In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which a hearing is currently scheduled for ; to promote efficiency in the administration of the code enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the parties hereto agree as follows: 1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence. Litter/debris scattered throughout the property consisting of plastic bottles, cans, paper goods, etc. and a trailer in the front yard with litter/debris being stored. THEREFORE, it is agreed between the parties that the Respondent shall; 1) Pay operational costs in the amount of $ incurred in the prosecution of this case within 30 days of this hearing. 2) Abate all violations by: Removing all unauthorized accumulation of litter from the property site intended for final disposal or store items within a completely enclosed structure within days of this hearing or a fine of $ I0 ()°per day will be imposed until the violation is abated AND Store commercial vehicle/ equipment in rear yard and conceal from view, or store within a completely enclosed structure, or remove from residentially zoned property within days of this hearing or a fine of $ 'per day will be imposed until the violation is abated. 3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the Investigator perform a site inspection to confirm compliance. (24 hours notice shall be by phone or fax and made during the workweek. I think you should ask Mr Short. I do have a presentation for the magistrate but if warnings were given even verbally shouldn't I have the sane consideration? Especially when it's the taxi drivers initiating the request to reel in the drivers to set up for your investigators On another note why is there no flexibility on the county while Uber is trying to work this out with you. Collier County Code of Laws, Chapter 54, Article VI, Section 54-179 Collier County, Florida, Land Development Code 04-41 as amended Chapter, 2.02.03 Prohibited Uses Any unauthorized accumulation of litter in or upon any property, vacant or improved, or on or upon any public street, alley or other public or private place is a violation of this article.Any property owner,tenant, occupant, agent, manager, or other person who owns, maintains, or controls private property,whether improved or unimproved, is hereby declared to be in violation of this article where any such unauthorized accumulation of litter is maintained or is allowed to remain on such property.: The unauthorized accumulation of litter or improper storage of litter or improper dumping of abandoned property or litter as described in sections 54-179--54-184, in or upon public or private property, is hereby declared to be a public nuisance.: 2.02.03 Prohibited Uses Any use or structure not specifically identified in a zoning district as a permitted use, conditional use, or accessory use shall be prohibited in such zoning district. Violation Status - Recurring DESCRIPTION OF CONDITIONS CONSTITUTING THE VIOLATION(S). Did Witness: Litter and illegal storage on property consisting of but not limited to, matress, plastics, glass, cords, ropes, containers,tools and other misc items etc.... ORDER TO CORRECT VIOLATION(S): You are directed by this Notice to take the following corrective action(s): 1. Must remove or cause to remove any unauthorized accumulation of litter.Unauthorized accumulation of litter is defined as the accumulation of litter in or upon any public or private property or body of water, which is not contained within proper containers or receptacle provided for control of litter, or is not otherwise permitted or authorized, by any other Collier County Ordinance. This term shall not include building materials used in construction or repair of a building or structure which materials are properly stored at the site of such activity, so long as: a) The subject building is being constructed, remodeled, repaired, or demolished under the authority of an active, valid Collier County building permit and for which the materials are to be used; and b)The building materials are secured during construction, remodel, repair, or building demolition, to prevent the material from falling out, spilling, blowing out by wind action, or coming out by other accidental means so that it trespasses on adjacent properties, or creates a negative visual impact to surrounding properties. 2. Must remove or cause to remove any unauthorized litter which is a public nuisance pursuant to this section. 3. Must cease all outdoor storage use at any and all property other than property zoned for_use as identified in Ordinance 04-41, as amended, Section 2.04.03, Tables 1 and 2 AND/OR Remove_from unimproved property and/or property regulated by an approved Site Development Plan and the intended use in accordance with Section 10.02.03(B) (5)and/or intended allowable uses in 2.04.03, Tables 1 and 2. Store items in fully enclosed structure or remove from property. ON OR BEFORE: April 3, 2014 Failure to correct violations may result in: 1) Mandatory notice to appear or issuance of a citation that may result in fines up to$500 and costs of prosecution. OR 2) Code Enforcement Board review that may result in fines up to $1000 per day per violation, as long as the violation remains, and costs of prosecution.
