Preliminary Work Permits il' thc pro. jcct's linal plat is not submitted to the Board of County
Commissioners lbr approval pursuant to l)ivision 3.2 oftl~e Land Development Code, unless thb
Owner is delayed in having his final plat reviewed by thc Board duc to thc fimlt of thc County.
All work approved by this Agreement must cease and not restart if thc final plat is m)t submitted
and approved by thc Board of ('ounty Commissioners within this authorization period. No work
is autimrizcd under this Agreement prior to salisfying thc conditions in Section 3 of this
Agreement. Anvattcmpt to commence work prior to issuance ofrccluisitc permits shall render
all provisions of this Agreement null and void.
By entering into this Agreement lhe County does not guarantee and thc Owner can not
rely upon thc lhct that thc pro.jcct's linal plat will be approved upon submission to thc t3oard of
County Commissioners. Thc Owner is required to comply with all of thc provisions and
procedures of thc Land Development Code bclbrc thc final plat can bc submittmt to thc Board
consideration.

This letter is to notify you of the District's agency action concerning your
application for an Environmental Resource Standard General Incidental Site
Activities Permit. This action is taken pursuant to Rule 40E-1.603 and Chapter
40E-40, Florida Administrative Code.
Based on the information provided, District rules have been adhered to and an
Environmental Resource Standard General Incidental Site Activities Permit is in
effect for:
land clearing within the upland areas of the project and excavation of Lakes 11
14 and 15. ,
Subject to:
1. Not receiving a timely filed request for a Chapter 120 Florida Statutes
administrative hearing, ' ,
2. the enclosed General Conditions,
3. Obtaining all required federal, state, local and special district
authorizations prior to the start of any activity approved by this permit.
4. Prior to the commencement of construction, the perimeter of the protected
wetlands and upland buffer zones shall be staked and roped to prevent
encroachment into these areas. The permittee shall notify the SFWMD's
environmental compliance staff in writing upon completion of roping and
staking and schedule an inspection of this work. The roping and staking
shall be subject to SFWMD staff approval. The permittee shall modify the
staking and roping if SFWMD staff determines it is insufficient or is not
in conformance with the intent of this permit.

pre-construction meeting shall be held with SFWMD field engineering and
environmental post permit compliance staff from the Fort Myers office.
Should you object to these Conditions, please refer to the attached "Notice of
Rights" which addresses the procedures to be followed if you desire a public
hearing or other review to the proposed agency action.
Please contact this office if you have any questions concerning this matter.
we do not hear from you prior to the date specified in the "Notice of Rights",
we will assume that you concur with the District's recommendation.

THE STANDARD GENERAL PERMITS AUTHORIZED PURSUANT TO THIS CHAPTER SHALL BE
SUBJECT TO THE GENERAL CONDITIONS SET FORTH IN RULE 40E-4.38I, F.A.C.
THE PERMITTEE SHALL NOT CONSTRUCT ANY WORKS OR ENGAGE IN ANY LAND CLEARING
ACTIVITIES WITHIN 50 FEET OF THE LANDWARD EXTENT OF WETLANDS OR OTHER
SURFACE WATERS OR PROPOSED UPLAND PRESERVATION AREAS ON THE PROJECT SITE.
THE PERMITTEE SHALL EXCAVATE NO CLOSER THAN 200 FEET OF THE LANDWARD EXTENT
OF WETLANDS OR OTHER SURFACE WATERS ON THE PROJECT SITE OR AS OTHERWISE
SPECIFIED IN THE PERMIT. '
THE PROPERTY MUST BE RESTORED TO THE SATISFACTION OF THE DISTRICT IF THE
INDIVIDUAL ENVIRONMENTAL RESOURCE PERMIT IS DENIED OR THE PERMITTED PROJECT
IS OTHERWISE NOT IN ACCORD WITH TlfE INCIDENTAL SITE ACTIVITIES AUTHORIZED
HEREIN.
ANY DAMAGE TO OFF-SITE PROPERTY WHICH MAY HAVE BEEN CAUSED BY THE
INCIDENTAL SITE ACTIVITIES HEREIN MUST BE MITIGATED OR OTHERWISE OFFSET TO
THE SATISFACTION OF THE DISTRICT.
THE ACTIVITIES ARE COMMENCED AT THE PERMITTEE'S OWN RISK.
THE PERMITTEE SHALL PROCEED TO TIMELY OBTAIN THE INDIVIDUAL ENVIRONMENTAL
