Summary TheCCAAhasnotprovidedpropermanagementoversightforoperationsandleasesattheImmokaleeRegional Airport.Instancesofnon-compliancehavebeendetectedfortheareasreviewed. Thefollowingobservationsweregeneratedduringthisreview: 1.Itdoesnotappearrecreationalvehiclesandgocarttrackoperationsand/orrelatedstructures(i.e.pitarea)area permitteduseintheAirportOperationsTractandoperationshavenotreceivedFAAapproval. 2.Airportoperationshavelackedoversight. a.Thereisnoleaseforthegocarttrack/operations. b.Theleasefordragstripoperationsdoesnotincludeallactivitiesbeingconductedbythetenant. c.Dragstripoperationsarebeingconductedinareasoutsideoftheoperationarea. d.Itdoesnotappearthereisinsuranceinplaceforgocarttrackoperations. e.Existinginsurancemaynotbesufficienttocoveroperations. f.TheCountyhaslostrevenue. g.Accesstoairsidelandhasnotbeenlimitedtoauthorizedindividuals/activities. h.Structuresfordragstripand/orgocarttrackoperationshavenotobtainedproperpermitsorproper approval. 3.TheCCAAhasnotcompliedwiththeFAArequirementstoobtain“noobjection”fordragstripoperations. a.TheFAAdidnotprovideadvanceapprovalofnon-aeronauticaluseoftheclosed4/22runwayasadrag strip. 4.Thereisnoagreementinplaceidentifyingresponsibilitiesforthebathhouselocatedatthedragstrip. a.Thebathhouseisoutsideofthedragstripoperationarea,butisusedfordragstripoperations. 5.Relocationofthebathhousedidnotobtaingrantorapprovalorproperpermits. FailuretocomplywithFAAassurancesand/orgrantorrequirementsmay:resultinfindings,jeopardizecurrentand futurefunding,resultindisbarmentfromreceivingfederalfunding,requirerepaymentofpriorreceivedfunds, resultinterminationofthecurrentfunding,impactfuturefunding,resultinliabilityfordamagesfor misrepresentation,and/orcausesafetyconcerns. 4 Objective Theobjectivesofthereviewwereto:1)determinewhethergrantfundswereinvolvedforthedragstrip,alsoknown astheracetrack;2)whethergrantfundswereproperlyused(ifapplicabletothedragstrip);and3)determine whetherthedragstripandgocarttrackwereincompliancewithFederalAviationAdministration(FAA) regulations,assurances,andrequirements. ScopeLimitation ThescopeofthereviewdidnotincludeanalysisoftheImmokaleeRegionalRacewaymonthlypaymentsand supportingdocumentationforleasepaymentcompliance.Thereviewofleaserevenuecomplianceisunderwaywith GrowthManagementDivisionandClerk’sFinance. 5 Background OnApril23,1999,theCCAAenteredintoalicenseagreementwithRTHEnterprises,Inc.d/b/aImmokalee RegionalRacewayforthesolepurposeofoperatingan“IHRASanctionedDragRacingStrip”notingdragracingis aninherentlyriskyactivityandimposingadditionalsafetyrequirements.TheagreementindicatedtheImmokalee RegionalRacewayhadconstructedavehicleaccessroadfromAirparkBoulevardtotheoperationalarea.The agreementwaseffectiveApril1,1999throughMarch31,2002.TheagreementrequiredtheImmokaleeRegional Racewaytopaythefollowingfees:$150.00monthlyoccupancyfee,$1,000.00feeeachweekofanactivityfor commercialactivitiesfee,50%ofgrossrevenuesderivedfromadvertisingconcessionsfortheadvertisingfee, $5,000.00depositwheretheCCAAretainsinterestearnedonthedeposit.BeginningMay1,2009,theImmokalee RegionalRacewaywasrequiredtopay$2,000.00permonthataminimumfor$1,000.00feeeachweekofactivity. Theagreementindicatednopermanentimprovementswillbepermitted. InAugustof2000,theCCAAenteredintograntagreementstocompleteconstructionandimprovementstoenhance theImmokaleeRegionalAirportIndustrialParkincludingthefollowingspecificprojects:extensionofAirpark