THIS CAUSE came before the Code Enforcement Board upon the Petitioner's Motion for Imposition
Fines/Liens on June 30,2015,and the Code Enforcement Board,having heard argument respective to all
appropriate matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
1. On May 28,2015,Respondent was found guilty of violation of Collier County Land Development Code
04-41,as amended, Section 2.02.03 Specific Parking requirements for residential uses in mixed use urban
residential use,single family dwelling units. Collier County Land Development Code 04-41„as amended
Section 4.05.03(A) in the following particulars: automotive repair activity and vehicles parked on the
grass of improved residential zoned property,which violation(s)occurred on the property located at 5361
Holland St.,Naples,FL Folio No. 622560007 (Legal Description:NAPLES MANOR EXT,BLK 7,LOT
32)
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before June 3,2015, or a fine of$250.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5078,PG 3546).
3. Operational costs of$64.17 incurred by the County in the prosecution of this case were paid.
4. An Affidavit of Compliance was filed with the Board by the:Code Enforcement Official on June 29,2015,
which Affidavit certified under oath that the required corrective action has been taken as ordered.
5. The violation has been abated as of the date of the hearing.
6. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to
correct the violation;(c)whether there were previous violations committed by the violator;(d)the cost
upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)
the value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would
cause on the Respondent;(h)the time and cost incurred by the Code Enforcement to have the violation
corrected and(i)any other equitable factors which would make the requested mitigation appropriate.

thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 528,PG 147).
3. Operational costs of$66.27 incurred by the County in the prosecution of this case were paid.
4. An Affidavit of Compliance was filed with the Board by the Code Enforcement Official on June 5,2015,
which Affidavit certified under oath that the required corrective action has been taken as ordered.
5. The violation has been abated as of the date of the hearing.
6. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to

THIS CAUSE came on for public hearing before the Code Enforcement Board on June 30, 2015, and the
Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective to

FINDINGS OF FACT
1. Respondent, SOUTH NAPLES CENTER LLC is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is Ordered to
comply.
4. The real property located at 13255 Tamiami Trail E.,Naples,FL, Folio No. 726440009(Legal Description:
3 51 26 COMM E 1/4 CNR SEC, S612.57 FT ALG SEC LINE, THEN N 89 DEB W FOR 722.35 FT TO

ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162, Florida Statutes,and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,
Section 10.02.06(B)(1)(a).
B. Respondent must abate the violation by obtaining all required Collier County Building Permit(s)or
Demolition Permit, inspections and Certificate of Completion/Occupancy by September 28,2015 or a fine
of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$67.11 on
or before July 29,2015.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

THIS CAUSE came on for public hearing before the Code Enforcement Board on June 30, 2015, and the
Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective to
all appropriate matters,hereupon issues its Findings of Fact and Order of the Code Enforcement Board, as follows:
FINDINGS OF FACT
1. Respondent, 5681 DOGWOOD LLC is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is Ordered to
comply.
4. The real property located at 5681 Dogwood Way, Naples, FL, Folio No. 38341320000 (Legal Description:
GOLDEN GATE EST UNIT 33 E 75 FT OF W 180 FT OF TR 108)is in violation of Collier County Land
Development Code, Ordinances, Chapter 10 Road and Bridges, Article II. Construction in Public Right of
Ways, Division 1,Generally Section 110-30 in the following particulars:
Culvert pipe has failed and is rusted through.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162, Florida Statutes,and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code,Ordinances,Chapter 10
Road and Bridges,Article II. Construction in Public Right of Ways,Division 1, Generally Section 110-30.
B. Respondent must abate the violation by obtaining all required Collier County Right-of-Way permit(s)and
inspections through to issuance of a final approval to bring the Right-of-Way access to a permitted
condition by October 28,2015 or a fine of$150.00 per day will be imposed for each day the violation
remains thereafter.
Re-recorded to correct certification error
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$66.27 on
or before July 29,2015.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

before June 6, 2015, or a fine of$250.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5147,PG 3657-
3658).
3. On June 30,2015,Respondents filed a Request/Motion for Extension of Time to Comply.
4. Operational costs of 65.54 have been paid.
ORDER
Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter 162, Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:

and Building Regulations,Article VI,Property Maintenance Code, Section 22-231(1)and(2),compliance

B. Respondent must abate the violation by vacating the residence or obtaining all water/sewer connections
through an approved pipe distribution system connected to a potable water supply by July 1,2015 or a fine
of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.43 on
or before July 29,2015.
E. Respondents shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

July 23,2015 to determine whether the building and foundation is unsafe,as referenced in the letter from the
Building official to the owners dated January 9,2015.
C. Upon completion of the required inspections,the Respondent must abate the violation by obtaining all
required permits or demolition permits by August 22,2015 or a fine of$250.00 per day will be imposed for
each day the violation remains thereafter.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$67.95 on
or before July 27,2015.

