AGENDA APPROVAL With the placement of items 9, 10 and 11 immediately before item 6, the agenda was unanimously approved on a motion by Mr. Cravens and a second by Mr. Bachman. APPROVAL OF MAY 6 MEETING MINUTES Mr. Cravens motioned, Mr. Streckenbein seconded that all Board minutes be summary minutes only in the future and approved the minutes with the following additions and corrections: Dr. Bush asked that her name include her title in the future, and item C under Chair's Comments should read that they are trying to prevent left turns from the south exit at Waterpark Place, and a direct left turn that goes into Marker 36 parking lot. Under FDEP Permit Modification, Dr. Trecker indicated that this entire section should be reduced to: "Concerns over al- lowing up to 10 percent silt content in the dredge through Clam Pass placed on the beach were discussed. The Board took no action. As a result, no change in the al- lowable silt content was made in the current dredging permit application." Under the Administrator Feedback item, the entire section should be reduced to: "The directors critiqued Mr. Dorrill's performance and provided a number of sugges- tions." Ms. O'Brien noted that her name was misspelled in the middle of the ap- proval of the 3/4/15 minutes, and the sentence in that same section beginning "Once the process.." should read "Once the project.. ". At the top of Page 6, the motion makers were Dr. Trecker and Mr. Streckenbein. At the bottom of the page, Mr. Cravens was the motion maker. On Page 8, in the third line from the bottom, it was Dr. Trecker rather than Mr. Cravens who indicated "he had problems with quite a bit of it ". On Page 4 in the 4th line from the top, Dr. Trecker felt that the sentence reading "In response to Dr. Trecker's concern" should read "In response to Dr. Trecker's K Pelican Bay Services Division Board Regular Session June 3, 2015 request for more specifics.. ". At the end of that section, the last sentence should read "....the Board should directly manage the process ". The motion then carried unanimously. AUDIENCE COMMENTS Dr. Joseph Doyle commented on expenses related to temporary labor and vehicle pur- chases. Mr. Frank Miele, Magna -Bon, presented a copper solution to treat algae in the lakes. BIDS FOR OAK LAKE SANCTUARY LAKE BANK WORK Dr. Trecker moved, Mr. Cravens seconded to award the lake bank work at Oak Lake Sanctuary to Surety Construction, authorizing expenditures of up to $120,000. After Board and Audience comments, the motion carried unanimously. OAK LAKE SANCTUARY SWALE Mr. Cravens moved, Mr. Dawson seconded moving forward with the Sanctuary swale concept and the associated budget amendment not to exceed $55,000. After Board and Audience comments, the motion carried unanimously. BIDS FOR OAKMONT LAKE BANK WORK The Board had approved this project at a prior meeting and asked staff to work with Sure- ty to reduce their bid not to exceed $50,000 if possible. CIP PHASE 3 LANDSCAPING PLANS Dr. Chicurel moved, Mr. Cravens seconded that the PBSD place a one year mora- torium on the CIP Phase 3 relandscaping proposal provided by Goetz & Stropes, and that the year be used to re- evaluate the landscape goals, and to determine what those goals should be. After Board and audience comments, the motion carried unanimouslv. MULTI -WAY STOP AT NORTH POINTE DRIVE AND PELICAN BAY BOULEVARD Dr. Chicurel moved, Mr. Cravens seconded that the PBSD advise the County Traf- fic Operations Department not to install a three -way stop at the intersection of North Pointe Drive and Pelican Bay Boulevard as the criteria has not been met. After Board and audience comments, the motion carried 9 -1. Mr. Bachman ab- stained. 3 Pelican Bay Services Division Board Regular Session June 3, 2015 BEACH RENOURISHMENT Dr. Trecker moved, Dr. Bush seconded that the PBSD fund no beach renourish- ment in the section of Pelican Bay beach for which is has responsibility in 2015. The motion carried unanimously. A letter from the PBSD Board would be sent to Mr. McAlpin confirming this decision. WATER PARAMETERS FOR BERM SITES Ms. O'Brien moved, Dr. Trecker seconded that the PBSD Board begin to collect samples at the six berm sites on a monthly basis per the parameters outlined in the Clam Bay NRPA Management Plan. The motion carried unanimously. CLAM BAY PILOT OYSTER PROGRAM Ms. O'Brien moved, Dr. Trecker seconded that 15 oyster recruitment stations be deployed this summer throughout the waters of the Clam Bay system to ascertain whether oysters can be sustained in the system, at a cost not to exceed $1,500. The motion carried unanimously. BRAZILIAN PEPPER REMOVAL The contractor who does exotic removal for PBSD would be asked to remove Brazilian Pepper in several areas. The issue of the PBSD doing exotic removal on the beach will be dis- cussed at the next Clam Bay Committee