Thank you very much for your recent letter concerning skate boarders
and rollerbladers in Collier County. I certainly share your belief -
that a County facility at our community parks would be desirable for
skate boarders and rollerbladers. I am taking the liberty of
forwarding your letter to the Collier County Parks and Recreation
Advisory Board for their review and consideration. As you know, I
will be leaving the Board of County Commissioners on November 8,
1994 , and therefore will not be involved in the issues that you have
raised in your letter.
If I can be of any assistance to you in my capacity as Commissioner
between now and then, please do not hesitate to ask. After that
date, I will be opening a Legislative Office on the 3rd Floor of
Building F at the Government Center and look forward to working with
you in my capacity as State Representative from District 76.

I 'm an 18 year old Eagle Scout , a voter , and am
currently enrolled at Edison Community Collage . I am writing
because I am concerned about the problem of skate boarders
and rollerbladers . They get in trouble for jumping off
stairs and sliding on walls . Understandably they cause a
problem for businesses and they deface buildings . As of now
if a person is seen involved in these activities the police
are called or the teens get yelled at by business owners .
First this is a waste of time for the police and the yelling
only causes bad feelings between the owner and the teen . To
solve this problem I would like to propose that a part of a
park be set aside for teens to skate in . I understand that
the county doesn 't have billions of dollars to spend on
building a park of this nature , but please keep in mind that
the bigger and the better this place is the more people will
go there instead of going to the streets . If ideas are
needed for the out line of a park you may contact me and I
will do my best to get some ideas to you . The building of
this facility will not only keep more kids `rom bothering
the businesses of Collier County , but also :gill give the

in the State of Florida. As a resident of Collier County since 1984, and as a parent of two

Experience
1991 - Present Mr. Davis is head of the Civil Engineering Division at Coastal Engineering
Consultants, Inc.with responsibility for land planning, rezoning and site engineering
of planned unit developments, including commercial development, multi-family and
single family residential projects. He has successfully negotiated and administered -
municipal contracts for the development of environmentally sensitive coastal and
river front projects.
1986 - 1991 As an Associate Engineer with Coastal Engineering Consultants, Inc., Mr. Davis was
responsible for writing proposals, site planning, site design and engineering of
utilities (using the Kentucky Pipe Program for water distribution and manifolded
pump stations, roads, parking lots, drainage,and water management facilities), and
design and permitting of projects requiring mitigation of ACOE jurisdictional
wetlands. He was responsible for writing project specifications and contract
documents, project construction scheduling and project management.
1985 - 1986 Mr. Davis,while with the Nielson Company,worked in highway and heavy industrial
contracting, specifically in project estimating and management as related to the
following types of projects: State and Federal highways, power plants, and
wastewater treatment plants. Mr. Davis is experienced in calculating mass
diagrams including free haul and overhaul. Additional experience includes the
following: highway geometric design,traffic operations including progressive traffic
signal timing, trip generation including linear regression and the gravity mode.
Mr. Davis is knowledgeable in the area of computer programming. His computer
background also involves working with the following software:Autocad,Timberland
Accubid (job estimating software) and Earthwork (Quantity take-off software) and
various surface water management programs.
1984 - 1985 Mr. Davis, working for Coastal Engineering Consultants, Inc., was involved in the
design and management of civil projects in Southwest Florida, including the site
development of the Marco Beach Hilton on Marco Island, Windstar and Crown
Point West in Naples.

