Agreement with Collier County as to the resolution of the Citation in reference, Citation No. PU4713 dated the
20 day of May, 2015,
In consideration of the disposition and resolution of the matters outlined in said Citation for which a hearing is
currently scheduled for August 07,2015 to promote efficiency in the administration of the code enforcement
process; and to obtain a quick and expeditious resolution of the matters outlined therein, the parties hereto
agrees as follows:
1) The violations noted in the referenced Citation are accurate and I stipulate to their existence.
2) The violations are that of Ordinance / Section(s) 134-174 N,Q.and are described as unlawful
connection to district's water system by connecting a garden hose to curbstop with a meter or
protection..
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of$50.00 incurred in the prosecution of this case.
2) Pay administrative fee of$5.00 incurred in the processing of this case.
3) Pay civil penalty of$ 1000.00.
4) Total Charges are $1055.00. r

This just happened. Angry lady.
I walked up to this vehicle to talk to the person sitting inside. No intention to
write a citation. the lady refused to roll down the window. finally she did and
she said I'm on the phone. I asked if she had a handicap permit. she said I
don't have one I'm on the phone. she rolled her window back up. I said
ma'am I need to talk to you. she rolled the window down and said I can't talk
I'm on the phone. I said okay then I'll just write you the citation. she said
fine. I wrote the ticket she rolled down the window I handed it to her and I
drove away.