meeting. FISCAL YEAR 2016 BUDGET Dr. Trecker moved, Mr. Cravens seconded to approve the fiscal year 2016 Budget as presented. Landscape & Safety Committee 4 Pelican Bay Services Division Board Regular Session June 3, 2015 The lack of visibility at the Pebble Creek Crosswalk continues to be an issue and the need to encourage use of the crosswalk button was noted. The changes to the median on Pelican Bay Boulevard at Waterpark Place would be addressed at the July Board meeting. d. Water Management Committee The Board /Committee will address and define PBSD water management policies. CHAIR'S COMMENTS a. PBSD and PBF Landscaping The PBSD and PBF are in the process of working toward formalizing an agree- ment relating to PBSD landscaping maintenance work done on PBF property. Topics for future meetings Board members were asked to bring topics for future agendas to the next meeting. In none of the reports has there been any thing mentioned about the water lily problem. As a resident of the Willow Brook condominium complex, I am appalled that you have taken no action to remove water lilies from the lake that surrounds our pool.We have just completed an extensive upgrading of our pool at considerable expense. Parts of the Lake that runs from Gulf Park Drive to the Pelikin Bay Club are clear—but water lilies and other vegetation back up on the area near and around the Willow Brook pool! In a survey of the Internet, I discovered a number of products that kill water lilies without affecting marine life. I suggest your Board should take steps to purchase some of these products. Georgetown Removal of a shoal in pond he could see from his home. resident DRAFT Water Management in Pelican Bay Per Collier County ordinance, PBSD provides water management service for PB There are 63 water management ponds in six drainage basins in PB. In most cases these water management ponds are owned by the associations in which they are located. PBSD has drainage easements for 44 of these ponds. These easements provide right -of- way access to the ponds to perform the specific drainage - related work outlined in the easements. Each easement is unique, but in most cases the easement specifies that it is "for access and drainage, including the construction, placement, maintenance, repair and replacement of drainage swales, lakes, embankments, structures, pipes, manholes and related appurtenances over, under, on and through the properties described..." PBSD is the permitee for several South Florida Water Management District ( SFWMD) permits for water management in Pelican Bay. The permit issued in 1978 covers basins I, II, and III . The SFWMD permit for basins IV and V was issued in 1989, and the SFWMD permit for basin VI was issued in ?. Included in the permit for basin I, II, and III was this specific condition: "Water quality data for the water discharged from the permittee's property shall be submitted to the ( SFWMD) District." The SFWMD permit for System (basin) IV includes these special conditions: "The permittee shall be responsible for the correction of any water quality, erosion or shoaling problems that result from the construction or operation of the surface water management system. Lake side slopes shall be 4:1 (horizontal to vertical) to a depth of two feet below the control elevation. Side slopes shall be nurtured or planted from 2 feet below to 1 foot above control elevation to insure vegetative growth." Special conditions for the SFWMD permit for System (basin) V special were as follows: "The permittee shalt be responsible for the correction of any erosion or shoaling problems that result from the construction or operation of the surface water management system. The permittee shall be responsible for the correction of any water quality problems that result from the construction or operation of the surface water management system. In 2013 PBSD stopped using copper sulfate in the ponds for which it has drainage easements and asked that PB associations also stop using copper sulfate. PBSD has found that aeration equipment and littoral plantings and tall grass at ponds' edges help reduce nutrients and algae in ponds and has encouraged all associations in PB to use this equipment and plantings in its ponds. PBSD has one pilot program using floating islands in the pond at Avalon. The effectiveness of this program will be evaluated. PBSD staff checks the 44 ponds on a ? basis and uses ? to control weeds and ? to control algae, and ? for ? PBSD staff checks the embankments and erosion of the 44 ponds on a ? basis. The pipes connecting the ponds are checked on a ? basis. PBSD conducts water quality testing on a quarterly basis in 30 of the ponds in PB PBSD installed the fountains in the ponds in Georgetown (North) and Glenview and will not repair /replace these fountains when they stop