RE: Registry Resort Expansion to Existing
Facilities/Clam Pass Park
Dear Mr. Smith:
Please be advised that Charles Popper and I respectfully request
time at the September 25th meeting of the Parks Commission to
discuss the plans that the Registry Resort has for the expansion
of the facilities at the Clam Pass Park and to make a
presentation to consider the Registry Resort, on a permit-by-
permit basis, to provide banquet service at the proposed
expansion facility after park hours.
The Registry would like the Commission to consider allowing it on
a permit-by-permit basis to conduct food and beverage service on
the deck, which will be expanded in the new facility.

Dear Bob:
Despite the good faith efforts by the county to clear the
beach of weeds and associated debris, it has become
painfully apparent that because of regulatory hold-ups
and the lack of a clear remedy, that Tigertail Beach is
still, and will continue to be substandard for an
indefinite period.
This condition has and continues to do irreparable
damage to our business , despite all our efforts .
Therefore, according to our contract and previous
discussions' with County representatives we are requesting
a much needed reduction in rent effective 8/1/91 to
the agreed amount of 15%/ $500 . 00 until such a time
that Tigertail is again a " first class " beach.

AMENDMENT TO FOOD AND BEVERAGE CONCESSION AGREEMENT

This Amendment to Agreement entered into this day
of October, 1991, by and between the Board of County
Commissioners, Collier County, Florida, hereinafter referred to
as "County" , and Cool Concessions, Inc. , a Florida corporation
with offices at 828 Hideaway Circle East, Suite 416, Marco
Island, Florida 33937, hereinafter called the "Concessionaire" .
WITNESSETH:
WHEREAS, the County and Concessionaire have previously
entered into a certain Agreement dated March 26, 1991, and
WHEREAS, the Concession Agreement provided for the
�✓ Concessionaire to pay monthly to the County the amount of 22.5%
of total gross revenues or nine hundred dollars ($900) per month,
whichever is greater; and
WHEREAS, the Concessionaire has requested and the Collier
County Parks and Recreation Department has recommended that the
Board of County Commissioners agree to reduce the payments to the
County.

NOW, THEREFORE, the Food and Beverage Concession Agreement
dated March 26, 1991, is hereby amended as follows:
1. Paragraph sixteen is supplemented and amended to read as
follows:

CONSIDERATION. The Concessionaire shall remit to the
County, as consideration for this Agreement, a percentage
of the total gross revenue of the Concessionaire's
business of Food and Beverage in the amount of 15.5% of
total gross or revenues or six hundred fifty dollars
($650) per month, whichever is greater, until such time
the vegetation under the jurisdiction of the Florida
Department of Environmental Regulations is removed and
the beach is considered cleared by the County. This
shall be only a temporary consideration owed to the
County by the Concessionaire.
Said payments shall be tendered to the County by the 15th
day of each month for the preceding month, and such
payments shall be accompanied by a statement of gross
receipts for the preceding month. It is also understood
that the applicable Florida State Sales Tax on payments
to the County as per this Agreement shall be added to the
Concessionaire' s payment and forwarded to the County as
part of said payments. It is the intent of the County
• that it is to receive its revenue payment as net, free
and clear of all costs and charges arising from, or
relating to Concessionaire's obligations under this
Agreement and that the minimum monthly guarantee or the
percentage of total gross revenues whichever is greater,
•be paid monthly. The term "gross revenue" or "gross

® receipts" is understood to mean all income collected,
accrued or derived by the Concessionaire under the
privileges granted by this Agreement or other document
entered into with the County, excluding amounts of any
Federal, State, or other tax, collected by the
Concessionaire from customers and required by law to be
remitted to the taxing authority. The County Finance
Department shall provide Concessionaire a Statement of
Gross Receipts. The Concessionaire shall provide a copy
of his State Sales and Use Tax Report for the same
accounting period as required for the Statement of Gross
Receipts.
2 . Except as hereby modified, supplemented, amended or
changed, all the terms and conditions of said original
® Food and Beverage Concession Agreement shall all remain in
full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this
Amendment to Food and Beverage Concession Agreement to be
executed the day and year first above written.