Chapter 14 Article II
Sec. 14-36. Dangerous dogs; definitions and procedures.
1. Definitions.
A. Dangerous dog means any dog that according to the records of the appropriate authority:
(1) Has aggressively bitten, attacked, or endangered or has inflicted severe injury on a human being on public or
private property;
(2) Has more than once severely injured or killed a domestic animal while off the owner's property;
(3) Has, when unprovoked, chased or approached a person upon the streets, sidewalks, or any public grounds in
a menacing fashion or apparent attitude of attack, provided that such actions are attested to in a sworn
statement by one or more persons and dutifully investigated by the appropriate authority.
B. Unprovoked means that the victim who has been conducting himself or herself peacefully and lawfully has been
bitten or chased in a menacing fashion or attacked by a dog.
C.Severe injury means any physical injury that results in broken bones, multiple bites, or disfiguring lacerations requiring
sutures or reconstructive surgery.
D. Investigation is conducted by animal services. Animal services must interview the dog's owner when possible and may
require a sworn affidavit from any person desiring to have a dog classified as dangerous.
E. Proper enclosure means that, while on the owner's property,the dog can be securely confined indoors or in a securely
enclosed and locked pen or structure, suitable to prevent the entry of young children and designed to prevent the
animal from escaping. Such a pen or structure shall be structurally sound, made of materials impervious to moisture,
have secure sides and a secure top to prevent the dog from escaping over, under, or through the structure, and shall
also provide protection from injury and the elements.The square footage of a proper enclosure used as a primary
means of confinement for a dog must be equal to or greater than the length of the animal from the tip of the nose to
the base of the tail, doubled,then squared, and divided by 144. For example, a dog measuring 30 inches from the tip of
the nose to the base of the tail will require a 25 square foot enclosure (30 x 2 = 60; 60 x 60= 3,600; 3,600/144= 25).The
height of the enclosure shall be equal to or greater than the length of the animal from the tip of the nose to the base of
the tail multiplied by 1.5.
2. Procedure.
A.The Director shall investigate reported incidents involving any dog that may be dangerous and shall, if possible,
interview the owner and require a sworn affidavit from any person, including any animal control officer or enforcement
officer, desiring to have a dog classified as dangerous. Any animal that is the subject of a dangerous dog investigation,
and is not impounded with animal services, shall be humanely and safely confined by the owner in a securely fenced or
enclosed area pending the outcome of the investigation and resolution of any hearings related to the dangerous dog
classification.The address of where the animal resides shall be provided to animal services. No dog that is the subject of
a dangerous dog investigation may be relocated or ownership transferred pending the outcome of an investigation or
any hearings related to the determination of a dangerous dog classification. In the event that a dog is to be destroyed,
the dog shall not be relocated or ownership transferred.
B. Animal services may impound any dog under investigation if the owner is unable or unwilling to securely confine the
dog during the investigation. Upon written notice from animal services,the owner must allow access to the dog for the
purposes of impoundment. If the dog is impounded during this time,the owner is responsible for all costs related to
impoundment unless the owner ultimately prevails and the dog is not declared dangerous.
C.A dog shall not be declared dangerous if the threat, injury, or damage was sustained by a person who, at the time,
was unlawfully on the property or,while lawfully on the property,was tormenting, abusing, or assaulting the dog or its
owner or a family member. No dog may be declared dangerous if the dog was protecting or defending a human being
within the immediate vicinity of the dog from an unjustified attack or assault.
D. If the Director, or his or her designee, makes an initial determination that a dog is dangerous, based on the initial
investigation,the County shall provide written notification of that determination to the owner of the dog. Notice shall
be by certified mail, by certified hand delivery, by service pursuant to F.S. ch.48, or as otherwise authorized by Florida
Statute.The Director's initial determination shall automatically become final unless the dog's owner, within seven
calendar days after receipt of the notice,files a written request for a hearing to challenge the Director's initial
determination.The written request must be submitted to animal services. If the dog's owner files a timely written
request for a challenge hearing, the effective date of the determination shall be the date of the final decision of the
Special Magistrate.
E.Any owner of a dog that is initially declared dangerous by the Director may appeal that decision to the Code
Enforcement Special Magistrate.This hearing shall be held as soon as possible, but not more than 21 calendar days and
no sooner than 5 days after rece f request from the owner.The hearing my be continued by agreement of
both parties.
F. If the Special Magistrate's determination is to uphold the dangerous dog classification, animal services shall provide
written notification to the owner as required above.The dog owner may file a written request for a hearing in county
court to appeal the classification within ten (10) business days after receiving notice.This request for hearing must be
filed with the county court,and a copy provided to animal services within the time provided.Any such appeal shall not
be a hearing de novo, but shall be limited to appellate review of the record created before the Special Magistrate.
3. Registration of dangerous dog and fees.
A. Registration of dangerous dog. Not later than 14 calendar days after the final effective date, as specified above,that
the dog is determined to be a dangerous dog,the dog's owner must file a complete written standard form application
with animal services to be issued a certificate of registration for the dangerous dog.The application/administration fee
for each certificate shall be$300.00 annually.A complete application for the initial certificate of registration shall
include: (i)the filing fee and late fees, if any; (ii) a color photograph of dog and a signed acknowledgement form that the
dog will be identified by name and address on the Collier County Animal Services website; (iii) a receipt or other written
proof that the dog has been permanently identified (via tattoo or microchip); (iv)a current certificate of vaccination for
the dog; and (v) a receipt or other written proof that the dog has been spayed or neutered by a licensed veterinarian. If
there is a medical or other reason that the dog cannot be spayed or neutered,the owner will provide the reason in
writing signed by a Collier County licensed veterinarian.
B. Within ten days of receipt of a complete application, animal services will make a site visit to ensure provision of a
proper enclosure, and posting of the premises with a clearly visible warning sign at all entry points that informs both
children and adults of the presence of a dangerous dog on the property.Animal services will provide the required signs.
Upon completion of a successful site visit, animal services will issue the requested initial certificate.The duration of each
certificate is 365 days.There shall be a late fee of$10.00 per day,for each day that the certificate is not issued.
C.Annual renewal of certificate of registration. A standard renewal application must be filed annually at least ten
calendar days prior to the date that the respective certificate is to expire.A complete application for a renewal
certificate shall include the$300.00 renewal/administrative fee, a then current color photograph of each dangerous dog
sign posted at the premises where the dangerous dog resides, and a current certificate of vaccination.
D. Failure to re-register.There shall be a late fee of$10.00 for each day that a complete renewal application is not filed.
Animal services may impound any dog whose owner has: (i)filed to re-apply for registration 30 days past the expiration
of the certification; or(ii)failed to successfully complete re-registration 45 days past the expiration of the certification.
Upon written notice from animal services,the owner must allow access to the dog for the purposes of impoundment.
The owner is responsible for all costs related to impoundment. Failure to successfully re-register the dog after 30 days of
impoundment will result in forfeiture of ownership of the dog.Animal services may dispose of such an impounded dog,
in a humane manner, at the expense of the owner.
4.Subsequent handling of dangerous dogs.
A.The owner shall immediately notify animal services when a dog that has been classified as dangerous:
(1) Is loose or unconfined;
(2) Has bitten a human being or attacked another animal; and/or
(3) Is sold,given away,or dies.
Prior to a dangerous dog being sold or given away,the owner shall provide the name, address,and telephone
number of the new owner to animal services.The new owner must comply with all the requirements of this
Ordinance.The owner is required to notify the appropriate animal services authority if the dog is moved out of
jurisdiction.
B. It is unlawful for the owner of a dangerous dog to permit the dog to be outside a proper enclosure unless the dog is
muzzled and restrained by a suitable leash of dependable strength and under the control of a competent person. Unless
prohibited by the dog's physical make-up, as in brachycephalic breeds,the muzzle must be of a cage-style that will not
interfere with the dog's vision, will allow the dog to pant and drink, but will prevent it from biting a person or animal.
The owner may exercise the dog in a securely fenced or enclosed area that does not have a top,without a muzzle or a
leash, if the dog remains within his or her sight and only members of the immediate household or person 18 years of age
or older are allowed in the enclosure when the dog is present.When being transported, such dogs must be safely and
securely restrained within a vehicle.
C. Hunting dogs are exempt from the provisions of this act when engaged in any legal hunt or training procedure. Dogs
engaged in training or exhibiting in legal sports such as obedience trials, conformation shows,field trials,
hunting/retrieving trials, and herding trials are exempt from the provisions of this act when engaged in any legal
procedures. However, such dogs at all other times in all other respects shall be subject to this and local laws. Dogs that
have been classified as dangerous shall not be used for hunting purposes.