A RESOLUTION ADOPTING A FORMAL POLICY ESTABLISHING
GUIDELINES FOR RECEIVING RECOMMENDATIONS FOR
APPOINTMENT OF MEMBERS TO ADVISORY COMMITTEES AND -
QUASI-JUDICIAL BOARDS.
WHEREAS, the Board of County Commissioners has established -
various advisory boards and quasi-judicial boards to assist in
various facets of county business and functions; and
WHEREAS, members are appointed to the Various advisory
committees and quasi-judicial boards by Resolution of the Board of
County Commissioners; and
WHEREAS, the Board wishes to establish a policy and set forth
guidelines regarding the recommendation process for membership on
advisory committees and quasi-judicial boards.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the following
guidelines are hereby established for Board of County
Commissioners receipt and acceptance of recommendations from the
various advisory committees and quasi-judicial boards for
appointment of members to such committees or boards:
1) Recommendations will be accepted by the Board of County
Commissioners for appointments or reappointments for vacancies on
advisory committees from the current membership of the committee.
An advisory committee shall be allocated 41 days after
notification from the Board office to submit in writing their
recommendations to the Board of County Commissioners for the
appointment or reappointment of members to such committPP-
2) The County Staff is to review and categorize the t
applicants in areas of expertise and assure that the applicants •
possess the minimum position requirements for the appointment zhev

I 'm an 18 year old Eagle Scout , a voter , and am
currently enrolled at Edison Community Collage . I am writing
because I am concerned about the problem of skate boarders
and rollerbladers . They get in trouble for jumping off
stairs and sliding on walls . Understandably they cause a
problem for businesses and they deface buildings . As of now
if a person is seen involved in these activities the police
are called or the teens get yelled at by business owners .
First this is a waste of time for the police and the yelling
only causes bad feelings between the owner and the teen . To
solve this problem I would like to propose that a part of a
park be set aside for teens to skate in . I understand that
the county doesn 't have billions of dollars to spend on
building a park of this nature , but please keep in mind that
the bigger and the better this place is the more people will
go there instead of going to the streets . I- ideas are
needed for the out line of a park you may contact me and I
will do my best to get some ideas to you . The building of
this facility will not only keep more kids from bothering
the businesses of Collier County , but also will give the

police less work and will make all of the above persons

of the County providing a launch and storage site on Lely -
Barefoot Beach?

1991 - Present Mr. Davis is head of the Civil Engineering Division at Coastal Engineering
Consultants,Inc.with responsibility for land planning,rezoning and site engineering
of planned unit developments,including commercial development,multi-family and
single family residential projects. He has successfully negotiated and administered - .
municipal contracts for the development of environmentally sensitive coastal and
river front projects.
1986 - 1991 As an Associate Engineer with Coastal Engineering Consultants,Inc.,Mr. Davis was
responsible for writing proposals, site planning, site design and engineering of
utilities (using the Kentucky Pipe Program for water distribution and manifolded
pump stations,roads.parking lots,drainage,and water management facilities),and
design and permitting of projects requiring mitigation of ACOE jurisdictional
wetlands. He was responsible for writing project specifications and contract
documents, project construction scheduling and project management.
1985 - 1986 Mr.Davis,while with the Nielson Company,worked in highway and heavy industrial
contracting, specifically in project estimating and management as related to the
following types of projects: State and Federal highways, power plants, and
wastewater treatment plants. Mr. Davis is experienced in calculating mass
diagrams including free haul and overhaul. Additional experience includes the

following:highway geometric design,traffic operations including progressive traffic
\ signal timing, trip generation including linear regression and the gravity mode.
• Mr. Davis is knowledgeable in the area of computer programming. His computer
background also involves working with the following software:Autocad,Timberland
Accubid Gob estimating software) and Earthwork (Quantity take-off software) and
various surface water management programs.
1984-1985 Mr. Davis, working for Coastal Engineering Consultants, Inc., was involved in the
design and management of civil projects in Southwest Florida, including the site

Point West in Naples.

In Option 2 and 3 the leagues currently conducted and co-sponsored by the
County would change. In Option 2 all County leagues played at the
Pelican Bay Community Park would pay the league fees to the contractor,
thereby reducing the county tennis revenue by $2,000. In Option 3 the
County would continue to maintain the current leagues.
In both options the public, as well as the County maintained leagues,
would be limited to play time on the courts with Option 2 being the most
limited.
** Contractor would be responsible for maintenance of the courts.
Estimated maintenance cost is $2,500/court/year x 8 courts = $20,000.
This requirement would be more difficult in a limited operation like
Option 3 and would either cause our payment to be much less or
continue to maintain the courts ourselves.

