordance with
(a) the attached "Scope of Maintenance", (b) the following federally accepted state standards:
Manual of Uniform Minimum Standards for Design, Construction and Maintenance for Streets
and Highways (2012), as amended.
2. This document incorporates and includes all prior negotiations, correspondence, conversations,
agreements or understandings applicable to the matters contained herein and the parties agree
that there are no commitments, agreements or understanding concerning the subject matter of
this Agreement that are not contained in this document. Accordingly, it is agreed that no
deviation from the terms hereof shall be predicated upon any prior representation or agreements
whether oral or written.

Scope of Maintenance
Location of Maintenance: SR 84 (Rd ID 03030001) from milepost 4.084 to 5.493 for a total of

Scope: Brick Paver Maintenance
Specification: The size is a 3 7/8"x 7 7/8"x 2 3/8",Classic Interlocking Paver. The interlocking
pavers follow the design criteria of ASTM C-936-82 with compressive strength minimum 8,000
psi.
Background: As part of the FDOT's road improvements in Collier County, brick pavers were
installed within medians instead of asphalt to match existing roadway design and to stabilize
narrow portions of the median.
Maintenance Requirements: The County will be responsible, at its cost, for weed control,
cleaning, and replacement, as needed. FDOT will continue to mow and edge and maintain all
other aspects of the State Road maintenance program.

TRANSPORTATION POST PROJECT MAINTENANCE AGREEMENT
BETWEEN
FLORIDA DEPARTMENT OF TRANSPORTATION
AND
COLLIER COUNTY
This is an Agreement, by and between the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION (hereinafter, the "DEPARTMENT") and COLLIER COUNTY (hereinafter,
"LOCAL AGENCY") for the maintenance of post-project landscape improvements described
below.
WITNESSETH
1. WHEREAS, the LOCAL AGENCY is authorized to undertake a project within the
DEPARTMENT'S geographical limits; and
2. WHEREAS, said project is identified and known to the parties as Financial Project #195416-4-
52-01, brick paver installation on SR 84 (Rd ID 03030001) from milepost 4.084 to 5.493 for a
total of 7,442 Linear Feet, at the following locations;
Sta.1176+03 to 1176+19 0/S 20'-23' Lt. Centerline of Construction/MP 4.144 to MP 4.1472
Sta. 1177+64 to 1180+03 0/S 0'-5' Lt. Centerline of Construction/MP 4.174 to MP 4.2193

4. WHEREAS, the LOCAL AGENCY by Resolution No. 2014-101 dated 5/27/14 a
copy of which is attached hereto and made a part hereof, has consented to and approved the
Agreement and has authorized its Chairman or designee to execute said Agreement.
NOW, THEREFORE, in consideration of the premises, the parties agree as follows:
1. It is understood and agreed by the parties that upon completion of the project, the LOCAL
AGENCY shall be responsible, at its cost, for maintenance of said project in accordance with
(a) the attached "Scope of Maintenance", (b) the following federally accepted state standards:
Manual of Uniform Minimum Standards for Design, Construction and Maintenance for Streets
and Highways (2012), as amended.
2. This document incorporates and includes all prior negotiations, correspondence, conversations,
agreements or understandings applicable to the matters contained herein and the parties agree
that there are no commitments, agreements or understanding concerning the subject matter of
this Agreement that are not contained in this document. Accordingly, it is agreed that no
deviation from the terms hereof shall be predicated upon any prior representation or agreements
whether oral or written.

Scope of Maintenance
Location of Maintenance: SR 84 (Rd ID 03030001) from milepost 4.084 to 5.493 for a total of
7,442 linear feet upon completion of Financial Project#195416-4-52-0
Scope: Brick Paver Maintenance
Specification: The size is a 3 7/8"x 7 7/8"x 2 3/8",Classic Interlocking Paver. The interlocking
pavers follow the design criteria of ASTM C-936-82 with compressive strength minimum 8,000
psi.
Background: As part of the FDOT's road improvements in Collier County, brick pavers were
installed within medians instead of asphalt to match existing roadway design and to stabilize
narrow portions of the median.
. Maintenance Requirements: The County will be responsible, at its cost, for weed control,
cleaning, and replacement, as needed. FDOT will continue to mow and edge and maintain all
other aspects of the State Road maintenance program.