2015 or a fine of$250.00 per day will be imposed for each day the violation remains thereafter;and
C. Continuing to completion/Certificate of Occupancy no later than December 26,2016 or a fine of$250.00 per
day will be imposed for each day the violation remains thereafter.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may

Code 04-41, as Amended, Section 3.05.01(B) and Collier County Code of Laws and Ordinances, Chapter
22,Article IV, Section 22-108, in the following particulars:
Removal of native and non-native vegetation by heavy machinery without the required county permit;
placement of lime-rock fill and mulch/chipped material on cleared site without required county permit or
authorization,excavation of existing ground material to a depth greater than 3 feet over a large portion of the
property,then replacement of the removed material with fill brought in from the outside without required
county permit.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondents are found guilty of violating Collier County Land Development Code 04-41,as Amended,
Section 3.05.01(B)and Collier County Code of Laws and Ordinances, Chapter 22,Article IV, Section 22-
108.
B. Respondent must abate the violation by meeting with the County by October 28,2015 and obtaining all
required permits or variances required to take corrective action by January 28,2016 or a fine of$100.00 per
day will be imposed for each day the violation remains thereafter.
C. If Respondents fail to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of$66.69
on or before July 27,2015.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

Collier County Code of Laws, Chapter 54 Environment, Article IV, Noise, Section 54-92-(F)(2) and (B)
maximum permissible sound and vibration levels by zoning clarification or use occupancy. (1)No sound
shall violate any sound standard provision of this article(table 1)violated in the following particulars:
Beach Tavern sound levels exceeding the allowable decibel limit for the time period readings were performed.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating of Collier County Code of Laws and Ordinances, Chapter 2,Article
IX,Commercial Amplified Music in residential use or zoning. Collier County Code of Laws, Chapter 54
Environment, Article IV,Noise, Section 54-92-(t)(2)and(B)maximum permissible sound and vibration
levels by zoning clarification or use occupancy. (1)No sound shall violate any sound standard provision of
this article(table 1).
B. Respondent must abate the violation by reducing the noise levels to acceptable levels no later than July 3,
2015 or a fine of$250.00 per day will be imposed for each day the violation remains thereafter.
C. Subsequent violations will cause the board to consider the Respondent as a repeat offender subject to
enhanced fines and a recommendation,from the Board,that all amplified sound be removed from the
premises and that the Collier County Zoning Department revoke any permits issued to allow entertainment
on the premises.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$70.89 on
or before July 29,2015.
F. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

ORDER

A. Respondents are found guilty of violating Collier County Land Development Code 04-41,AS AMENDED,
Section 10.02.06(B)(1)(A)and 10.02.06(B)(I)(e)(I).
B. Respondents must abate the violation by obtaining all required Collier County Building Permits,inspections
and Certificate of Completion/Occupancy by January 19,2016 or a fine of$200.00 per day will be imposed for
each day the violation remains thereafter.
C. If Respondents fail to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.

FINDINGS OF FACT
1. Respondent,JOANNE BAKER,ET AL..is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is ordered to
comply.
4. The real property located at 6905 Johns Road,Naples, FL, Folio#00435240008 (Legal Description: 23 50

R/W) is in violation of Collier County Land Development Code 04-41, AS AMENDED, Section

5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,AS AMENDED,
Section 10.02.06(B)(1)(A)and 10.02.06(B)(1)(E).
B. Respondent must abate the violation by obtaining all required Collier County Building Permits, inspections
and Certificate of Completion/Occupancy by January 19,2016 or a fine of$200.00 per day will be imposed for
each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$74.25 on
or before August 22,2015.
E. Respondents shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

COMES NOW, the undersigned, Joanne Baker, on behalf of herself as representative for Respondents and
enters into this Stipulation and Agreement with Collier County as to the resolution of Notices of Violation in
reference (case) number CESD20150009085 dated the 5th day of May, 2015.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for July 23rd, 2015 ; to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $74.25 incurred in the prosecution of this case within 30
days of this hearing.
2) Abate all violations by:
Obtaining all required Collier County Building Permit(s) or Demolition Permit, inspections, and
Certificate of Completion/Occupancy within 180 days of this Hearing or a fine of $200.00 per day will be
imposed until the violation is abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property

FINDINGS OF FACT
1. On June 27,2013, Respondent was found guilty of violation of Collier County Land Development Code
04-41, as amended, Section 10.02.06(B)(1)(A) in the following particulars: addition/alterations made to
structure without first obtaining a Collier County Building permit,which violation(s)occurred on the
property located at at 3315 Guilford Road,Naples,FL 34112,Folio#47871280009(Legal Description:
GUILFORD ACRES BLK A LOT 17 EXC N 230FT+LESS W 20FT).
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before December 24,2013,or a fine of$250.00 per day would be assessed for each day the violations
continue thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 4942,PG 3838).
On June 20,2014 an Extension of Time to comply was granted. (A copy of the Order is recorded at OR
5058,PG 2030).
3. Operational costs of$207.12 incurred by the County in the prosecution of this case have been paid.
4. The violation has been abated as of June 15,2015.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent's Motion to Abate Fines is granted and no accrued fines are imposed.