Boulevard,IndustrialParksiteimprovements,AutomotiveSportsComplexsupportinfrastructureandpermit, sketchesandschematics,feasibilityanalysis,ERPpermit,restrooms,spectatorparking,campground,andproject masterplan. OnNovember19,2001,CCAAResolution01-35,theCCAAapprovedextendingthelease,settoexpireon March31,2002,foranadditionalfiveyears.Airportstaffweredirectedtonegotiatetheleasetermsandbringthe leasebacktothenextCCAABoardMeeting. OnMarch11,2002,theCCAAenteredintotheFirstAmendmenttoLicensingAgreementwithRTHEnterprises, Inc.,aFloridaCorporationd/b/aImmokaleeRegionalRacewaytoextendtheinitialleaseexpiringon March31,2002.TheFirstAmendmentextendedtheleaseperiod,effectiveApril1,2002throughMarch31,2007. TheFirstAmendmentincorporateda30daycancellationclausewithoutliabilitytoeitherpartyintheeventof cancellation,thetenanttopay$200.00yearlyforaCommercialOperatingPrivilegeFee,thetenanttopay $2,750.00monthlyplusapplicableFloridataxes,thetenanttopay50%ofgrossrevenuesderivedfromadvertising concessionsplusapplicableFloridataxes,andrequiringa$5,000.00depositwiththeCCAAretaininganyinterest earnedonthedeposit.Aspartofthelease,thetenantagreedtoconstructatemporarylimerockroadattheentrance tothedragracingsite. OnMay13,2002,thethenExecutiveAirportDirector(ReferenceExhibitG foratimelineofmanagement) indicatedthebathroombeingconstructedforthedragstriphadpermittingproblemswiththeCountybecausethe Countydidnotwanttoissueapermittocompleteconstructionofapermanentbathroomwhenthedragstripwas allowedunderatemporaryusepermit.TheHealthDepartmentindicatedapermanentbathroomwouldneed constructedforthecampgroundinordertoobtainanoperatingcertificate.TheCCAAapprovedremovingthe restroomsfromthedragstripandconstructingthebathhouseatthecampground. OnSeptember9,2002,theCCAAacceptedtheConceptualMasterPlanforMotorSportsPark.Accordingto CCAAminutes,theCCAAdeterminationtocontinueforwardwiththeMotorSportsParkprojecthadnotbeen decidedandwastobediscussedwithcitizensthroughpublicmeetings. OnFebruary10,2003,theCCAAdirectedstafftopresentadditionalexpenditureoptionsfortheMotorSportsPark Complexforthepublicworkshoptodiscusstheproject.Itdoesnotappearapublicworkshopoccurredorthat differentexpendituresoptionswerepresentedtotheCCAAbyAirportstaff. OnNovember13,2006,theExecutiveAirportDirectorprovidedanupdatetotheCCAA.TheExecutiveAirport Directorindicatedthebathhouseatthecampgroundwouldneedrelocatedinordertoproceedwithdevelopmentof theairport.TheownerofImmokaleeRegionalRacewayexpressedinterestinrelocatingthebathhousetothedrag striparea.TheExecutiveDirectorindicatedaletterwouldbeprovidedtotheownerwithpermissiontorelocatethe bathhouseconditionedontheownerobtainingallthenecessarypermits. 6 OnDecember11,2006,theImmokaleeRegionalAirportManager,providedtheowneroftheImmokaleeRegional Racewayaletterapprovingtherelocationofthebathhousetothedragstrip.Theletterindicatedthebathhouse “…mustbedestroyed…”andrelocationofthebathhousewouldbeallowedattheImmokaleeRegionalRaceway’s expense.Theletterindicates“…AsperourdiscussioninNovember2006,itwasagreedthatallexpensesassociated withthebathhouserelocation,aswellasobtainingallnecessarypermits…becomesyoursoleresponsibilitypriorto thefacilitybeingrelocated.”Thebathhousewasrelocatedtothedragstrip(outsidetheoperationarea). OnApril15,2009,theFAAacceptedtheImmokaleeRegionalAirportMasterPlanandconditionallyapprovedthe AirportLayoutPlan(ALP).Theapprovalwassubjecttotheairportobtainingtheenvironmentalapprovalsneeded. Theapprovaldidnotprovideassuranceoffederalfundsfortheprojectsandadditionalapprovalwasneededpriorto