On 9/12/94, we requested you to exercise your fiduciary
responsibility as Head of the State Lands Division- to notify the
FL. Game & Fresh Water Fish Commission that CWA 88-1 is not
currently a validly approved CWA and that they should promptly
remove all signage and the grass that has grown since 1988. Attached
to the 9/12 memo was a copy of the 12/15/87 notification from State
Lands to the Game Commission which stated "--for this nesting season-"
Clearly the Trustees authorized 1988 only. On 1 /15/88 Robt . Brantley,
Game Commission issued his statement similar to the 12/15/87 memo, but
with quite different verbage on the valid period for the CWA. We have
found no legal basis for the Col . Brantley statement . Most importantly
the Game Commission continues their signage.
We believe that this difference is very important and must
be settled. The resolution of this difference is very important to
our current beach management plans.
Do you believe that an administrative review process will
be the necessary forum- or do you propose that we resolve this dispute
in some other manner? Please respond promptly.

REQUEST: Approval for the Florida Game and Fresh Water Fish Commission to post two
sandbar/mangrove islands to prevent trespass during this year's bird nesting season.
COUNTY/LOCATION: Statewide
APPLICANT: Florida Game and Fresh Water Fish Commission
and the Division of State Lands
CONSIDERATION: N/A
STAFF REMARKS: The Florida Game and Fresh Water Fish Commission (GFWFC) is charged
with the responsibility to post critical wildlife areas to minimize the adverse
impact on wildlife due to man-caused disturbance or destruction. The areas are
identified by GFWFC field biologists and a recommendation is made to the GFWFC to
initiate rule making in order to manage public access during specific times of the
year. Approval of the property owner (Trustees) is necessary for areas such as spoil
islands, sandbars , mangrove islands, etc. , to be posted. Once approval is granted,..
the GFWFC staff must notify local governments, and go through rule making procedures
(Rule 39-14, Florida Administrative Code) prior to seasonally posting the area in
order to afford protection.
The first area is a small mangrove island in the Myakka River: The island is a
valuable rookery. The other area is a small , sandy island in Big Marco Pass which is
also used by nesting birds.

Considerable debate was held over the question:
1- Should Sand Dollar Is. be maintained as an island, or
2- Should the intervening space be filled in.
Sec. of State Jim Smith helped bridge the dispute by the
insertion of Stipulation (9) wherein a channel between
Sand Dollar Is . and the mainland be maintained . The DER
refused to issue such a permit. We asked for a permit to
fill in the lagoon and were denied. We have sought a
compromise and have not found one.

Several significant differences in wording need emphasis:
TRUSTEE'S AUTHORIZATION: "--this nesting season--"
GFC MEMO: "--annual nesting and entire year feeding and nesting--"
The Game Commission has refused to discuss these differences
On 11 /14/93, we got the Game Commission to agree that their
geographic description was inadequate. We are here today
to discuss their future plans .

The manner in which Sand Dollar Island has been made to
merge with the mainland is ruining the value of Tigertail County Park.
The obvious goal of the Game Commission is to create a PASSIVE
BIRD PARK . Obviously the utility of this park as a sandy bathing
beach will be devastated. Tigertail used to be a prime beach park
for the region of Southwest Florida. The State and County have long-
range plans include the expansion of this park for park purposes .
Bird watching is completely served by other areas in South west Florid
whereas beach parks are few.
We implore you to let a fully developed Marco Island
continue to serve the TOURIST population. Florida derives a very
large revenue from tourists . A bird watching park will greatly reduce
this income stream.

