3. Developer agrees to complete thc golf course and its required improvements xxithin three

Development PIan(SDP) for thc Golf Course is approxcd and thc Cotmtv grants prclimma~' acceptance to
thc required subdivision improvements, and all required suppo~ facilities arc in place anb approxcd for
occupm~cy and usc as a goll'coursc facility.
4. Developer agrees to dedicate and grant, without cost or reimbt.'scmcnt to thc County. alt
ncccssa~' casements to thc Coumv and all other service providers to serve thc golf course and thc
remaining portions of thc ovcralI i)ro.jcct and other lands, i)rovidcd said casement grants do not
unreasonably intcrt~rc with thc usc and operation of thc golf course

6. Developer shall prepare golfcours¢ construction plans and final plat or SDP plans lgr thc
golf course and shall submit these plans and plat for rcx'icxv and approval in accordance xxith thc
Subdivision Regulations. Plans shall include xxhcrc applicable water management lakes, conxcvancc
structures and outfalls, irrign~ion fncilitics, other 13crmancnt or temporal' access roads or militics, t~t~litx'
crossings and thc like and site clearing.
7. Developer shall obtain all rcclt, isitc £cdcral. state and local permits and at>provals m:d s}~alI
construct Iht inrrastruclurc s~bjcct to this Agreement including thc albrcmcntioncd golf course, lakes and
water management facilities, irrigation pump stations, shchcrs, tcmpora~5. ini'rastruclurc and any
maintenance facility in accortl:mcc with all applicable federal, state and local regulations, land usc and I:m~l
development regulat ions.

9. Developer agrees that a Site l)cvclopmcnt Pl;m (sometimes rcfcrr,.:d to hcrcm as "SDP")
shall be submitted for any vertical conslruct~on, such ns 'a ,nai.tcnancc facility or prol)oscd structures
serving thc golf course in accordance xxith Ordinance S2-()2. as amended by Ordiuancc 00-24. or their
successors in flmction, to obtain site plan api)roval..After Iht SDP is apl2rovcd l)cxclopcr shall bc allowed
to apply for building permits which directly relates to thc development of structures for thc golf course
only. Any proposed cltd)hc~usc or like facility shall not bc dccmcd to bc part of' this :Xgrccmcnt or thc
infrastructure addressed herein
10. County agrees and shall permit thc developer to proceed with Iht pi:tuning, permitting ami
construction of thc golf course irrigation Immp station, rest shchcrs, maintenance lhcility, and requisite
infrastructure subject to this t~gI'CCIllClI[. [SS[lallCC of County al)provals to conlmcncc construction of thc
golf course shall bc conditioned upon thc Following:
a) Upon thc C'ountv Manager. or his designee, finding that thc uotf course construction pi:ms
and documents and final plat. or SDP for thc golf course arc in compliance with Ibc pro¥isions of
Gro~kth Management Plan and thc Subdivision Regulations and thereafter upon aptm>xal of same by thc
Board or Commissioners during a regularly scheduled meeting