"Diesel", as described above, is a "Dangerous Dog" pursuant to Collier County Ordinance

Pursuant to Collier County Ordinance Chapter 14, Article II, Section 14-36 and/or Subsection
767.12(1)(c), to appeal this initial determination, your written request MUST be provided to
CCDAS (Attn: Officer Lynch) not later than seven (7) calendar days from the day that you
receive this letter.
If you request this hearing, the hearing will be held as soon as possible, but not later than twenty-
one (21) calendar days and not sooner than five (5) days after the day that CCDAS receives your
written request for a hearing. If you request a hearing, be sure to provide CCDAS a telephone
number where you can be reached on weekdays between 8 a.m. and 5 p.m. in order for CCDAS
to conveniently notify you of the date, time, and place of the hearing. A letter notifying you of
the same will also be sent to you. If you have a preference for a specific date and time, (or dates
and times that will be most convenient for you) you may request such dates and times in your
written request for the hearing. CCDAS will make our best effort to accommodate your request.
However, CCDAS cannot guarantee that your hearing will be scheduled on the date(s) and
time(s) as you requested. This hearing may only be rescheduled by written agreement approved
by both parties.
If you do not request a hearing within seven (7) days from the date of your receipt of this letter,
this initial determination will become a final determination that your dog is a"dangerous dog" as
determined by CCDAS.
If a final determination is made that this dog is a"dangerous dog" you will be required by law to
immediately take several actions with regard to this dog. These obligations include registering
this dog as a "dangerous dog" with CCDAS and are specified in Collier County Chapter 14,
Article II, Section 14-36 and/or Chapter 767 Florida Statutes. Additional obligations are
specified in Chapter 14 of the Collier County Code of Laws and Ordinances.
If your dog is impounded throughout this process, you will be required to pay for all costs
incurred for the care of the dog. You must pay all costs in full before your dog will be released to
you. Please note CCDAS will not hold your dog indefinitely. Failure to comply with all
requirements of this letter, Florida Law, and County ordinance will ultimately result in your
forfeiture of ownership of your dog.

I sirmarwr years of age hereby make this sworn statement as to the Dog Bite attack by
the dog Diesel on June 2,2015 at the address of 9404 Autumn Haze Dr. Naples,Florida 34109,the home
of Ron Forbis.
My friend MI and I walked into her house and started heading to her bedroom around 10:30 the night
of June 2,2015. Garrett the brother was in the next room in bed with all the dogs:We walked past the

