THIS CAUSE came before the Code Enforcement Board upon the Petitioner's Motion for Imposition
Fines/Liens on August 27,2015,and the Code Enforcement Board,having heard argument respective to all
appropriate matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
1. On January 22,205,Respondents were found guilty of violation of Collier County Land Development
Code, Section 04-41,as amended,Collier County Land Development Code, Section 10.02.06((B)(1)(A)for
having an expired building permit without the completion of all related inspections and the issuance of a
Certificate of Completion/Occupancy, which violation(s)occurred on the property located at 1101 N. 11`h
St.,Immokalee,FL,Folio#63912040001 (Legal Description: Newmarket South BLK 3,Lot 5 and S1/2 of
Lot 14).
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before April 22,2015 a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5179,Page 193).
3. Operational costs of$67.00 incurred by the County in the prosecution of this case were ordered to be paid.
4. Respondents,having been duly noticed for the public hearing regarding the County's Motion,did not
appear at the public hearing through his representative, and no legal defense to the Motion was presented.
6. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
7. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is granted.
B. Daily fines of$200.00 per day are assessed against the Respondents for 127 days for the period from April
23,2015 through August 27,2015 for a total amount of fines of$25,400.00.
C. Respondents shall pay operational costs for the Imposition of Fines hearing in the amount of$65.43.
E. Respondents are ordered to pay fines and costs in the total amount of$25,465.43 or be subject to Notice of
Assessment of Lien against all properties owned by Respondent in Collier County,Florida.

2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before July 24,2015 or a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5138,Page 1198).
3. Operational costs of$65.43 incurred by the County in the prosecution of this case were ordered to be paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did appear at
the public hearing through his representative,and no legal defense to the Motion was presented. The
representative of Kaye's Custom Homes,the builder who is assisting the Respondent,requested a ninety
(90)day extension and said request was denied.
6. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
7. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes, and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is granted.
B. Daily fines of$200.00 per day are assessed against the Respondents for 34 days for the period from July
25,2015 through August 27,2015 for a total amount of fines of $6,800.00.
C. Respondents shall pay previously assessed operational cost of$65.43.
D. Respondent shall pay operational costs for the Imposition of Fines hearing in the amount of$62.91.
E. Respondent is ordered to pay fines and costs in the total amount of$6,928.34 or be subject to Notice of
Assessment of Lien against all properties owned by Respondent in Collier County,Florida.
F. Daily fines of$200.00 shall continue to accrue until abatement is confirmed.

4. Respondents,having been duly noticed for the public hearing regarding the County's Motion,did not
appear at the public hearing, and no legal defense to the Motion was presented. Respondents sent an email
to the Board requesting a continuance of today's hearing and said request was denied.
6. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely filed.
7. The violation has not been abated as of the date of the hearing.

3. Operational costs of$65.85 incurred by the County in the prosecution of this case were paid.
4. The violation has been abated as of the date of the hearing.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to
correct the violation; (c)whether there were previous violations committed by the violator;(d)the cost
upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)
the value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would
cause on the Respondent; (h)the time and cost incurred by the Code Enforcement to have the violation

continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5078,PG 3533).
3. Operational costs of$64.17 incurred by the County in the prosecution of this case were paid.
4. The violation has been abated as of August 8,2015.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to
correct the violation;(c)whether there were previous violations committed by the violator;(d)the cost
upon the violator to correct the violation; (e)the amount of the time necessary to correct the violation;(1)

Demolition Permit, inspections and Certificate of Completion/Occupancy on or before October 26,2015 or
a fine of$100.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondents fail to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.