In accordance with your request, I have personally inspected the above captioned site which
is located along the south side of US-41 in unincorporated East Naples in Collier County,Florida. The
subject property is referred to as the Lake Avalon Planned Unit Development in accordance with
Ordinance No. 91-37 adopted by the Board of Collier County Commissioners on September 16, 1991.
The subject property consists of approximately 126+/- acres of which 55+/- acres are classified as
usable uplands. The subject property is currently zoned for a maximum of 376 dwelling units in
accordance with the adopted PUD document. The subject property is legally identified as follows:
A Portion of Section 13, Township 50 South, Range 25 East,
Containing 126+1-Acres Located Southwest of US-41 and Referred
to as Avalon Lake PUD, Ordinance No. 91-37. The Subject Property
Is Referred to as Tax Parcel No. 20, in Section 13, Township 50
South, Range 25 East, with a Tax Identification Folio No. of
392840004.
Pursuant to your request, the purpose of my examination is to estimate the current market value
of the unencumbered fee simple title to the property, in its "as is" condition,as currently zoned for 378
multi-family dwelling units, and to estimate the market value of the property assuming the site is
designated as a low cost housing project with a total of 600 dwelling units. The effective date of
appraisal is October 1, 1993, which was the date of physical property inspection and photographs. The
valuation is subject to economic conditions and market performances prevailing as of the effective date
of appraisal. This appraisal is specifically contingent on all comments and conditions set forth in this
valuation.
The scope of this appraisal included an inspection of the subject property, a survey of recent
land sales within Collier and Lee Counties, a survey of general supply and demand trends affecting
residential housing in Collier County, a review of the subject's zoning and potential uses, a review of
the Master Land Use Plan for the property, and a cursory analysis of the subject property in
comparison to the competing market environ. I interviewed land owners, real estate brokers, land use
agencies, county personnel, and other knowledgeable sources regarding properties in this area. The

subject has been analyzed in relation to the market in which it exists, and to those properties with the
most similar characteristics. Comparable properties were compared with subject based on location,
size, potential use, density, physical characteristics, etc.. The subject has been valued on a price-per-
unit basis, which is consistent with land sales of this type in the general marketplace. All sales
information and listings were verified, and the subject's sales history was reviewed.
The subject property is located along the south side of US-41 east, approximately 1/2 mile
southeast of the intersection of Airport Road and US-41. The property consists of approximately 126
acres, of which 55+/- acres are classified as usable uplands. The balance of the property is a large
man-made lake that serves as the central focal point for the future development, and other surrounding
wetlands. The lake area consists of approximately 65 to 70 acres, and is a large symmetrical body of
water that is currently utilized by local area ski clubs for recreational purposes. The central lake is an
excellent amenity for the property. The Lake Avalon PUD allows 378 dwelling units with a minimum
floor area of 750 square feet. Buildings can vary between two and three stories in height, and all sites
will front directly along Lake Avalon. Development Standards and Regulations are classified as typical.
Pursuant to your request, I have valued the property in accordance with the existing zoning and
condition of the property, with an additional valuation of the property assuming it is designated for low
cost affordable housing of up to 600 dwelling units. This appraisal is based on the assumption that the
subject property is physically suitable for development of 378 multi-family dwelling units in accordance
with the existing PUD, or 600 low cost affordable housing units as set forth herein. No representations
are made that the subject property can physically accommodate density of this magnitude, nor that the
zoning will be approved to allow this intensity of use.
LAKE AVALON PUD VALUATION
In the valuation of subject's existing zoning, numerous sale transactions were surveyed for the
comparative analysis. Attached hereto is a land comparison chart utilizing five residential land sale
transactions from the greater Naples area. The properties are located within about an eight mile radius
of subject. The sales were analyzed on a price-per-unit basis, with no adjustment for date of sale.
There is no quantifiable support for a time adjustment. Other adjustments are for property location,
size, and physical characteristics. Since the subject property has benefit of the central lake amenity,
sale properties not having this type of feature are adjusted to account for this superior characteristic.
Sale No. 1 is the February 1988 sale of the Cypress Glen PUD along the north side of Pine
Ridge Road about six miles north of subject. The 30+/-acre site sold for$1,848,000. The property
was designated for 280 dwelling units indicating$6,600 per unit. The sale was adjusted downward by
10% for superior location, and upward by 10% for subject's superior physical characteristics. After
adjustments, Sale No. I reflects $6,600 per unit. Comparable Sale No. 2 is the June 1988 sale of the
Emerald Lakes PUD in North Naples about 7.5 miles northwest of subject. The property consists of
148 acres designated for 525 dwelling units and sold for approximately $3,595,000. The purchase
price reflects $6,847 per unit. After adjustments, Sale No. 2 reflects $6,847 per unit. Sale No. 3 is
the November 1988 sale of 40 acres in the Shadowood PUD. The property was designated for 228
dwelling units and sold for $1,475,000 or $6,469 per unit. After adjustments, Sale No. 3 reflects
$7,116 per unit. Sale No. 4 is the September 1990 sale of 63 acres in the Sapphire Lakes PUD. The
property sold for $1,738,000 and was designated for 316 units indicating $5,500 per unit. After
adjustments, Sale No. 4 reflects $6,325 per unit. Sale No. 5 is the combined sale of the Piper's Grove
property in North Naples about 8 miles north of subject. The purchase price is $2,289,000 and the