AGREEMENT FOR SCOREKEEPER SERVICES
This Agreement entered into this 1st day of August, 1991, by
and between the Board of County Commissioners of Collier County,
Florida, hereinafter referred to as the "County" , and the Naples
Scorekeepers Association of Naples, Florida, hereinafter referred
to as "NSA" . In consideration of the covenants contained herein,
the parties hereto agree as follows:
SECTION I - NSA shall furnish Scorekeepers for all games for
the following leagues: Men' s Softball, Women's Softball, Boy' s
Softball, Girl ' s Softball, Church League Softball, and any mixed
Softball Leagues run by the County in the Naples area.
SECTION II - The County shall pay NSA for furnishing
scorekeepers the following rates payable as provided herein:
A. MEN'S ONE PITCH SOFTBALL - $7 . 00 per game. Approximately
90 games anticipated to be played March through June
inclusive.
B. MEN'S SOFTBALL - $7. 00 per game. Approximately 746 games
anticipated to be played September through July
inclusive.
C. WOMEN'S SOFTBALL - $7 . 00 per game. Approximately- 110
games anticipated to be played October through December
and March through June inclusive.
D. CO-ED LEAGUE - $7. 00 per game. Approximately 160 games
anticipated to be played February through July inclusive.
E. CHURCH LEAGUE SOFTBALL - $7. 00 per game. Approximately
160 games anticipated to be played December through
February inclusive.
F. YOUTH BASKETBALL GAMES - $6. 00 per game. Approximately
120 games anticipated to be played January through
February inclusive.
The above standards are approximate in nature and NSA shall not
obligate. the County to a specific number of games, nor to a
definite period of time within the calendar year in which said
games will be played. The rates mentioned include extra innings,
if necessary.
SECTION III - NSA shall provide:
A. Scorekeepers for all games.
B. A pre-season list of registered scorekeepers for
consideration by the County shall be furnished to the
County before each season or league.

C. The County shall have the authority to review the conduct
and effectiveness of scorekeepers. The County reserves
the right to require NSA to replace any scorekeeper who
is deficient in meeting standards established by the
County.
SECTION IV - In the event of postponement or cancellation of
a scheduled contest herein, the County shall bare no cost if the
scorekeeper or a Board Member of NSA IS NOTIFIED ONE HOUR PRIOR
TO GAME TIME.
A. If the scorekeeper(s) are not notified of postponement or
cancellation prior to arrival at the field for a
scheduled contest, the scorekeeper(s) will be compensated
for one game even though no game is played.
B. In the event a contest which is in progress is canceled
due to inclement weather, electrical outage, or
circumstances beyond the County of NSA's control,
scorekeepers will be paid for games completed and any
games in progress at the time of cancellation.
SECTION V - The Agreement shall be in effect from August 1,
1991 through July 31, 1992 . Amendments to this Contract shall be
in writing and signed by both parties. The County may, at its
Q sole discretion, extend this Agreement under all of the terms and
conditions contained in this Agreement for up to one additional
year following expiration of the original term.
SECTION VI - Payment of scorekeepers will be made in
accordance with Collier County Purchasing and Finance Department
procedures. NSA shall render to the County a biweekly statement,
showing the number of games worked by its scorekeeper(s) . The
statement shall contain a certification by an officer of NSA that
he/she has reviewed the statement and that the information
contained therein is true and correct. This statement shall be
mailed to:

SECTION VII - It is expressly understood that NSA
scorekeepers are independent contractors and not agents or
employees of the County and therefore not entitled to benefits
normally afforded employees of the County. This provision is not
intended to apply to any County employee who acts as a
scorekeeper.
SECTION VIII- NSA agrees to verbally notify the County' s
Athletic Supervisor as to time and location of organizational
meetings one week prior to said meeting date.
SECTION IX - All notices from the County to NSA shall be
deemed duly served if mailed by registered or certified mail to
NSA at the following address:

NSA and the County may change the above mailing addresses at any
time upon giving the other party written notification.
SECTION X - If NSA fails to comply with any of the terms and
conditions hereof and such default is not cured within five (5)
days after written notice is given to NSA, the County may
terminate this Agreement. In addition, the County reserves the
right to terminate this Agreement for any other reason or no
reason, and at any time, within ten (10) days after further
written notification to NSA.
SECTION XI - The NSA will not use, nor suffer or permit any
person to use in any manner whatsoever, County facilities for any
improper, immoral or offensive purpose, or for any purpose in
violation of any federal, state, County or municipal ordinance,
rule, order or regulation, or of any governmental rule or
regulation now in effect or hereafter enacted or adopted. In the
event of such violation by NSA or if the County or its authorized
representative shall deem any conduct on the part of NSA to be
objectionable or improper, the County shall have the right to
suspend this Agreement with NSA should NSA fail to correct any
such violation, conduct, or practice to the satisfaction of the
County within twenty-four (24) hours after receiving notice of
such violation, conduct, or practice, such suspension to continue
until the violation is cured. NSA further agrees not to continue
performance under this Agreement during the suspension period
until the violation has been corrected to the satisfaction of the
County.
SECTION XII - NSA agrees that there shall be no
discrimination as to race, sex, color, creed, or natural origin.
SECTION XIII - Nothing herein contained shall create or be
construed as creating a partnership between the County and the
NSA or to constitute NSA as an agent of the County.
SECTION XIV - This Agreement shall be administered on behalf
of the County by the Parks and Recreation Department.
SECTION XV - It is further understood and agreed, by and
between the parties herein, that the within Agreement is subject
to an item of annual appropriation contained in the County
budget.
SECTION XVI - NSA, its officers and members shall, through
the signing of this document by an authorized party or agent,
indemnify, hold harmless and defend Collier County and its agents
and employees from all suits and actions, including attorney's
fees and all costs of litigation and judgment of every name and
description bought against the County as a result of loss, damage
or injury to person or property by reason of any act or failure
to act by NSA, its agents, servants or employees.
IN WITNESS WHEREOF, NSA and the County, have each,
respectively, by an authorized person or agent, hereunder set
their hands and seals on the date and year first above written.

RECOMMENDATION TO ENTER INTO A TRANSPORTATION AGREEMENT BETWEEN
COLLIER COUNTY BOARD OF COMMISSIONERS AND THE SCHOOL BOARD OF
COLLIER COUNTY, FLORIDA FOR THE PURPOSE OF UTILIZING SCHOOL BUSES
TO TRANSPORT PARKS AND RECREATION PROGRAM PARTICIPANTS
Objective: To obtain the Board of County Commissioners approval
for Collier County to enter into a Transportation Agreement with
the School Board of Collier County, Florida, for use of school
buses to transport participants during Parks and Recreation
programs and camps.
Considerations: In years past, The Board of County
Commissioners has entered into a Transportation Agreement with
the School Board of Collier County, Florida, Office of Support
Services, Transportation Department. This Agreement provided for
the transportation of participants to various off-site
recreational areas during Parks and Recreation programs. The use
of these buses enhances the programs by providing a variety of
activities to the participants. Examples of activities have
included but were not limited to educational site visits, roller
skating, swimming, beach trips, bowling, and movies.
There has been no change in the fee structure from the 1990/91
Agreement. Collier County will pay a flat rate of $20. 00 per
hour for each hour. A $10. 00 administrative charge will be
levied for each trip. "A fee of labor rate $ as needed for
cleaning and maintenance" is $30. 00 per hour. This will be
charged only if the bus is returned in disarray. The Parks and
Recreation Department has never had to pay this fee in five (5)
years. The School Board has included, at the request of the
Parks and Recreation Department, Option B - Bus Only. This
option permits the Parks and Recreation Department to provide a
licensed and approved school bus driver. The fee of $1. 05 per
operated mile has not increased from 1990/91. The School Board
has added a Fuel Adjustment Clause Option B-Bus Only Section (2) .
The rate of $1. 05 per operated mile is based on a fuel cost of
$0.73 per gallon. The base rate of $1. 05 will increase one (1)
cent per mile for every ten (10) cents of variance from the fuel
cost of $0.73 per gallon. The effect of the Fuel Adjustment
Clause should be minimal as the Parks and Recreation Department
does not foresee using Option B frequently.
Section (2) , Part 6. Pursuant to Florida Statute 234 . 03 states
that Collier County agrees to provide liability insurance "in an
amount equal to $5, 000 multiplied by the rated seating capacity
of the bus or. . . $100, 000, whichever is greater. " Collier County
has general liability coverage through Lloyds of London, for one million dollars. A certificate of proof of insurance has been
forwarded to the proper authorities at the School Board of
Collier County.