THIS CAUSE came on for public hearing before the Code Enforcement Board on August 27,2015,and the
Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective to
all appropriate matters,hereupon issues its Findings of Fact and Order of the Code Enforcement Board,as follows:
FINDINGS OF FACT
1. Respondent,RANDY HOLTON, is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at 5341 Martin St., Naples, FL, Folio #62098320002 (Legal: NAPLES MANOR
ADD BLK 9, LOT 30) is in violation of Collier County Land Development Code 04-41, as amended,
Section 10.02.06(B)(1)(a)in the following particulars:
Unpermitted shed and animal cages on improved residential property
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended, Section
10.02.06(B)(1)(a).
B. Respondent must abate the violation by applying for and obtaining all permits and inspection through and
including a certificate of occupancy/completion, or demolition permit,required for described
structure/improvements OR applying for and obtaining all permits and inspection through and including a
certificate of occupancy/completion required to remove said structure/improvements including materials from
the property and restore the property to a permitted stated on or before September 26,2015 or a fine of
$100.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.01 on
or before September 26,2015.
E. Respondents shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came on for public hearing before the Code Enforcement Board on August 27,2015, and the
Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective to
all appropriate matters,hereupon issues its Findings of Fact and Order of the Code Enforcement Board,as follows:
FINDINGS OF FACT
1. Respondent,MARICELA PEREZ. is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is Ordered to
comply.
4. The real property located at 4755 Vireo Lane, Immokalee, FL, Folio # 34750000025 (Legal Description:
GEMMER SUBDIVISION, LOT 1) is in violation of Collier County Land Development Code 04-41, AS
AMENDED, Section 10.02.06(B)(1)(A) in the following particulars:
An addition with electric and a carport with a wooden deck all attached to the primary structure all
constructed without first obtaining the authorization of the required permit(s)inspections and
certificate(s)of occupancy as require by Collier County Building department
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,AS AMENDED,
Section 10.02.06(B)(1)(A).
B. Respondent must abate the violation by obtaining all required Collier County Building Permits,or
Demolition Permits, inspections and Certificate of Completion/Occupancy by December 25,2015 or a fine of
$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$64.17 on
or before September 26,2015.
E. Respondents shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

THIS CAUSE came before the Code Enforcement Board upon the Respondent's Motion for Extension of
Time to Comply,and the Code Enforcement Board,having reviewed the Motion,all associated documents and
heard argument respective to all appropriate matters, issues the following Order:
FINDINGS OF FACT
1. On May 23,2013,Respondent was found guilty of violating Collier County Land Development
Code 04-41 as amended,Sections10.02.06(B)(1)(a),10.02.06(B)(1)(e),and 10.02.06(B)(1)(e)(i)
alterations/improvement to structure/property without first having the required Collier County Building
Permits,which violation occurred on the property located at 10580 6th St.N.,Naples,FL,Folio
#62578800000(Legal Description: Lot 26,Block 22,of NAPLES PARK,UNIT 2).
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before November 19, 2013, or a fine of$250.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR Book 4995, PG
2850).
3. On September 24,2015 Respondents filed a Request/Motion for Extension of Time to Comply.
4. Previously assessed operational costs of$271.97 have been paid.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondents' Request/Motion for Extension of Time to Comply is granted.
B. The time for which Respondents are to comply has been extended until November 23,2015.
C. No fines shall accrue during the extension period.

COMES NOW, the undersigned, Lin Lin Wana, on behalf of himself or as representative
for Respondent and enters into this Stipulation and Agreement with Collier County as to the resolution of Notices
of Violation in reference (case) number CESD20150013679 dated the 10th, day of July, 2015.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which a
hearing is currently scheduled for 09/24/2015;to promote efficiency in the administration of the code enforcement

4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriffs Office to

THIS CAUSE came on for public hearing before the Code Enforcement Board on September 24,2015, and
the Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective
to all appropriate matters, hereupon issues its Findings of Fact and Order of the Code Enforcement Board, as
follows:
FINDINGS OF FACT
1. Respondent,DIAPAZON USA,LLC. is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is Ordered to
comply.
4. The real property located at 3435 Enterprise Ave., Unit 30, Naples, FL, Folio # 76720000602 (Legal
Description: 3435 ENTERPRISE A CONDOMINIUM UNIT 30) is in violation of Collier County Land
Development Code 04-41,AS AMENDED, Section 10.02.06(B)(1)(A)and(e)in the following particulars:
Hydrolic jack installed and no permit obtained.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,AS AMENDED,
Section 10.02.06(B)(1)(A)and(e).
B. Respondent must abate the violation by obtaining all required Collier County Building Permits, inspections
and Certificate of Completion/Occupancy by December 23,2015 or a fine of$250.00 per day will be
imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$64.59 on
or before October 24,2015.
E. Respondents shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a fmal inspection may be performed to confirm compliance.

FINDINGS OF FACT
1. On April 23,2015, Respondents were found guilty of violation of Collier County Land Development Code
04-41,as amended, Section 10.02.06(B)(1)(A) in the following particulars: A pole barn(approximately 30
x 50)in the rear yard of improved occupied residential property without first obtaining the required
permit(s), inspection(s)and certificate of completion,which violation(s)occurred on the property located at

2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before August 21,2015 or a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5147,PG 3677-3678).
3. Operational costs of$65.01 incurred by the County in the prosecution of this case were paid.
4. The violation has been abated as of September 22,2015.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to
correct the violation;(c)whether there were previous violations committed by the violator;(d)the cost
upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)
the value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would
cause on the Respondent;(h)the time and cost incurred by the Code Enforcement to have the violation
corrected and(i)any other equitable factors which would make the requested mitigation appropriate.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