This letter is your written notice that Collier County Domestic Animal Services (CCDAS) has
determined that there exists sufficient cause to make the initial determination that your dog,
"Diesel", as described above, is a "Dangerous Dog" pursuant to Collier County Ordinance
Chapter 14, Article II, Section 14-36 and/or Chapter 767, Florida Statutes based on the following
findings:
1) On June 2nd, 2015 has aggressively bitten, attacked, or endangered or has inflicted severe
injury on a human being on public or private property.
Pursuant to Collier County Ordinance Chapter 14, Article II, Section 14-36 and/or Subsection
767.12(1)(c), to appeal this initial determination, your written request MUST be provided to
CCDAS (Attn: Officer Lynch) not later than seven (7) calendar days from the day that you
receive this letter.
If you request this hearing, the hearing will be held as soon as possible, but not later than twenty-
one (21) calendar days and not sooner than five (5) days after the day that CCDAS receives your
written request for a hearing. If you request a hearing, be sure to provide CCDAS a telephone
number where you can be reached on weekdays between 8 a.m. and 5 p.m. in order for CCDAS
to conveniently notify you of the date, time, and place of the hearing. A letter notifying you of
the same will also be sent to you. If you have a preference for a specific date and time, (or dates

walked past the room and Jillian greeted Garret and then she and I went into her room.We were
changing into our pajamas and taking off our makeup for bed when we heard Garrett say
something and yell"what the heck was that" and all the dogs got up and were barking.
The next thing I know Diesel was in Jillian's room standing behind me with a look like he was
ready to attack. I slowly started moving away and calmly asked for Jillian as the dog had a
vicious look in his eye. I had known Diesel since he was a puppy and for some reason he just
started attacking me first in my upper left hip area and then next in my left calf area and at that
point I was so terrorized and in shock that I blacked out. Diesel also continued to attack me in
the left calf area,then in the left foot top, bottom and toe area.Jillian could not get the dog off of
me until Garrett came into the room and yelled"Diesel release".
I was then carried to the Kitchen by Jillian with blood all over me and the house and placed on
the Kitchen counter where Ron the father tried to wrap my wounds as they were gaping holes
and bleeding a lot. He then rushed me to the emergency room (NCH) downtown Naples location
where I had to have 33 stitches.

I Samantha R. Cornett 17 years of age hereby make this sworn statement as to the Dog Bite attack by
the dog Diesel on June 2,2015 at the address of 9404 Autumn Haze Dr. Naples,Florida 34109,the home
of Ron Forbis.
My friend Jillian and I walked into her house and started heading to her bedroom around 10:30 the night

