LEON EISENBUD, PRESIDENT I. INTRODUCTION : Thank you, Mr.Chairman , for the opportunity to make this statement on behalf of the residents of Barefoot Beach. You will notice that I am not accompanied by a delegation. This is not a presentation by a group of dissident residents. Instead my appearance should be characterized as an effort to cooperate with the County in an effort to solve a potentially serious problem, the overburdened intersection at Bonita Beach Road and Lely Beach Boulevard. More specifically we are concerned about the traffic patterns just inside the intersection, patterns which are already unsafe and at times, chaotic. The recent decision by the Board of Commissioners to make the entrance to the park off the Barefoot Beach entryway a permanent one was arrived at without a careful inspection of the conditions at the site, and without consideration of data already available at the Department of Transportation. We believe that this decision was 11100, premature and , essentially, was arrived at on a political basis. We are confident that further analysis will demonstrate very clearly that retaining the existing location as the entry or exit to the combined Collier-Lee Park is not desirable. Furthermore we believe that there are alternative solutions which will allay the concerns of the residents, and prove as well to be advantageous to the public in general , including the residents of Lee County. II. THE SITE : The intersection of Bonita Beach Road with Lely Beach Boulevard is utilized either as a passing point or entry point for private cars and commercial vehicles from the following locations : 1 . The several thousand condominiums on Fort Myers Beach and Hickory Boulevard and the entire populations of the many beachfront and backwater communities of southwest Lee County. There is no other satisfactory route to or from US 41 -- other than the circuitous one towards Sanibel -- a road which harbors stop-go traffic all day during the tourist season. 2. Barefoot Beach a. This is the only entrance to this residential community which at build out will contain 686 residential units, of which 348 will be condominium apartments and the remainder individual homes. Allowing for an accepted index of 2. 1 per unit, Barefoot Beach will have a population of - Amyl • approximately 1400 Collier County residents within a few years. b. This intersection provides the only entry point to the Barefoot Beach Preserve -- on each of the recent weekends over 200 cars were counted daily, going to the preserve. Since there is no charge for parking at the preserve and Del nor Wiggins State Park is now charging $3.25 per vehicle it may be anticipated that the preserve will be heavily utilized during the tourist season. When the second parking lot at the preserve is opened the maximum number of spaces will be 109. When this number is reached the gate house is instructed by radio to deny further entrance. Already we have seen the backup which results from this arrangement as visitors ask to be permitted to wait for a space to open up. There is no place for them to wait. c. At the south end of Lely Beach Boulevard, close to the entrance to the preserve, a clubhouse is being constructed to house the Miramar -- a beach and tennis club formerly known as Auduly. This club will have a dining room, pool , tennis courts and several hundred feet of beachfront. The residents of Audubon will utilize this facility, as well as a limited number of members from other clubs on an exchange basis. The exact configuration of the Miramar facility and its membership is not final but it is clear that it will add a considerable number of cars to the traffic load since there is no other way to the club other than Lely Beach Boulevard. 3 . Bonita Beach. This public beach currently has several entrances. One of them is located at the entry to Barefoot Beach, just North of the gatehouse. Traffic exits the park at this point at right angles to Lely Beach Boulevard and must cross the southbound lane to reach the exit lane, and then must turn left to proceed to the intersection with Bonita Beach Road. Surprisingly,the Commission has decided that this is to be the permanent entrance to the combined park. Please keep in mind that the roadway from this entrance to the parking area for the park is contained within property owned by Lely. The entrance itself and the courtyard through which traffic to the park passes is currently owned by Lely but will shortly be owned by the Barefoot Beach Master Associaton. The residents of Barefoot Beach pay for the maintenance of the entryway, including the monuments, the pavement and the landscaping (as we do for all of Lely Beach Boulevard) . There are serious problems relating to liability inherent in this arrangement -- but the costs of maintaining the road and security and liability are subjects for another discussion and are not relevant to the problem of potential gridlock at this intersection. III. HISTORY : The following is the content of the final paragraph of the easement , granted to the County by the Lely Development Corporation, dated May 31 , 1988, signed by Richard Klaas, President: "The term of this easement shall be perpetual , provided nonetheless that said easement shall terminate at such time as a second roadway or an additional access other than herein conveyed is provided to the above described parking lot adjacent thereto. " Whether or not the addition of the Lee County entrance represents a "second roadway" or whether or not the inclusion of Lee County to the terms of this easement nullifies the agreement are matters of legal interpretation. The question is under review by our attorney. Quite apart from this technical distinction one fact is unassailable : this arrangement was intended to be a temporary convenience. All of the property owners on Barefoot Beach were told at the time of purchase that it was temporary and much of the resentment building in the community is in response to what we see as a breach of faith on the part of the County. Quite apart from the issues just described , our Board believes that retaining this access point will prove to be a serious error in planning, and will not prove to be an acceptable arrangement for the thousand's of Collier and Lee County residents who, hopefully. will be enabled to enter and leave the park without hazard and delay. IV. ALTERNATIVES : There are alternatives -- alternatives which will Nog, benefit the residents of both counties. I am pleased to indicate that we have been privileged to have the cooperation of Mr. George Archibald, Collier County Director of Transportation, who has visited the site with some of our residents, listened patiently to their complaints, and agreed to undertake a technical analysis of this problem. In fact the area in question has been under study for some time as part of the joint planning with Lee County for the four laning of Bonita Beach Road. We have agreed tentatively that the better arrangement would be to move the entrance to the park westward , directly opposite the entrance to the large condominium complex on the other side of the road. Placing a traffic signal at this new intersection would solve all of the problems enumerated in the document and it 0 would add an additional advantage -- the residents of the condominiums would have a safe exit and would be relieved of the long delays now encountered when accessing Bonita Beach Road. The residents of Barefoot Beach, visitors to the preserve and to Miramar would also be benefitted since there would be breaks in traffic, controlled by the nearby signal light. V. A BONUS . In addition to the advantages described above there is a real bonus to be derived from this new arrangement. The current winding road which leads from Lely Beach Boulevard to the Park is on Lely Property. With the closing of the existing access this road and the adjacent property will become available for additional parking. In discussions with John Agnelli , currently ICEO at Lely, he has agreed to give this parcel of land to the �,+ County as part of the agreement to end the easement. I cannot speak for Mr. Agnelli but as recently as last week he indicated that this offer is in place. This is a matter outside our authority but we urge the County to keep it in mind in the course of these deliberations. Thank you for the opportunity to make this presentation. The five-member board expects to dis- cuss more than a dozen items including park- ing at the State Road 951 boat ramp, the Tigertail beach concession contract,progress at Bonita Beach Park, the Immokalee child care center and boat ramps in Golden Gate and at Conklin Point. The meeting is open to the public. The administrative office is at 3300 Santa Barbara Boulevard in Golden Gate.