1 The Transportation Agreement will be in effect for one year,
August 15, 1991 through August 15, 1992. The Parks and
Recreation Department researched area bus companies and the
School Board has the lowest rate. The Parks and Recreation
Advisory Board reviewed and approved the Agreement at their
1 September 25, 1991, meeting by a <> vote.

Fiscal Impact: The cost budgeted for this service is $12 , 000.
Monies are budgeted in Accounts 001-156341-639990 and
111-156343-639990.
Growth Management Impact: None
Recommendation: Staff and PARAB recommend that the Board of
County Commissioners enter into an agreement with the School
Board of Collier County, Florida for the purpose of utilizing
school buses to transport Parks and Recreation program
participants.

TRANSPORTATION AGREEMENT
FOR GOVERNMENTAL AGENCY
THIS AGREEMENT made and entered into this 15th day of
August , 1991, by and between the School Board of
Collier County, Florida (School Board) , and Collier County
Parks and Recreation by and through the Board of County
Commissioners of Collier County, Florida (Agency) .
WHEREAS, Chapter 234 of the Florida Statutes authorize local
school districts to enter into agreements with organizations for
the use of school buses belonging to the school district, and
WHEREAS, the Agency desires to utilize the school buses of
the school district, and
WHEREAS, Florida Statutes section 234.211(1) (A) provides
that each school district may enter into agreements with the
governing body of a county or municipality in the school district
or any state agency for the use of school buses of the school
district for transportation of the elderly, transportation
disadvantaged or for any county, municipal, or state purpose.
IT IS THEREFORE AGREED:
1. Option A - Bus and Driver:
(1) The School Board shall provide buses with drivers
in accordance with the terms provided herein.
(2) The Agency shall reimburse the School Board for
the use of the vehicles at the rate of $ 20* per hour, an
administrative charge of $ 10 per day, and a fee of $ Labor
rate as needed for cleaning and maintenance.
Option B - Bus Only:
(1) Agency agrees to pay to the School Board $1. 05
per operated mile for each bus. Operated mile is defined as
every mile the vehicle is operated in support of the Agency' s
Program, whether with passengers or not, and to include necessary
trips from the School Board Transportation Department. Mileage
will be recorded and billed by the School Board. Such bus will
be returned to the Transportation Department of the School Board
at the end of each operating day. The Agency will be assessed a
$10. 00 cleaning fee for such bus checked back in which is not
cleaned.
(2) FUEL ADJUSTMENT CLAUSE - The rate per mile stated
in this agreement is based upon the actual operating expense per
bus mile for the prior fiscal year excluding driver expense, with
a base fuel cost of $0.73 per gallon. This rate per mile will be
adjusted one cent per mile for each ten cents of variance from
the base fuel price paid by the School Board during the billing
month.
(3) Such bus will be operated by employees of Agency
licensed and approved as school bus drivers by the Department of
Transportation of the School Board.
* Rate for first 5 hours, $12 per hour thereafter
2 . The Agency agrees that all requests for use of buses and
drivers will be made at least two weeks prior to the date
requested.
3 . The Agency agrees that in the event of a cancellation
the School Board will be given 24 hours advance notice. In the
event that notice of cancellation is not issued to the School
Board within 24 hours a fee of $ 20 will be due and payable
to the School Board.
4 . Payment for services rendered or due shall be assessed
by the School Board by the 10th of each month and paid by the
Agency by the 30th of each month.
5. The Agency shall indemnify and hold harmless the School
Board from any and all liability of the School Board by virtue of
the use of the school 's vehicles.
6. The Agency, pursuant to Florida Statute 234 . 03 , agrees
to provide liability insurance in an amount equal to $5, 000
multiplied by the rated seating capacity of the bus or other
vehicle, as determined by the State Board of Education, or
$100, 000, whichever is greater.
7. The Agency agrees that there shall be no fee charged to
passengers on the bus.
8 . This Agreement shall commence on the date first above
written and remain in effect for one (1) year.
9. This Agreement represents the entire Agreement between
the parties and may not be amended except by written instrument
signed by all parties hereto.

10. All the terms and provisions of this Agreement shall be
binding upon, inure to the benefit of, and be enforceable by the
parties and their legal representatives, successors and assigns.
IN WITNESS WHEREOF, the parties have executed this Agreement
on the day and year first above written.