Chapter 14 Article II
Sec. 14-36. Dangerous dogs; definitions and procedures.
1. Definitions.
A. Dangerous dog means any dog that according to the records of the appropriate authority:
(1) Has aggressively bitten, attacked, or endangered or has inflicted severe injury on a human being on public or
private property;
(2) Has more than once severely injured or killed a domestic animal while off the owner's property;
(3) Has, when unprovoked, chased or approached a person upon the streets, sidewalks, or any public grounds in
a menacing fashion or apparent attitude of attack, provided that such actions are attested to in a sworn
statement by one or more persons and dutifully investigated by the appropriate authority.
B. Unprovoked means that the victim who has been conducting himself or herself peacefully and lawfully has been
bitten or chased in a menacing fashion or attacked by a dog.
C.Severe injury means any physical injury that results in broken bones, multiple bites, or disfiguring lacerations requiring
sutures or reconstructive surgery.
D. Investigation is conducted by animal services.Animal services must interview the dog's owner when possible and may
require a sworn affidavit from any person desiring to have a dog classified as dangerous.
E. Proper enclosure means that, while on the owner's property, the dog can be securely confined indoors or in a securely
enclosed and locked pen or structure, suitable to prevent the entry of young children and designed to prevent the
animal from escaping. Such a pen or structure shall be structurally sound, made of materials impervious to moisture,
have secure sides and a secure top to prevent the dog from escaping over, under, or through the structure, and shall
also provide protection from injury and the elements.The square footage of a proper enclosure used as a primary
means of confinement for a dog must be equal to or greater than the length of the animal from the tip of the nose to
the base of the tail, doubled, then squared, and divided by 144. For example, a dog measuring 30 inches from the tip of
the nose to the base of the tail will require a 25 square foot enclosure (30 x 2 = 60; 60 x 60=3,600; 3,600/144=25).The
height of the enclosure shall be equal to or greater than the length of the animal from the tip of the nose to the base of
the tail multiplied by 1.5.
2. Procedure.
A.The Director shall investigate reported incidents involving any dog that may be dangerous and shall, if possible,
interview the owner and require a sworn affidavit from any person, including any animal control officer or enforcement
officer, desiring to have a dog classified as dangerous.Any animal that is the subject of a dangerous dog investigation,
and is not impounded with animal services, shall be humanely and safely confined by the owner in a securely fenced or
enclosed area pending the outcome of the investigation and resolution of any hearings related to the dangerous dog
classification.The address of where the animal resides shall be provided to animal services. No dog that is the subject of
a dangerous dog investigation may be relocated or ownership transferred pending the outcome of an investigation or
any hearings related to the determination of a dangerous dog classification. In the event that a dog is to be destroyed,
the dog shall not be relocated or ownership transferred.
B.Animal services may impound any dog under investigation if the owner is unable or unwilling to securely confine the
dog during the investigation. Upon written notice from animal services,the owner must allow access to the dog for the
purposes of impoundment. If the dog is impounded during this time,the owner is responsible for all costs related to
impoundment unless the owner ultimately prevails and the dog is not declared dangerous.
C. A dog shall not be declared dangerous if the threat, injury, or damage was sustained by a person who, at the time,
was unlawfully on the property or,while lawfully on the property,was tormenting, abusing, or assaulting the dog or its
owner or a family member. No dog may be declared dangerous if the dog was protecting or defending a human being
within the immediate vicinity of the dog from an unjustified attack or assault.
D. If the Director,or his or her designee, makes an initial determination that a dog is dangerous, based on the initial
investigation,the County shall provide written notification of that determination to the owner of the dog. Notice shall
be by certified mail, by certified hand delivery, by service pursuant to F.S. ch. 48, or as otherwise authorized by Florida
Statute.The Director's initial determination shall automatically become final unless the dog's owner, within seven
calendar days after receipt of the notice,files a written request for a hearing to challenge the Director's initial
determination.The written request must be submitted to animal services. If the dog's owner files a timely written
request for a challenge hearing, the effective date of the determination shall be the date of the final decision of the
Special Magistrate.
E. Any owner of a dog that is initially declared dangerous by the Director may appeal that decision to the Code
Enforcement Special Magistrate.This hearing shall be held as soon as possible, but not more than 21 calendar days and
no sooner than 5 days after receipt of request from the owner.The hearing may only be continued by agreement of
both parties.
F. If the Special Magistrate's determination is to uphold the dangerous dog classification, animal services shall provide
written notification to the owner as required above.The dog owner may file a written request for a hearing in county
court to appeal the classification within ten (10) business days after receiving notice.This request for hearing must be
filed with the county court, and a copy provided to animal services within the time provided. Any such appeal shall not
be a hearing de novo, but shall be limited to appellate review of the record created before the Special Magistrate.
3. Registration of dangerous dog and fees.
A. Registration of dangerous dog. Not later than 14 calendar days after the final effective date, as specified above,that
the dog is determined to be a dangerous dog,the dog's owner must file a complete written standard form application
with animal services to be issued a certificate of registration for the dangerous dog.The application/administration fee
for each certificate shall be$300.00 annually.A complete application for the initial certificate of registration shall
include: (i)the filing fee and late fees, if any; (ii) a color photograph of dog and a signed acknowledgement form that the
dog will be identified by name and address on the Collier County Animal Services website; (iii) a receipt or other written
proof that the dog has been permanently identified (via tattoo or microchip); (iv) a current certificate of vaccination for
the dog; and (v) a receipt or other written proof that the dog has been spayed or neutered by a licensed veterinarian. If
there is a medical or other reason that the dog cannot be spayed or neutered,the owner will provide the reason in
writing signed by a Collier County licensed veterinarian.
B.Within ten days of receipt of a complete application, animal services will make a site visit to ensure provision of a
proper enclosure, and posting of the premises with a clearly visible warning sign at all entry points that informs both
children and adults of the presence of a dangerous dog on the property.Animal services will provide the required signs.
Upon completion of a successful site visit, animal services will issue the requested initial certificate.The duration of each
certificate is 365 days.There shall be a late fee of$10.00 per day,for each day that the certificate is not issued.
C.Annual renewal of certificate of registration.A standard renewal application must be filed annually at least ten
calendar days prior to the date that the respective certificate is to expire. A complete application for a renewal
certificate shall include the$300.00 renewal/administrative fee, a then current color photograph of each dangerous dog
sign posted at the premises where the dangerous dog resides, and a current certificate of vaccination.
D. Failure to re-register.There shall be a late fee of$10.00 for each day that a complete renewal application is not filed.
Animal services may impound any dog whose owner has: (i)filed to re-apply for registration 30 days past the expiration
of the certification; or(ii)failed to successfully complete re-registration 45 days past the expiration of the certification.
Upon written notice from animal services,the owner must allow access to the dog for the purposes of impoundment.
The owner is responsible for all costs related to impoundment. Failure to successfully re-register the dog after 30 days of
impoundment will result in forfeiture of ownership of the dog.Animal services may dispose of such an impounded dog,
in a humane manner, at the expense of the owner.
4.Subsequent handling of dangerous dogs.
A.The owner shall immediately notify animal services when a dog that has been classified as dangerous:
(1) Is loose or unconfined;
(2) Has bitten a human being or attacked another animal; and/or
(3) Is sold,given away, or dies.
Prior to a dangerous dog being sold or given away,the owner shall provide the name, address, and telephone
number of the new owner to animal services.The new owner must comply with all the requirements of this
Ordinance.The owner is required to notify the appropriate animal services authority if the dog is moved out of
jurisdiction.
B. It is unlawful for the owner of a dangerous dog to permit the dog to be outside a proper enclosure unless the dog is
muzzled and restrained by a suitable leash of dependable strength and under the control of a competent person. Unless
prohibited by the dog's physical make-up, as in brachycephalic breeds, the muzzle must be of a cage-style that will not
interfere with the dog's vision, will allow the dog to pant and drink, but will prevent it from biting a person or animal.
The owner may exercise the dog in a securely fenced or enclosed area that does not have a top, without a muzzle or a
leash, if the dog remains within his or her sight and only members of the immediate household or person 18 years of age
or older are allowed in the enclosure when the dog is present. When being transported,such dogs must be safely and
securely restrained within a vehicle.
C. Hunting dogs are exempt from the provisions of this act when engaged in any legal hunt or training procedure. Dogs
engaged in training or exhibiting in legal sports such as obedience trials, conformation shows,field trials,
hunting/retrieving trials, and herding trials are exempt from the provisions of this act when engaged in any legal
procedures. However, such dogs at all other times in all other respects shall be subject to this and local laws. Dogs that
have been classified as dangerous shall not be used for hunting purposes.
D.This section does not apply to dogs used by law enforcement officials for law enforcement work.
5.Attack or bite by dangerous dog.
A. If a dog that has previously been declared dangerous attacks or bites a person or a domestic animal without
provocation,the owner is guilty of a misdemeanor of the first degree, punishable as provided in F.S. ch. 775, and subject
to imposition of a fine not to exceed $500.00. In addition,the dangerous dog shall be immediately confiscated by animal
services, placed in quarantine, if necessary, for the proper length of time, or impounded and held for ten business days
after the owner is given proper written notification, and thereafter destroyed in an expeditious and humane manner.
This ten-day time period shall allow the owner to request a hearing as outlined above in this section.The owner shall be
responsible for payment of all boarding costs and other fees as may be required to humanely and safely keep the animal
during any appeal procedure.
B. If a dog that has not been declared dangerous attacks and causes severe injury to or death of any human,the dog
shall be immediately confiscated by animal services, placed in quarantine, if necessary, for the proper length of time or
held for ten business days after the owner is given proper written notification, and thereafter destroyed in an