property was designated for 396 units reflecting $5,780 per unit. After adjustments, the sale reflects
$5,780 per dwelling unit.
Based on my analysis of subject in relation to the competing marketplace, it is my opinion the
market value of the site is in the mid-range of adjusted values, or $6,500 per unit. The property value I
is calculated as follows:
378 Units x $6,500 = $2,457,000

LAKE AVALON PUD - AFFORDABLE HOUSING S1i'J
In the valuation of subject as an affordable housing site, numerous rental apartment site
transactions were analyzed for comparative purposes. Six of the sales have been summarized in the
attached land comparison chart. Three of the sales are for conventional rental apartments, and three
of the sales were for affordable low cost rental housing communities. Sales were adjusted for utilities,
location,size, and physical characteristics. The adjustments are consistent with the valuation of subject
as currently zoned.
Sale No. 1 is the November 1988 sale of the Fountain View apartment site along Airport Road.
The property was designated for a maximum of 456 dwelling units and sold for$5,931 per unit. After
adjustments, Sale No. 1 reflects $5,338 per unit. Sale No. 2 is the April 1989 sale of a 30 acre
affordable housing site located along Bayshore Drive about 1/2 mile south of subject. The property
was designated for 184 dwelling units and sold for $5,163 per unit. After adjustments, Sale No. 2
reflects $4,905 per unit. Sale No. 3 is the April 1989 sale of the South Bay Plantation apartment site
about six miles southeast of subject. The 240 unit site sold for $6,542 per unit. After adjustments,
Sale No. 3 reflects $6,215 per unit. Sale No 4 is the June 1989 sale of the Waverly Place Apartments
along Green Boulevard in Golden Gate. The 300 unit site sold for$6,695 per unit. After adjustments,
Sale No. 4 reflects $6,361 per unit. Sale No. 5 is the June 1990 sale of the Arbour Lake affordable
rental apartment site along Old US-41 about 12 miles northwest of subject. The 246 unit site sold for
$5,040 per unit. After adjustments, Sale No. 5 reflects $5,292 per unit. Sale No. 6 is the October
1991 sale of the Saddlebrook affordable housing site about seven miles northeast of subject along Davis
Boulevard. The 698 unit site sold for$5,007 per unit. After adjustments,this sale reflects$5,759 per
unit. -
Based on my analysis of subject as an affordable housing site in relation to the competing
market, it is my opinion the probable value is $5,500 per unit. The value is calculated as follows:

of subject. The sales were analyzed on a price-per-unit basis, with no adjustment for date of sale.
There is no quantifiable support for a time adjustment. Other adjustments are for property location,
size, and physical characteristics. Since the subject property has benefit of the central lake amenity,
sale properties not having this type of feature are adjusted to account for this superior characteristic.
Sale No. 1 is the February 1988 sale of the Cypress Glen PUD along the north side of Pine
Ridge Road about six miles north of subject. The 30+/-acre site sold for$1,848,000. The property
was designated for 280 dwelling units indicating$6,600 per unit. The sale was adjusted downward by
10% for superior location, and upward by 10% for subject's superior physical characteristics. After j
adjustments, Sale No. 1 reflects $6,600 per unit. Comparable Sale No. 2 is the June 1988 sale of the
Emerald Lakes PUD in North Naples about 7.5 miles northwest of subject. The property consists of
148 acres designated for 525 dwelling units and sold for approximately $3,595,000. The purchase
price reflects $6,847 per unit. After adjustments, Sale No. 2 reflects $6,847 per unit. Sale No. 3 is
the November 1988 sale of 40 acres in the Shadowood PUD. The property was designated for 228
dwelling units and sold for $1,475,000 or $6,469 per unit. After adjustments, Sale No. 3 reflects
$7,116 per unit. Sale No. 4 is the September 1990 sale of 63 acres in the Sapphire Lakes PUD. The
property sold for $1,738,000 and was designated for 316 units indicating $5,500 per unit. After
adjustments, Sale No. 4 reflects $6,325 per unit. Sale No. 5 is the combined sale of the Piper's Grove
property in North Naples about 8 miles north of subject. The purchase price is $2,289,000 and the

property was designated for 396 units reflecting $5,780 per unit. After adjustments, the sale reflects
$5,780 per dwelling unit.
Based on my analysis of subject in relation to the competing marketplace, it is my opinion the
market value of the site is in the mid-range of adjusted values, or $6,500 per unit. The property value
is calculated as follows:

LAKE AVALON PUD - AFFORDABLE HOUSING SITE
In the valuation of subject as an affordable housing site, numerous rental apartment site
transactions were analyzed for comparative purposes. Six of the sales have been summarized in the
attached land comparison chart. Three of the sales are for conventional rental apartments, and three
of the sales were for affordable low cost rental housing communities. Sales were adjusted for utilities,
location,size, and physical characteristics. The adjustments are consistent with the valuation of subject
as currently zoned. `.
Sale No. 1 is the November 1988 sale of the Fountain View apartment site along Airport Road.
The property was designated for a maximum of 456 dwelling units and sold for$5,931 per unit. After
adjustments, Sale No. 1 reflects $5,338 per unit. Sale No. 2 is the April 1989 sale of a 30 acre
affordable housing site located along Bayshore Drive about 1/2 mile south of subject. The property
was designated for 184 dwelling units and sold for $5,163 per unit. After adjustments, Sale No. 2
reflects $4,905 per unit. Sale No. 3 is the April 1989 sale of the South Bay Plantation apartment site
about six miles southeast of subject. The 240 unit site sold for $6,542 per unit. After adjustments,
Sale No. 3 reflects $6,215 per unit. Sale No 4 is the June 1989 sale of the Waverly Place Apartments •
along Green Boulevard in Golden Gate. The 300 unit site sold for$6,695 per unit. After adjustments,
Sale No. 4 reflects $6,361 per unit. Sale No. 5 is the June 1990 sale of the Arbour Lake affordable
rental apartment site along Old US-41 about 12 miles northwest of subject. The 246 unit site sold for
$5,040 per unit. After adjustments, Sale No. 5 reflects $5,292 per unit. Sale No. 6 is the October
1991 sale of the Saddlebrook affordable housing site about seven miles northeast of subject along Davis
Boulevard. The 698 unit site sold for$5,007 per unit. After adjustments, this sale reflects$5,759 per

Based on my analysis of subject as an affordable housing site in relation to the competing
market, it is my opinion the probable value is $5,500 per unit. The value is calculated as follows:

Park. OCPM has assigned a construction manager to this
project. Obtaining bids for work.
N. Athletic Fields: 1,674,000 Construction of athletic facilities throughout County.
Presently looking at ENCP and Middle and Elementary school
sites. i.e. Pine Ridge and East Naples Middle Schools. Met
with principals to discuss proposed plan. School Board staff
has agreed to the idea, will be presenting to BCC. BCC

