Notice is hereby given that the Collier County Board of County Commissioners
will hold Special Meeting on FRIDAY, NOVEMBER 30, 2001 at 2:00 P.M., in the
Board Meeting Room, Third Floor, Harmon Turner Building (Administration), at the
Collier County Government Complex, 3301 East Tamiami Trail, Naples, Florida. The
Special Meeting will include, but may not be limited to, the following:
Presentation of the 2001 Annual Update and Inventory Report on
Public Facilities (AUIR) as required by Section 3.15.6, Collier County Land
Development Code.

Recommended LDC Changes for
Division 3.15. Adequate Public Facilities Ordinance
Section 3.15.5 includes references to two separate programs, one for monitoring and
management and one for regulatory purposes. However, only one "program" has ever
been contemplated and applied under the current ordinance. That is the Annual Update
and inventory report. Upon review of this section, it appears clear that the second
program for regulating development to ensure adequate public facilities are available is
needed to be developed and implemented separate from the AUIR. This would be the
"checkbook" that staff has often referred to in determining the adequacy of transportation
facilities.
Sec. 3.15.6. Management and monitoring program.
The manner in which this section is currently written, it is also applied as the regulatory
program as well. The section states "findings of the AUIR shall form the basis for the
preparation of the next annual update and amendment to the CIE, the determination of
any area of significant influence (ASI) and the review and issuance of development
orders subject to the provision of this division during the next year." This combined with
the standards for review of application for road facilities (Sections 3.15.7.3.5.6,
3.15.7.3.5.6.1 and 3.15.7.3.5.6.2) establishes the AUIR as the regulatory tool for
transportation concurrency since the road component of the adequate public facility
certificate shall be granted if the project does not lie within an ASI. An ASI is set only
during the development of the AUIR. This is a once a year review and does not take into
account cumulative approvals or issuances of APF certificates.
Staff would recommend that the language of the APFO be modified in the next available
cycle which would delineate the AUIR as the annual balance sheet for development of
amendments to the CIE and would be the basis of a concurrency management system that
would determine compliance throughout the year rather than giving a countywide
concurrency approval for all road facilities which has been past practice. The
management system, which would be consistent with the current language of the APFO
for a separate regulatory program, would evaluate each application separately but give
consideration for prior approvals and consumption of capacity. This would have a
greater capability of ensuring that we can anticipate how much and when development
will impact the system and in conjunction with modifications to application of the term
ASI will allow a metering of development when deficiencies or potential deficiencies
exist rather than a complete shutdown of development.
Sec. 3.15.6.4 Establishment of area of significant influence (ASI) for roads.
Redefining the definition and application of ASIs is also part of the staff's
recommendations for the next available LDC amendment cycle. Currently ASIs are
applied when deficiencies or potential deficiencies are defined and cannot be resolved
with the first three years of the transportation improvement programs of either the state or
the county. What is not included in any of the definitions or applications are the terms
for "Constrained" or "Backlogged" facilities. Staff would recommend inclusion of these
terms as developed by the Florida Department of Transportation along with the
methodology for continued development for facilities defined as either constrained or
backlogged.
In addition to including the ability to apply these definitions, staff would also recommend
modification to the means for establishing a specific ASI boundary. The current
boundary definitions are arbitrary and based on roadway functional classification. Staff
would recommend eliminating the boundary definition based on a mileage radius and
replace the ASI concept with a rational means of determining if new or redevelopment
will substantially and adversely impact a deficient roadway facility or allow the potential
for limited development approval based on parallel facility improvements, transportation
system management applications (taking back the capacity of a roadway) or alternate
means of access or site distribution to minimize impacts to deficient facilities. All of
these recommendations would be included in the next LDC amendment cycle.
Part of the change would also require changes to the management and issuance of the
adequate public facilities certificates. The approval authority along with the management
of the transportation concurrency management system would be with the Transportation
Division. Issuance of the certificates would be mandatory no later than final subdivision
plat or final site development plan. Deferrals to the building permit stage would no
longer be permitted. It would not mean that payment of impact fees would be required at
application for an APFC. Many other communities apply concurrency approvals without
the certificate issuance being tied to impact fee payment. That is still tied to the issuance
of a building permit.
Another item which is currently still in the AFPO but was inadvertently left out of the
current LDC ordinance language is the ability for a property owner to pay into escrow all
impact fees associated with the zoning of the property and obtain an APF certificate.
With a concurrency management system in place, the need for this clause would be
eliminated.
Staff will be presenting a complete update of the AFPO with the above referenced
modifications in January.