working. PBSD has purchased and installed aeration equipment in ? ponds for which it has drainage easements and will install aeration equipment in the remainder of ponds on which it has drainage easements as funds are available. Associations which own the ponds are responsible for energy costs for the aeration equipment and for repairs and replacement equipment as needed. PBSD will remove aeration equipment it installed upon the request of the owners of the pond. PBSD will remove exotics and other vegetation around ponds for which it has easements if they are blocking the flow of water through established swales, flow - ways, pipes, and ponds. PBSD will provide interested associations with start -up littoral plantings for the ponds for which PBSD has drainage easements. NOTES: Notes in bold need to discussed and edited by the Water Management Committee and /or PBSD Board. Documents requested by Henry Bachman and included in the May board materials were a primary source for this draft. It appears we have the SFWMD staff report for the initial permit, but not the actual permit. The initial permit may include additional special or limiting conditions not listed above. It appears we don't have the permit modification document for basin VI. PBSD may want to consider making basin IV a priority for littoral plants because they are mentioned in the permit. Per the drainage easements we have seen to date, none include any landscaping responsibilities, making those who own the ponds responsible for landscaping. As we discussed, specific requirements must be met in order for a member to participate in a meeting and vote by phone. The requirements are: 1- A quorum of members physically present in the room. (The absent member may not count toward the quorum.) 2- The quorum must vote (majority vote) to allow the member to appear by phone and must make a finding of an extraordinary circumstance. The Attorney General's Office has opined that an extraordinary circumstance may be an illness or it may be whatever the majority of the committee finds to be extraordinary. Number of board members required to be present The Sunshine Law extends to the discussions and deliberations as well as the formal action taken by a public board or commission. There is no requirement that a quorum be present for a meeting of members of a public board or commission to be subject to s. 286.011, F.S. Instead, the law is applicable to any gathering, whether formal or casual, of two or more members of the same board or commission to discuss some matter on which foreseeable action will be taken by the public board or commission. Circumstances in which the Sunshine Law may apply to a single individual or where two board members are not physically present Section 286.011, F.S., applies to public boards and commissions, i.e., collegial bodies, and has been applied to meetings of "two or more members" of the same board or commission when discussing some matter which will foreseeably come before the board or commission. Therefore, the statute does not ordinarily apply to an individual member of a public board or commission or to public officials who are not board or commission members. Inf. Certain factual situations, however, have arisen where, in order to assure public access to the decision - making processes of public boards or commissions, it has been necessary to conclude that the presence of two individuals of the same board or commission is not necessary to trigger application of s. 286.011, F.S. As stated by the Supreme Court, the Sunshine Law is to be construed "so as to frustrate all evasive devices." Town of Palm Beach a Gradison, 296 So. 2d 473, 477 (Fla. 1974). a. Written correspondence between board members A commissioner may send a written report to other commissioners on a subject that will be discussed at a public meeting without violating the Sunshine Law, if prior to the meeting, there is no interaction related to the report among the commissioners and the report, which is subject to disclosure under the Public Records Act, is not being used as a substitute for action at a public meeting. AGO 89 -23. And see AGO 01 -20 (e -mail communication of factual background information from one council member to another is a public record but does not constitute a meeting subject to the Sunshine Law when it does not result in the exchange of council members' comments or responses on subjects requiring council action). If, however, the report is circulated among board members for comments with such comments being provided to other members, there is interaction among the board members which is subject to s. 286.011, F.S. In addition, the Attorney General's Office has expressed concern that a process whereby board members distribute their own position papers on the same subject to other members is "problematical" and