AN ORDINANCE CONFIRMING THE CREATION OF THE
PARKS AND RECREATION ADVISORY BOARD; PROVIDING
FOR APPOINTMENT AND COMPOSITION; SETTING FORTH
THE TERMS OF OFFICE; PROVIDING FOR REMOVAL FROM
OFFICE, FAILURE TO ATTEND MEETINGS; PROVIDING FOR
OFFICERS, QUORUM, RULES OF PROCEDURE; PROVIDING
FOR REIMBURSEMENT OF EXPENSES; SETTING FORTH THE
FUNCTIONS, POWERS AND DUTIES OF THE ADVISORY BOARD;
SETTING FORTH THE DUTIES OF THE PUBLIC SERVICES
ADMINISTRATOR OR HIS DESIGNEE; PROVIDING A REVIEW
PROCESS; PROVIDING FOR CONFLICT AND SEVERABILITY;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Collier County Ordinance No. 86-41, as amended, sets
forth the requirements for creating County Advisory Boards; and
WHEREAS, the Parks and Recreation Advisory Board was created
by the Board of County Commissioners in October, 1975; and
WHEREAS, it is the desire of the Board of County
Commissioners to confirm and ratify the establishment of the Parks
and Recreation Advisory Board and to formalize the structure and
operation of the advisory board in accordance with the provisions
of Collier County Ordinance No. 86-41, as amended.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Board Confirmation of the Creation of the Parks and
Recreation Advisory Board.
The creation and establishment of the Parks and Recreation
Advisory Board (hereinafter referred to as the "Board") is hereby
confirmed and ratified.
SECTION TWO. Appointment and Composition,
A. The Board shall be composed of seven (7) members
consisting of one (1) member from the Immokalee Community Park
District, one (1) member from the Marco Island Community Park
District and five (5) members from the Naples and Urban Area
Community Park District.
B. Members of the Board shall' be appointed by and serve at
the pleasure of the Board of County Commissioners. Said members
shall be permanent residents within the Community Park District
that they represent, and all shall be electors of Collier County.

C. Appointment of members to the Board shall be by
resolution of the Board of County Commissioners, which resolution
shall set forth the date of-appointment and the term of office.
SECTION THREE. Terms of Office.
The initial terms of office of the Board shall be as follows:
A. Two (2) members will serve until December 31,
1993.
B. Three (3) members will serve until December 31,
1994.
C. Two (2) members will serve until December 31,
1995.
Thereafter, each appointment or reappointment shall be for a
term of four (4) years. A member of the Parks and Recreation
Advisory Board may be reappointed by the Board of County
Commissioners for one (1) successive term. However, other
qualified applicants may be considered for any vacancy.
Appointments to fill any vacancies on the Board shall be for the
remainder of the unexpired term of office.
SECTION FOUR. Removal From Office: Failure to Attend Meetings.
A. Any member of the Board may be removed from office, with
or without cause, by a majority vote of the Board of County
Commissioners.
B. In the event that any Board member is absent from two (2)
consecutive Board meetings without a satisfactory excuse
acceptable to the Board Chairman, the Board Chairman shall state
such fact at the next regularly scheduled Board meeting and shall
thereafter notify, in writing, the Public Services Administrator
or his Designee of the Board member's failure to attend without
satisfactory excuse. The Board of County Commissioners shall
review the Board Chairman's notification at a County Commission
meeting and shall declare the Board member's position to be vacant
if the Commission concurs that the Board member was absent from
two (2) consecutive Board meetings without a satisfactory excuse

