Code Enforcement Board to order.
Notice: The respondent may be limited to 20 minutes for case
presentation unless additional time is granted by the Board. Persons
wishing to speak on any agenda item will receive up to five minutes

CHAIRMAN KAUFMAN: Good morning.

CHAIRMAN KAUFMAN REPORTER: Could you state your
name.
MS. VUKOVIC: Branislava Cirakovic Vukovic.
CHAIRMAN KAUFMAN: Okay. For the Board, this is the case
that was handwritten that was on your position when you got here this
morning.
Okay. Why don't you let us know what you're requesting and
why.
MS. VUKOVIC: We're still requesting the extension due to
zoning decisions by Mr. Fred Reischl and planning -- Zoning
Department. And they still didn't come to the conclusion of how to
resolve the situation. So basically they told me to ask for another
extension.
CHAIRMAN KAUFMAN: Okay. And the county says?
MR. HOAGBOON: Sir, we have no objection. For the record,
John Hoagboon, Collier County Code Enforcement. They're just
waiting on a reschedule for the hearing for the variance hearing. That's
all it is, basically.
CHAIRMAN KAUFMAN: Okay. And how much time do you
think you would need?

MS. VUKOVIC: Between 90 to 180 days; I don't know.
CHAIRMAN KAUFMAN: One hundred eighty days being six
months. We could certainly go shorter than that. I mean, this thing
has been going on since May 23rd, 2013. And I realize that you're
waiting for the county to move, but I would think that a zoning
meeting is held sooner rather than later as far as this is concerned.
MR. HOAGBOON: It has to go through the BCC process, and I
think that's why there might be a little bit more time involved, and
that's probably the cause for the need for a little bit more time
requested.
CHAIRMAN KAUFMAN: Has the county given you any
indication of when they're going to have their meeting to go through
this?
MS. VUKOVIC: I didn't get any correspondence yet.
MR. HOAGBOON: Sir, it's pending at this time.
CHAIRMAN KAUFMAN: Okay. Mr. Lefebvre?
MR. LEFEBVRE: I don't understand why we're almost
two-and-a-half years down the road, and we're still waiting for a
zoning variance. There's many processes that take a much shorter time
that are much more involved in this, including rezoning a piece of
property from it being an agricultural piece including, and I've said this
phrase multiple times, building a high-rise.
So, again, I don't understand why this is taking so long. We're
again, two-and-a-half years out from the original case.

MR. LEFEBVRE: Well, I don't know if it's so much the county
as is the respondent. I mean, if this was the route they were taking, I
want to know when they started taking this route to go for the variance.
If they realized back a year and a half ago that they could not do what
they wanted to do without a variance -- and I don't remember the
specifics of the case. Was it that you have two residences or
something? What was the original case?
MS. VUKOVIC: Well, any time you want to do the process, they
will not start it unless you give the money, like -- I think it's $5,000.
So I did it, like, a while ago. So they still -- like, when you apply for a
rezoning, that's the beginning. And since then, you know, I'm still
waiting.
MR. LEFEBVRE: But was this a case where it's a house that was
a duplex, but it was --
MS. VUKOVIC: In the Collier County records it shows as a
duplex, and that's how I bought it.
MR. LEFEBVRE: Okay. That's how you bought it. So you
want to keep it as a duplex?
MS. VUKOVIC: Correct, yeah.
CHAIRMAN KAUFMAN: And the zoning in that area says it is
a single-family; is that it?
MS. VUKOVIC: Yeah, which is a discrepancy which Collier
County had it recorded.
CHAIRMAN KAUFMAN: So you're asking for a variance to
grant a two-family or a duplex in an area that was previously zoned for
single-family, so then the county --
MS. VUKOVIC: At this point I really don't care any longer. I

mean, whatever you guys decide, whatever county -- whatever
Planning decides, I'm fine. I mean, it's property, I do -- actually, one of
the people you have on the thing is actually deceased. And he -- the
coroner (sic), so, you know, so you might want to take it out from --

contact our friends in zoning and see when this will be resolved?
MR. HOAGBOON: Yes, sir.
CHAIRMAN KAUFMAN: And maybe if it's not resolved in
whatever time we grant for an extension, should we grant an extension,
that that be presented to the Board.
MR. HOAGBOON: Yep.
CHAIRMAN KAUFMAN: So we cut the end of the tunnel on
this, where it's not a train there hitting us in the face.
MR. HOAGBOON: I don't see any issue with that. You know,
just to reiterate on what she said, they've done everything that's been
required of them. They had everything posted as far as, like, you
know, for the area at the HEX hearing, and at the last minute, you
know, the county stepped in and said, hey, this needs to go a little bit
more further -- you know, suggested it for the BCC, so -- but I think
we could do that. We can go ahead and contact them with that regard.
MR. LEFEBVRE: What I want to know is at what point did the
respondent realize, I have to go for a variance, and when was that
variance applied for? Because it should have been pretty evident much
sooner that you needed to go this route, and it should not have -- I just
don't know why it's taken as long as it has.
CHAIRMAN KAUFMAN: When did you purchase -- when did
you purchase the property?
MS. VUKOVIC: I did apply in February 2013 for a variance.
That was the application fee which I said, so -- but, again, for some
reason, maybe because of that discrepancy, that's what it is. I believe I
purchased it 2007.