knowledge of the dog's dangerous propensities, yet demonstrated a reckless disregard for such propensities under the
circumstances, the owner of the dog is guilty of a misdemeanor of the second degree, punishable as provided in F.S. ch.
775, and subject to imposition of a fine not to exceed $500.00.
C. If a dog that has previously been declared dangerous attacks and causes severe injury to or death of any human, the
owner is guilty of a felony of the third degree, punishable as provided in F.S. ch. 775. In addition,the dog shall be
immediately confiscated by animal services, placed in quarantine, if necessary,for the proper length of time or held for
ten business days after the owner is given proper written notification, and thereafter destroyed in an expeditious and
humane manner. This ten-day time period shall allow the owner to request a hearing under this section.The owner shall
be responsible for payment of all boarding costs and other fees as may be required to humanely and safely keep the
animal during any appeal procedure.
D. If the owner files a written appeal under this section,the dog must be held and may not be destroyed while the
appeal is pending.
E. If a dog attacks or bites a person who is engaged in or attempting to engage in a criminal activity at the time of the
attack,the owner is not guilty of any crime specified under this section.
6. Violations.
A. Failure to comply with any provision of this section may result in a fine not to exceed $500.00 and impoundment of
the subject dog. Upon written notice from animal services,the owner must allow access to the dog for the purposes of
impoundment.The owner is responsible for all costs related to impoundment.
B. Failure to cure any violation of this section within 30 days of impoundment of the subject dog will result in forfeiture
of ownership of the dog.Animal services may dispose of such an impounded dog, in a humane manner at the expense of
the owner.
C. Upon second occurrence of a violation of this section, failure to cure within ten days of impoundment of the subject
dog will result in forfeiture of ownership of the dog. Animal services may dispose of such an impounded dog, in a
humane manner at the expense of the owner.