and shall promptly fill the vacant position. The Board member
shall not serve at any meetings after his or her position is
declared vacant. -
C. If any member of the Board is absent for more than
one-half of the Board's meetings in a given fiscal year, it shall
be deemed that the member has tendered his resignation from such
Board. The Board of County Commissioners shall as soon as
practicable after such resignation, declare the position to be
vacant and shall promptly act to fill the vacancy. The Board
member shall not serve at any meetings after his position has been
declared vacant by the Board of County Commissioners.
D. A member of the Board shall be deemed absent from a
meeting when he/she is not present during at least 75% of the
meeting.
SECTION FIVE. Officers: Ouorum: Rules of Procedure.
A. Annually the membership of the Board shall elect a
chairman and vice chairman from among the members. Officers'
terms shall be for one (1) year, with eligibility for reelection.
B. The presence of four (4) or more members shall constitute
a quorum of the Board necessary to take action and transact
business. In addition, an affirmative vote of three (3) or more
members shall be necessary in order to take official action,
regardless of whether four (4) or more members of the Board are
present at the meeting.
C. The Board shall, by majority vote of the entire
membership, adopt rules of procedure for the transaction of
business and shall keep a written record of meetings, resolutions,
findings and determinations. Copies of all Board minutes,
resolutions, reports, and exhibits shall be submitted to the Board
of County Commissioners.
SECTION SIX. Reimbursement of Expenses.
Members of the Board shall serve without compensation, but
shall be entitled to receive reimbursement for expenses reasonably

incurred in the performance of their duties upon prior approval of
the Board of County Commissioners.
SECTION SEVEN. Functions. Powers and Duties of the Board.
The functions, powers and duties of the Board shall be as
follows:
A. To evaluate, consider and review the acquisition of
park property.
B. To consider and analyze the development of park and
recreation facilities constructed on these park
properties.
C. To review and provide input on parks and recreation
programs, classes and special events.
D. To review and provide input on the Parks and
Recreation Master Plan.
E. , To solicit input from the public that may assist
with the duties listed above.
F. To provide recommendations to the Board of County
Commissioners on issues relating to those duties
specified above or other duties assigned by the
Board of County Commissioners.
G. The Board may adopt and amend "Guidelines" to govern
their operation, subject to approval by the Board
of County Commissioners.
SECTION EIGHT. Duties of the Public Services Administrator or
His Designee.
The duties of the Public Services Administrator or his
Designee shall be:
A. To administer the activities of the Board in
accordance with established policies of the Board
of County Commissioners and guidelines adopted by
the Board.
B. To provide periodic written reports to the Board,
the County Manager and the Board of County
Commissioners on the activities of the Board.

C. Attend all Board meetings.
SECTION NINE. Review Process.
This Board shall be reviewed once every four (4) years
commencing in 1996, in accordance with the procedures contained in
Ordinance No. 86-41, as amended.
SECTION TEN. Conflict and Severability.
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
,SECTION ELEVEN. Effective Date.
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
PASSED AND DULY ADOPTED by the Board of County Commissioners
of Collier County, Florida, this day of

Concerned over problems with ladies restroom
facilities for physically challenged visitors .
Specifically, the restroom door is too heavy;
there is a "lip" in the door that makes it
difficult to get a wheelchair into the room;
there are no paper towels in the dispenser
in the handicapped stall nor is there is
trash dispenser.
She also mentioned that it would be helpful
if the handicapped parking spots were closer
to the entrance, perhaps this can be done with
the new landscaping. Also, someone has moved
the bikerack into the path from the handicapped
parking spot into Lhe building .
She has offered to be a volunteer consultant
with regard to more user friendly facilities
for physically challenged persons, if you
would like for her to do so.

Re: Sailboat docking on city shoreline
Dear Lt. Morales:
I am currently serving as the Chairman of the Collier County
Parks and Recreation Advisory Board. In that capacity, I was
requested to contact the City of Naples regarding their policy for
storage of boats along the city shoreline. I contacted Mark
Thornton, Director of Community Services, and he referred me to
you.
The reason I am writing to you is that I was contacted by a
group of county residents who indicated that they had been unable
to register their boats for storage on the Naples city beach since
a new ordinance was enacted in 1993. Having reviewed the
ordinance, Ordinance No. 93-6923, I find no criteria included
therein which would establish to whom the available spaces are
assigned.
Would you please provide me with information regarding the
procedure which is currently being used to assign the available
spaces? _Specifically, I am interested in whether any procedure is
in place which would allow a resident of Collier County living
outside the city limits to obtain the right to dock their boat at
one of the thirty-five (35) designated spaces.
I would like to be able to respond to the citizens' inquiry in