case began, May of 2013, you had applied for a variance?
MS. VUKOVIC: Yeah. I wasn't aware that it wasn't a duplex at
all because --

MS. VUKOVIC: -- on the Collier County it shows as duplex. It
still shows, if you go to Collier County Appraiser.
CHAIRMAN KAUFMAN: Okay. Well, I think to bring this to
an end one way or the other that the county needs to step up and to
provide information to the Board within a reasonable period of time. If
somebody wants to make a motion to that effect or any effect, or any
other comments from the Board.
MR. LEFEBVRE: Have you thought about seeking legal
representation for this?
MS. VUKOVIC: I mean, you know, it doesn't do any good,
because it's not in my side. It's about planning, zoning, county. You
know, so where I'm standing, it doesn't make any difference to me
except that I have to come to the meetings. And I'm happy to come.
But, again, if they say yes, great; if they say no, it's okay with me, too.
You know, like I -- at this point it's been so long, so, you know, it's a --
I'm just in this process, and -- to be honest with you.
It doesn't matter for me if I hired an attorney. I don't think it's
going to make it any faster. It's just -- it's going to cost me even more.
MR. LEFEBVRE: Again, to rezone a property where you're
building homes or commercial doesn't take two-and-a-half years. A
comprehensive land use change doesn't take two-and-a-half years to
do, and we're at two-and-a-half years now. So that's what I'm trying to
get at. What I'm trying to get at, right now it doesn't seem like there's
any pressure to have this completed because we keep on giving you
extensions every three months, six months that you come here. We're

MS. VUKOVIC: I really don't feel like you're giving, personally,
me. I think you're giving that to the process, and that's what I feel.
Because, again, whatever I had to fill it out and to give, I do. But it's
not my decision at this point.
CHAIRMAN KAUFMAN: I really believe that this is where the
county -- I mean, if you applied for a variance in May of 2013, we may
be asking the respondent the question that should be asked of the
county. Why have they not come back with a yes or no in two years?
MR. MARINO: Three.
CHAIRMAN KAUFMAN: Three years. A long time.
MR. MARINO: I agree.
MR. HOAGBOON: Sir, just to interject, they've done everything
that's been asked of them. They've met all the deadlines, you know,
for each and every, you know, issuance of the variance in the -- you
know, the process involved, and it was just this last stage where it was
asked, you know, rescheduled and go to the BCC process.
CHAIRMAN KAUFMAN: Yeah. And the county will do one of
two things; they'll either approve the variance or they won't, and then
the case will be over. The respondent will know which direction
they're going in, and we're done. But I don't know that -- well, I think
that the Board should have the authority to require the county to
respond at least to the Board saying we are going to have an answer on
this variance by such and such a date.
MR. MARINO: How would you like to handle it?
CHAIRMAN KAUFMAN: Yeah, yeah. We don't hear variances
here, but I get your point.
So I would propose that we grant some sort of an extension and
then also if the county will contact the county, if you will -- and ask
them for some definitive date on when this thing is going to be
revolved.

in the county, the print they have I found at Collier County is not same

the county to asking what they print. They have on the record, so why
I need to do.
And the person in the county, they tell me, say they don't have a
regular print. They only have the two old print. They say you can do
whatever you do, and they give me the new print, and then they will be
-- said that. So that's why I bought the house.
And then when I get home to try -- and go ahead I do -- whatever
I do I try to -- I draw all my own print to get that wherever it is. And
then someone coming there, they say I don't have right to do that. I
had to apply the permit.
So I -- it's pretty difficult because they don't have original print in
there. So I just paid $5,000 to get a company special -- they provide a
permit and get the floor print, and they promised me -- I already paid

the $5,000. They promised me to do that, but I didn't know they did
not do that.
They did a delay, so I received a hearing. I received a letter from
the hearing from you guy, so then -- it's a good thing the county didn't
know to them too, so that's the letter. They give it to me. Then I found
out -- the company I hired, they give me to letter. They promised me,
say they can finish it whenever the letter required.
CHAIRMAN KAUFMAN: Okay. Did they pull a permit, do
you know?
MS. WANG: Not yet. This moment, not yet, but they said they
can -- they give me the letter, they say I can provide to the county, and
they said they promise -- you guy promise me they can finish the --

been so many alterations to the structure that it's going to have to be a

the number of businesses that are in that complex and the available
parking. And I've spoken to Christine Willoughby about that, and she
said that as long as I have that lift in there it changes the use and

So unless I can get her to not classify that as an automatic use, I
don't see much alternative than to having to remove that jack.