should be discouraged. See AGO 01 -21 (city council's discussions and deliberations on matters coming before the council must occur at a duly noticed city council meeting and the circulation of position statements must not be used to circumvent the requirements of the statute). AGO 93 -90. b. Meetings conducted over the telephone or using electronic media technology (1) Discussions conducted via telephones, computers, or other electronic means are not exempted from the Sunshine Law As discussed in this manual, the Sunshine Law applies to the deliberations and discussions between two or more members of a board or commission on some matter which foreseeably will come before that board or commission for action. The use of a telephone to conduct such discussions does not remove the conversation from the requirements of s. 286.011, F.S. See State a Childers, No. 02- 21939 -MMC; 02- 21940 -MMB (Escambia Co. Ct. June 5, 2003), per curiam affirmed, 886 So. 2d 229 (Fla. 1 st DCA 2004) (telephone conversation during which two county commissioners and the supervisor of elections discussed redistricting violated the Sunshine Law). (2) Authority of boards to conduct public meetings via electronic media technology (e.g., telephone or video conferencing) (a) State boards In AGO 98 -28, the Attorney General's Office concluded that s. 120.54(5)(b)2., F.S., authorizes state agencies to conduct public meetings via electronic means provided that the board complies with uniform rules of procedure adopted by the state Administration Commission. These rules contain notice requirements and procedures for providing points of access for the public. See Rule 28 -109, F.A.C. There are 6 access modifications to Pelican Bay Blvd labeled in order from north to south. These are labeled on the attached plan sheet 2 of 7. I just spoke with their engineer, Mark Minor,and he informed me that he met with the Collier County Transportation Operations and Right-Of-Way departments on 06/25. The County is requesting a traffic study to justify things such as spacing between driveways and turn lane lengths. The plans will likely change at least a little bit. Per Note#2 on the plan,the proposed work in the Pelican Bay Blvd right-of-way will be restored to pre- construction conditions. However, per my discussion with Mr. Minor,the exceptions are: Access 1-the northbound left turn lane will be lengthened to at least 225 feet and remain that way, Access 2 -the existing southbound left turn lane will be removed and remain that way, Access 5—the median will be converted from a full access to a southbound u-turn only and remain that way, Access 6-will remain a permanent turn lane into Sandpiper parking lot. Below are my comments on each access point: ACCESS 1 This main access to Waterpark will remain in its current location. The existing landscape median, palm trees and sign will be removed temporarily to be replaced with pavers to accommodate two lanes in and two lanes out. The existing southbound entry radius (right turns in)will be widened to a 65' radius to accommodate large vehicles. The plan does NOT show the existing paver crosswalk and sidewalk curb ramp recently constructed on Pelican Bay Blvd. The proposed 65' radius does not work well with the existing crosswalk and with the existing berm access asphalt path. There are also utilities in this area including a gas valve and telephone pedestal that need to be adjusted/relocated. We recommend that the existing driveway radius remain to not affect the existing paver crosswalk and asphalt path. In speaking with Mr. Minor he indicated that the increased 65' radius was something a previous County employee requested in 2008, and probably won't be necessary based on the 06/25 County meeting. ACCESS 2 The existing Grenadier Blvd access will remain in its current location and become a temporary construction access. Upon completion of Waterpark this access will revert back to the permanent resident access. The existing southbound left turn lane (u-turn) is being closed for safety purposes by County request because there is no driveway on the east side of Pelican Bay Blvd. ACCESS 3 This is a new resident access,which effectively is a temporary relocation of existing Access 2. Residents will use this access until construction is complete and Access 2 is restored. We are concerned that the spacing between Access 2 and 3 is short which could cause conflicts for turning movements. The County has requested a traffic study to address this. Also it appears that one or two existing oak trees in the median will need to be removed to accommodate the northbound left turn lane. ACCESS 4 This is a temporary exit driveway for St. Laurent to take exiting vehicles off the Access 3 location. This driveway will be removed and restored after construction. ACCESS 5 This is a modification to