This is to advise you that on December 31, 1990, the terms for
Cherryle Thomas and Gil C. Mueller will expire. Letters were sent
to Mrs. Thomas and Mr. Mueller advising that they were eligible for
reappointment and requesting that they submit a letter of interest.
Letters requesting reappointment were received from both Mrs. Thomas
and Mr. Mueller. Additionally, a press release was issued and one
resume was received from Mr. Walter C. Pearson of District 1.
Copies of the letters and resume are attached for your review.
Please let me know, in writing, your recommendations for appointment
and I will prepare the executive summary for the Board's Agenda.

ACTIVITIES PURSUANT TO SECTION 161.053, FLORIDA STATUTES
FINAL ORDER
FINDINGS OF FACT: An application for authorization to conduct the activities seaward of the coastal
construction control line which are indicated in the project description, was filed by the
applicant/permittee named herein on July 2, 1990, and was determined to be complete pursuant to rule
on August 30, 1990. The application was considered by the Chief of the Bureau of Coastal Engineering
and Regulation on behalf of the Department of Natural Resources.
CONCLUSIONS OF LAW: After considering the merits of the proposal and any written objections from
affected persons, the Department finds that on compliance with the permit conditions, the activities
indicated in the project description are of such a nature that they will result in no significant adverse
impacts to the beach/dune areas or to adjacent properties; that the work is not expected to adversely
impact nesting sea turtles, their hatchlings, or their habitat; that the work is expendable in nature and/or
is appropriately designed in accordance with Section 16B-33.007, Florida Administrative Code; and that
it is an activity or type of construction which the Bureau Chief has authority to approve or deny pursuant
to subdelegated authority BS-5(n) and BS-5(s), Administrative Directive DNR 140, effective April 20,
1990. Based on the foregoing considerations, the Bureau Chief approves the application; authorizes
construction and/or activities at the location indicated below in strict accordance with the project
description, the approved plans (if any) which are attached and are by this reference Incorporated herein,
and the conditions provided in Section 16B-33.015, Florida Administrative Code; and also imposes any
additional conditions shown below,pursuant to Paragraph 16B-33.015(3)(u),Florida Administrative Code.
EXPIRATION DATE: ,November 27, 19 91.
LOCATION: Between approximately 300 feet north of the Department of Natural Resources' reference
monument R-132 and 380 feet south of the Department of Natural Resources reference monument R-
134, in Collier County. Project address: Tigertail Beach Park, Spinnaker Drive, Marco Island.
'ROJECT DESCRIPTION: The applicant/permittee is authorized to remove some existing vegetation
and to perform routine beach cleaning. The vegetation is to be removed from the seawardmost vegetation
line landward up to a line parallel to the existing vegetation line in accordance with Special Permit
Condition 3. The beach cleaning operation is to consist of removing debris and undesirable vegetation
• from the sandy beach areas by lightweight machinery to a location landward of the coastal construction
control line.

SPECIAL PERMIT CONDITIONS:
1. No work shall be conducted under this permit until the permittee has received a written notice to
proceed from the Department. Prior to issuance of a notice to proceed, the permittee shall provide
the Bureau staff with the following:
1.1 A Sea Turtle Protection Plan (STPP) approved by the Florida Marine Research
Institute, in St. Petersburg, Florida.
1.2 Written assurance satisfactory to the Department that the vegetation planting and
extended walkover structures specified in Special Permit Conditions 3, 4, 6 and 7
below shall be performed. A draft of the proposed assurance shall be submitted to
the Department for Its approval prior to finalizing the assurance.
1.3 Written evidence that adequate public notification of the work authorized under this
permit was printed in the appropriate local newspaper or other equivalent form of
print media.
2. Prior to commencement of construction activity authorized by this permit, a preconstruction
conference shall be held at the site among the contractor, the owner or authorized agent, and a
staff representative of the Bureau of Coastal Engineering and Regulation to establish an
understanding among the parties as to the items specified in the special and general conditions of
the permit.
3. The vegetation to be removed shall extend from the existing frontal vegetation line landward up to a
line a maximum of 100 feet landward of and parallel with the existing frontal vegetation line, but in
no case shall it lie more than 140 feet landward of the mean high water line. The area where
vegetation is W be removed from shall be staked out prior to the preconstruction conference and subject
to approval by the staff representative.
4. All removed sea oats and any other indigenous, salt-resistant, vegetation shall remain seaward of
the control line and shall be transplanted to barren areas on the site which are located seaward of
the existing walkover structures on the site. In the event the transplanted material is insufficient
to cover the barren areas, similar species from nursery stock shall be planted in the barren areas
until the area is sufficiently covered to the Department's satisfaction.
5. The permittee shall irrigate and apply fertilizer as appropriate for the particular species planted,
at least until the vegetation Is established (usually approximately 2 years after planting). At least
a 75 percent survival rate of the vegetation shall be ensured and replanting shall be conducted until
a 75 percent overall survival rate is attained and until arty sizeable barren portions of the area(s)
are covered. A temporary pedestrian traffic-control fence shall be placed at the seaward limit of
the new vegetation line to protect the vegetation until the vegetation is sufficiently established. The
siting and design of the fence shall be approved by the Bureau staff representative at the
preconstruction meeting.
6. As mitigation for the removal of the vegetation authorized by this permit, the permittee shall extend the
existing walkover structures to a point just seawall.," of the final vegetation line.
7. The transplanted and planted vegetation and the extended walkover structures shall be maintained
unless otherwise determined by the Department. In the event a storm removes or substantially damages
the vegetation and/or the walkover structures, the vegetation and walkover structures shall be replaced
no later than 60 days following said storm event, unless determined otherwise by the Department. This
condition shall be stayed if significant changes in the shoreline condition occur as determined by the
Department.

