AMENDMENTTQ AGREEMENT
THIS AMENDMENT TO AGREEMENT entered into this -' day of
,. _. ...... , 19 ~, ,., by and between Johnathan Gifford, joined by his spouse,
Cheryl Gilford, hereinafter referred to as the "Owner", and COLLIER COUNTY, a
political subdivision of the State of Florida, its successors and assigns, hereinafter
referred to as the "County."
WITNESSETH
WHEREAS, the County and Johnathan Gifford, joined by his spouse, Cheryl Gifford
have previously entered into an Agreement dated June 11, 1998; and
WHEREAS, the County and Johnathan Gilford, joined by his spouse, Cheryl Gilford
are desirous of amending said Agreement; and
NOW THEREFORE, in consideration of the covenants and agreements provided within
the said Agreement dated June 11, 1998 and Ten Dollars ($10.00) and Other Valuable
Consideration, the said Agreement is hereby amended as follows:
1. Paragraph number 3 of the Agreement is hereby deleted in its entirety and the
following provision is substituted in its place:
Both Owner and Purchaser agree that time is of the essence in regard to the closing
and that. therefore, said closing shall occur within one hundred eighty (180) days of the
execution of the Agreement by Purchaser. At closing, Purchaser shall deliver the
County Warrant to Owner and Owner shall deliver an easement to Purchaser in a form
acceptable to Purchaser.
Except as expressly provided herein, the said Agreement between the County and
Johnathan Gifford, joined by his spouse, Cheryl Gilford remains in full force and effect
according to the terms and conditions contained therein, and said terms and conditions
are applicable hereto except as expressly provided otherwise herein.
IN WITNESS WHEREOF, Johnathan Gilford, joined by his spouse, Cheryl Gilford and
County have hereto executed this Amendment to Agreement the day and year first
above written.