06/29/2015 06/30/15 The victim is Her mother Laura told me that was visiting the
dog owners sister. She was sitting and folding laundry when the dog walked up behind her and
attacked her.According to the victims mother, received over 1111111Mincluding both

wand_ She said the hospital took a bite report.This report was never received by DAS.
Laura said the dog owner told her they were going to put the dog to sleep. She later saw a posting
on snap chat that they were trying to find a home for the dog.The dog owner will not speak to the
victim's mother at all. She said the medical bills are around$40,000. She said the dog owner has
now given the dog away and she is worried that this dog will "kill somebody".She does not know
who the dog was given to. I did advise her that we can not get involved in any of the financial
aspects of the dog bite. She said they already have a lawyer for that aspect of the case. 102/NE

Upon arrival of 560 Ketch Dr,we made contact with Mr.&Ms. Cornett(bite victim's parents)as well
as regarding the incident that occurred on June 2nd. WIRD
explained that she was at her friend, house(they have been friends for approximately 5
years)when they were preparing for a sleepover. _heard the dogs in the residence get
excited and start barking at a noise they heard&the dog owner,Garret Forbis,make a statement
about the noise and the dogs barking;when IIIIIIIIIbturned around "Diesel"was standing behind
her and looked "strange",she took a step back and yelled for her friend; "Diesel"then attacked,
biting her on her andaill The dog would not release his hold until Mr. Forbis yelled
"release";they then carried_from the room and sought medical attention. Man
sustained numerous injuries,and received to try and close the
wound(s). Photographs were taken of the wounds on hem the wound on
it and the other wound photographs will be attached.
Ms. Cornett stated that they had filled out a bite card at the hospital the day of the incident and isn't
sure why the report did not make it to DAS. I discussed the most pressing concern of possible rabies
exposure during the incident and the quarantine period that follows(over due at this time); I did
assure Ms.Cornett that if the dog was alive and well 10 days after the incident that she can rest
assured the rabies virus was not transmitted during that time(there are ads attempting to rehome
the dog around the 20th of this month). I explained that we would try to formally release the dog
from quarantine as that is the immediate concern. We also discussed that Dangerous Dog
procedures, investigation,definition and what would occur if the dog were to be declared. I
provided an affidavit forallato submit(mother will also sign for notary); Ms.Cornett will
include any photographs of the injury as well as medical records and other relevant information to
assist in the investigation. I provided Ms.Cornett with DAS contact information and my email
address if they have any additional questions or concerns;I also advised that we would be in contact
with updates as we receive them.

Upon arrival at 9404 Autumn Haze Ln,we were unable to make contact with anyone at the
residence. While ringing the doorbell(three times)and knocking on the door,we were able to hear
one smaller breed dog and what sounded like a larger breed dog however we were unable to see
through the front door window because of the high glare; unable to confirm identity of"Diesel"or if
he is currently at the residence at this time. There were 4 vehicles in the driveway at this time-a
red hummer(WI)plates,a white jeep wrangler,a dark blue large van/bus type vehicle and a maroon
chevy SUV with the front hood up. (Ms.Cornett had stated that the Forbis family is currently on
vacation in Michigan but that dog owner Garret Forbis stays behind in Naples).
We left a notice on the front door requesting DAS contact as soon as possible to discuss the incident
that occurred earlier this month,as well as a blank affidavit.
Re-sequenced to continue to attempt contact and positive ID of"Diesel"for quarantine purposes.