8. Beach cleaning activities are restricted to those areas seaward of the new vegetation line.

The permittee is hereby placed on notice that a new permit application for similar work shall be treated
' as a new application and shall be reviewed in the same manner as the initial applicatio i A permit shall
also be required for any beach cleaning activities which occur at Tigertail Beach Park after the expiration
date of this permit.

Meeting began 1:35 p.m.
Approval of minutes of meeting November 13. Motion by Kim, Seconded Gil 3-0
Approval of special meeting of Nov. 13, Motion - Gil, Seconded -Geneva Till
3-0 .
FMCP Building Expansion - advertised in legal section of newspaper, Dodge
reports and trade journals. Pre-bid conference is for any bidders to ask
questions regarding proposal from Purchasing, Legal, and P & R staff.
December meeting discussion - to be held December 27th, 1:30.
Motion Till, Seconded Gil. 4-0
ACTION LIST:
Vanderbilt: No new activity purchasing additional beach accesses as parking
would still be a problem. KOD suggested if PARAB wishes to do something
regarding this matter to decide what it is and then take the recommendation to
BCC. Existing beach accesses are 10' wide walkways with no parking. Mr.
Kobza to bring in maps and plans regarding the Beautification MSTU and
determination will be made whether or not to pursue the issue.
Tigertail: Copy of permit from DNR received for clearing the beach. BCC had
given parameters and permit did not meet these requirements. Decision needs
to be made whether or not to accept the permit as it stands and take it back
to BCC. After discussion Gil motioned: We not accept the communication of
11/27 from Department of Natural Resources. The Board of County
Commissioners direct staff to explore potential for offering further
additional mitigation and go to at least the "green line" as originally
established in the original resolution and to file whatever appeals are
necessary, emphasis on replacing necessary vegetation. Seconded - Steven
Ball. Roll Call Vote taken: Mrs. Till - for; Gil Mueller - for; Steven Ball
- for; Kim Kobza - for. Unanimous. KOD will try to place it as an emergency
item on BCC agenda next Tuesday.
Pools: Discussion concerning location of polls. Original Master Plan showed
a 25 meter pool in GGCP, not the Olympic size. This Olympic size pool was
always considered a facility of the regional park. Would be the largest
single facility for capital expenditure as well as operating expenses. All
enhancements - wave machine, etc. - to produce revenue from the pool are being
considered.
Attendance at meeting - Gil Mueller made motion - Our chairman write a letter
to Mrs. Thomas requesting her attendance at PARAB meetings. Seconded by Ms.
Till. 4-0
Quarterly Report: Following City of Naples procedure - need a list of
facilities which will be divided into 5 groups for PARAB members to visit.
Appointments: Applications received - District I - Gil Mueller and 1 other
person - Walter C. Pearson. District V - Mrs. Thomas requesting
reappointment.
Motion by Geneva Till - Recommend re-appointment of Gil Mueller for District I
. Seconded by Steven Ball. Passed unanimously
Motion by Steven Ball - R:ecamtiend re-appointment of Cherzyl 'Thomas as member
of PARAB for District V. Seconded by Gil Mueller. Passed unanimously.
Steven Ball requested maps shgwing the neighborhood parks be reviewed at next
Board meeting.
Catamarans - If on private property call sheriff's office and removal will be
enforced. Look into having designated areas for these boats.

behind schedule. concerns regarding the contract by the baseball team.
8. Immokalee Community Park Bathroom Facilities - design underway and should
be completed by the end of the month. Bids go out in January.
9. Pools - Design work started for 25 meter pool. Staff prepare scope
services drafted, Consultant canes in and looks at various sites,
demographics.
10. 951 Boat Ramp - parking meter for lot. Attempt to have demonstation of
master meter" for next meeting.
11. Alternate Board Member - ordinance does not all alternates. Attendance
mechanism for declaring seat vacant. Write letter encouraging attending,
including the motion.
User Fee - Recommendation to go to BCC in approximately 2 weeks.
