Sharrows are symbols that guide bicycles to the best place to ride on the road and remind drivers to share the road with cyclists. Sharrows do not designate a particular part of the road for the exclusive use of bicycles. They simply guide the bicycles to the safest place to ride. The sharrow lane markings will also alert motorists that bicycles may be encountered in the lane and to share the lane with them. By Florida State law, motorists must allow 3 feet between their vehicle and the bicycle they are passing. Drivers should pass cyclists by using the inside lane. Bicyclists should ride to the right over the sharrow lane markings to maximize their safety. Both motorists and cyclists must SHARE THE ROAD. The information that I sent in my March 27, 2013 email summarizes the PBID easements over the south and north portions of Lake 9. [Note: I referred to this as Lake 9, but I believe this should be Lake 6.] These two easements also cover the lake bank and pathway. I will forward you that email with the original attachments. The south easement (OR Book 1321) includes the statement that Grantor will be responsible for the cost of restoration of improvements "bike paths, landscaping, lighting fixtures, etc." within the easement. The north easement (OR Book 1519) includes a similar statement regarding improvements, but doesn't specifically state pathways. It seems that pathways would be one of the improvements. The Plat for Unit Thirteen (attached) shows additional information regarding the easements. The Plat lists the same OR Book and Pages as what we previously found. The Lake 6 parcel is within Tract C on the Plat. The Plat cover sheet, General Note 16 indicates that a portion of the P.B.I.D.D.E. on Lake 6 has been vacated in OR 1394 (see attached). All of the legal descriptions have no sketches attached, so it is difficult to know exactly which portion of the lake was vacated at that time. It appears that the Plat replaced whatever existed prior to the Plat, so Tract C would be the new lake tract. General Note 17 indicates that Westinghouse or its successors /assigns shall be responsible for maintenance of those portions of Tract C that are not maintained by PBID. Our findings are limited to searches on the Clerk of Courts website and review and cross reference of those documents. A title search may turn up additional documents. Grantor shall have the right to utilize the easement area with development of the property and the property adjacent to U easement, and for parking vehicles and construction and use of a parking lot. Grantor shall have the right to modifytreduce the easement area to accommodate development of the property while providing unobstructed access for PBID. Then PBID agrees to vacate the portion not being used. Grantor shall allow free and open access over said property, including labor, equipment and materials as deemed necessary by PBID for purposes of performing its water management function There is no mention in this Easement document of maintenance of the pathway, parking lot or other facilities. It appears that Grantor owns the facilities and therefore would maintain them. EASEMENT No. 320 - Lake 9 south en (Qakmont) Grantor - Westinghouse Grantee - PBID The Easement Provides to PBID - access and drainage, including the construction, placement, maintenance, repair, and replacement of drainage swales, lakes, embankments, structures, pipes, manholes, and related appurtenances. PBID agrees to maintain the water management and drainage facilities and not interfere with ingress and egress of Grantor. PBID shall use care in performing work. Grantor will be responsible for the cost of restoration of improvements (i.e. bike paths, landscaping, lighting fixtures, etc.) that have been or will be located within the easement. This Easement document specifically mentions Grantor being responsible for "cost of restoration" of improvements. PBID shall maintain the water management and drainage facilities. EASEMENT No. 360 - Lake 9 north end Oakmont) Grantor - Westinghouse Grantee - PBiD The Easement Provides to PBID - access and drainage, including the construction, placement, maintenance, repair, and replacement of drainage swales, lakes, embankments, structures, pipes, manholes, and related appurtenances. PBID agrees to maintain the water management and drainage facilities and not interfere with ingress and egress of Grantor. PBID shall use care in performing work. This Easement document specifically mentions Grantor being responsible for "repairs, replacement maintenance or restoration ", except for when required by PBID's activities. PBID shall maintain the water management and drainage facilities. Note: The above is my summary and interpretation of the language written in the easements You may want your legal counsel to do the same.