the existing exit driveway for St. Pierre to allow right turns only to Pelican Bay Blvd. The existing Pelican Bay Blvd median will be closed to prohibit left turns exiting St. Pierre. The existing northbound left turn lane on Pelican Bay Blvd will be closed,and the existing southbound left turn lane will be modified to u-turns only. ACCESS 6 This is a permanent left turn lane which should provide improved access to Sandpiper Club parking lot. These plans will be modified based on the engineer's meeting with County Transportation last week. The engineer is also preparing a site plan for Collier County that shows the proposed (final) conditions after tower construction is complete and right-of-way restoration is complete. The drainage plan (sheet 7 of 16) is very similar to the drainage plan of 2008 for Waterpark Place as permitted by Collier County and SFWMD. Stormwater will be collected from the buildings, roads and open site via a series of connected storm inlets and pipes. Discharge is at the northwest corner of the property through a proposed drainage control structure. This control structure is the same as previously permitted with a rectangular notch and a 3" diameter circular bleeddown orifice to the PBSD drainage easement along the north berm. There is no on-site water storage or pretreatment volume required as is the case for the other existing tower sites along the west side of Pelican Bay Blvd. Stormwater storage from these tower sites is provided within the PBSD easement and is regulated by the existing discharge structures located along the north berm. A swale is proposed along the north property line to contain any runoff between the new development and the existing asphalt path, per Section A-A on sheet 8 of 16. The proposed Waterpark Place site land use coverage proposes less impervious area than previously designed in 2008. Total open space is 8.21 acres compared to 8.14 acres previously. The property owner has submitted a minor change to the existing SFWMD permit which appears to be complete for issuance soon. The Waterpark Place drainage and stormwater system design appears consistent with the previously permitted site and the typical design for the adjacent tower sites. The video replay should be available in the BCC video archives. Dr. Doyle spoke after the Public Utilities (water) and before Debt Service agenda items. The following areas were highlighted: 1. Vehicle replacement schedule--the 2009 truck only has 36K miles and does not need to be replaced this coming fiscal year. The operations manager does not need a fancy Ford Explorer ($45K) replacement for his vehicle--a less expensive ($30K) SUV or a truck if he needs towing capability will suffice. 2. Manpower--3 full-time permanent positions versus temporary labor especially in context of item #3. 3. Foundation property maintenance transition 4. Uncoupling budget assessment from spending authority--i.e. large ticket items, such as vehicles, should come to PBSD Board prior to placement of the purchase order. As you know, the budget is a "living document" and can be adjusted to spend LESS taxpayer money. We can surely find savings to keep the assessment under $500. He indicated he would have benefitted upon his appointment from some background materials/information about what the PBSD does, including the dos and don'ts of FL Sunshine Law. He also said it would have been helpful to have had a guided tour of the community before he started on the board. I think this kind of orientation would be beneficial for all new Board members before or immediately after their terms begins. Because board members may not communicate outside of meetings, I think you are the best person to do the orientation. I also want to make an effort to streamline our meetings to minimize their length. To accomplish this I will propose the board consider implementing the following changes in our meetings: That Board materials be available for pick-up in the PBSD office by 3:00pm and posted on the website by 5:00pm on the Fridays before board meetings. This facilitates either employed or retired board members having the weekend to review the materials. (When the meeting is early in the month, monthly financial reports may need to be distributed via email or at the meeting.) That only the approval of minutes of board meetings/workshops held in the previous month be on the agenda. That action items be placed at the top of the agenda after audience comments and include written materials explaining what action is being recommended and by whom. That the updates in the Administrator's report be provided in a brief written summary included in the Board materials received prior to the meeting. (At a recent meeting the oral only report took an hour.) I will talk about the above at Wednesday's meeting, but wanted to give you a heads-up.
