HAZZARD, ESQ. SUBJECT: FLORIDA HARDSCAPES &PAVER MAINTENANCE, INC. AND MIKEL G. DIEHL THREE-MONTH CREDIT REVIEW DATE: JULY 13, 2015 MEETING: WEDNESDAY, JULY 15, 2015 AT 9:00 A.M. Coleman, Hazzard & Taylor, P.A. is pleased to represent Florida Hardscapes & Paver Maintenance, Inc. and its principal, Mikel G. Diehl. On Wednesday, July 15, the Board will consider a credit report which purports to reflect the financial condition of Florida Hardscapes & Paver Maintenance, Inc. A copy of the credit report can be found at Tab 1 of the enclosed binder. The credit report contains numerous inaccuracies, as detailed below. Most importantly, the credit report contains several negative items which in fact pertain to M & C Florida Pavers, Inc. (an inactive Naples, Florida corporation once led by Mr. Diehl's father), and which have nothing to do with Florida Hardscapes & Paver Maintenance, Inc. Understandably, confusion results from the name similarity between Mikel G. Diehl, who goes by his middle name Garrett, and his father, Mike Diehl. The credit report also contains items which pertain to entirely unrelated companies from other parts of the state. General History M & C Florida Pavers, Inc. was a Florida corporation with "Mike Diehl," the father, of 6300 Janes Lane, as its president. See Tab 2. Mikel G. Diehl, the son, was at one time the Vice President of M & C Florida Pavers, Inc. See Tab 3. However, he had left the M & C Florida Pavers, Inc. by the time of its final annual report. See Tab 4. M & C Florida Pavers, Inc. dissolved in 2011. Mikel G. Diehl of 4530 15th Ave SW is the current President and Registered Agent for Florida Hardscapes & Paver Maintenance, Inc. See Tab 5. At one time, he listed his address as 6300 Janes Lane, which is his father's address and is the same address that had been listed for M & C Florida Pavers, Inc. See Tab 6. However, that was corrected in a subsequent annual report. See Tab 7. Tax Liens The credit report, at page 4, lists three tax liens that purportedly exist against Florida Hardscapes & Paver Maintenance, Inc. A review of the public record reveals that all three tax liens are against the father's inactive company, M & C Florida Pavers, Inc., and have nothing to do with Florida Hardscapes & Paver Maintenance, Inc. See Tax Lien 4973192 at Tab 8, Tax Lien 4792762 at Tab 9, and Tax Lien 4615441 at Tab 10. Judgment The judgment listed at the bottom of page 4 of the credit report, in favor of Tricircle Pavers, Inc., is against M & C Florida Pavers, Inc., not Florida Hardscapes & Paver Maintenance, Inc. See Tab 11. The"Michael Diehl"referred to in the judgment is Mikel G. ("Garrett") Deihl's father. Branch Addresses Page 5 of the credit report lists four branch addresses for Florida Hardscapes & Paver Maintenance, Inc. Only the first—4530 15th Ave SW, Naples, FL—is correct. 6261 W. Atlantic Blvd., Ste. 207, Margate, FL was once the address of an unrelated entity named Florida Pavers, Inc., which dissolved in 1997. See Tab 12. That address is now the site of a medical office plaza. See Tab 13. As discussed in the "General History" section above, 6300 Janes Lane was the address of the father's company, M & C Florida Pavers, Inc., and was previously listed as the address of Florida Hardscapes & Paver Maintenance, Inc. See Tab 2, Tab 6, and Tab 7. 6300 Janes Lane is not a current branch location of Florida Hardscapes & Paver Maintenance, Inc. 6421 Egret Terrace, Coconut Creek, FL is a single-family home owned by Jose Carlos Dos Santos. See Tab 14. This address was evidently included because Mr. Dos Santos is an officer of an unrelated entity called M & C Pavers, Inc., which bears a similar name to Mr. Diehl's father's inactive corporation, M & C Florida Pavers, Inc. See Tab 15. There is no business affiliation between M & C Pavers, Inc. and Florida Hardscapes &Paver Maintenance, Inc. Conclusion The negative information contained in the credit report does not pertain to Florida Hardscapes & Paver Maintenance, Inc. In light of the above information, I respectfully request that the Board disregard the credit report and approve Mikel G.