Upon arrival of 9404 Autumn Haze drive,we observed the same 4 vehicles listed in the previous
memo still in the driveway(one still with hood open),as well as the notice and affidavit from
yesterday left at the front door. We were again unable to make contact with anyone at the
residence, hearing a small breed and larger breed sounding dogs barking at the doorbell(twice). We
were able to peer through the front glass,and at a specific angle were able to observe a large
bully-breed white and black dog standing behind a gate;this dog matches the description and the
photograph that we have for"Diesel" (will try to confirm description of other dogs owned by
residents with victim and her family). We left a notice taped to the rear of the hummer spare wheel
(photographs attached) in the event that the front door is not frequently utilized requesting
immediate contact with DAS and warning that citations would be issued if contact is not made within
24 hours.
Unable to make contact with the victim's mother, Laura Cornett,via phone; left a voicemail
describing the dog and requesting DAS contact to advise whether they have additional dogs
matching that description at the location.
Re-sequenced for attempted contact again tomorrow.

the dog I observed through the window was"Diesel"(no other dogs matching his description at this
location). I advised that he was now"released"from quarantine and they should have no immediate

the affidavits and medical records to DAS sometime today. I advised that I would remain in contact
as more information is received.

After review of the affidavit(s),medical records and photographs, it has been determined that the
incident that occurred on June 2nd, 2015 involving (A187892)"Diesel",owned by(P116708)Garret
Forbis, resulted in the victim sustaining severe injury; meeting the definition of Dangerous Dog as
defined by Florida State Statute(FSS)and Collier County Animal Control Ordinance(CCACO),as
included below,and has resulted in the initial declaration of"Diesel" by Domestic Animal Services
(DAS).
Investigating Officer to deliver the Dangerous Dog Initial Declaration Letter, Dangerous Dog
Acknowledgement,additional copy of Dangerous Dog Ordinance and a blank Dangerous Dog
Registration Application tomorrow.
CCACO-Chapter 14 Article II Section 14-36(1)
(A)Dangerous dog means any dog that according to the records of the appropriate authority:
(1)Has aggressively bitten,attacked,or endangered or has inflicted severe injury on a human
being on public or private property
(C) Severe injury means any physical injury that results in broken bones, multiple bites,or
disfiguring lacerations requiring sutures or reconstructive surgery.

Upon arrival of 9404 Autumn Haze Dr,we observed several vehicles in the driveway(as mentioned in
previous memos,as well as a lifted pick up truck)and a package on the front porch. We were
unable to make contact with anyone at the residence but could hear three dogs(one large,two
small) barking from inside.
I made contact with dog owner Garret Forbis via phone,who stated that he was out of town and
would not be back until next week. Mr. Forbis stated that family members were caring for the dogs
while he is gone, but would not provide a time of day when they would be at the residence. Mr.
Forbis stated that he hadn't heard from DAS"in a while"and wanted to know what paperwork
needed to be signed. I explained that"Diesel"was being declared Dangerous as per CCACO&FSS,
but that he would have plenty of time to appeal the decision, if that is his wish,as the hearing will
not be for 3 more weeks and the delivered packet would include all the information that is necessary
for him to educate himself on the declaration. Mr. Forbis stated that he wanted to sign the
paperwork and asked if it could wait until next week; I explained that I would prefer the paperwork
be delivered this weekend and left for his return as he could start reviewing the information with his
family earlier; Mr. Forbis hung up the phone before any additional information could be provided. I
tried to call back; Mr. Forbis did not answer; voicemail left requesting DAS contact.
I made contact with victim's mother Ms.Cornett via phone,who confirmed that she also believes
that Mr. Forbis is in WI for vacation,but that other family members should be at the residence caring
for the dogs. Ms. Cornett advised that Mr. Forbis'father, Ron Forbis,owns several businesses, and
may be contacted in that manner.
Notice taped to back of Hummer license plate requesting DAS contact of the resident and/or
caretaker.
Activity re-sequenced to attempt contact again later this afternoon.

the Danger Dog Declaration packet to him for which he signed a receipt. He expressed a desire to
appeal the initial declaration and understands that his appeal request must be submitted in writing
within the time frame laid out in the letter.