construction. OnJuly13,2009,theExecutiveAirportDirectorloweredtheImmokaleeRegionalRaceway’sleasepaymentfrom $2,750.00to$1,188.28withoutCCAAapprovalorFAAapproval. OnDecember7,2010,theFAAcontactedtheAirportExecutiveDirectorregardingairportairsidelandusagefora dragstrip.TheFAAindicatedtheywereunawareofprovidingapprovalforthenon-aeronauticaluseofthelandasa dragstrip.TheFAAindicatedlandwouldneedFAAapprovalfornon-aeronauticaluseonairsidelandtobeleased atfairmarketvalue,theleaseapprovedbytheFAA,andtheAirportLayoutPlan(ALP)updatedtoreflectthe propertyusage.OnDecember9,2010,theExecutiveAirportDirectoracknowledgedtheFAAconcernand indicatedaresponsewouldbeprovidedwithin30days. OnJanuary12,2011,theExecutiveAirportDirectorprovidedalettertotheFAAformallyrequestingpermissionto useclosedRunway4/22fornon-aeronauticaluseasadragstrip.Theletterrecommendedincreasingthebasicrent from$1,188.28to$2,500.00permonth. OnFebruary22,2011,theFAAcommunicatedtotheCCAA,“Wedonotobjecttothecontinueduseofthisairport propertyfordragstrip,providedthefollowing: Anythingverticalorhorizontalthatwasconstructedforthisoperationmustbesubmittedtothisofficefor airspaceapprovalasanALPchange. Theoperationmustnotconstituteahazardtoairnavigationorinterferewiththeoperationoftheairportin anyway. Thecompensationoutlined…istreatedasairportrevenueanddepositedintotheairportfund. Thetermsoftheagreementareonamonth-to-monthinterimbasis,andthepropertywillreverttoan aeronauticaluserifrequiredtomeetaeronauticaldemand. TheuseagreementwillnotbeamendedorrenewedinthefuturewithoutFAAconcurrence.” OnMarch22,2011,theCCAAenteredintotheSecondAmendmenttoLicensingAgreementwithRTHEnterprises, Inc.aFloridaCorporationd/b/aImmokaleeRegionalRacewaytoamendtheLicenseAgreementandcontinuethe agreementonamonth-to-monthbasis.TheSecondAmendmentrevisedthefeestructureasfollows:thetenantto pay$200.00yearlyforaCommercialOperatingPrivilegeFee,thetenanttopay$2,500.00monthly,thetenantto pay50%ofgrossrevenuesderivedfromadvertisingconcessionsplusapplicableFloridataxes,andrequiringa $5,000.00depositwiththeCCAAretaininganyinterestearnedonthedeposit. BasedonCollierCountyPropertyAppraiseraerialimagesoftheImmokaleeRegionalAirportclosedRunway4/22 in2013,itappearsadragstripandgocarttrackhavebeenconstructedontherunwayandthebathhousefromthe campgroundwasmovedtothedragstriparea(ReferenceExhibitB ).Thedragstripandanaccessroadwere constructedpriorto1999.ThedragstripwasputintooperationbytheImmokaleeRegionalRacewayin1999 . Therewerenosignificantchangestothedragstripbetween2002and2003.In2004,astructurewasbuilt;seating andcontainerswereaddedatthedragstrip.In2005,itappearsstructureswereexpandedandadditionalcontainers wereaddedatthedragstrip.In2006,additionalcontainerswereaddedoutsideoftheleaseoperationareaand additionalseatingwasaddedatthedragstrip.Thegocarttrackappearstohavebeenconstructedattheendofthe runwayoutsideoftheleaseoperationareain2006.In2007,thebathhousewasremovedfromthecampground (ReferencesAuditReport2014-3 )andwasrelocatedtothedragstriparea.Itappearsapitareawasbeing constructedatthegocarttrack.In2008,itappearsthepitareawasfinishedincludingacoveredstructure.In2009, 7 therewerenosignificantchangestothegocarttrack.In2010,thegocarttrackwasmodifiedtoaddadditional pathsintheareaontopoftherunway.In2011through2012,therewerenosignificantchangestothegocarttrack. In2008through2012,containerswererelocated,butstayedonpremise;otherwise,nosignificantchangesatthe dragstrip.In2013,itappearsadditionalseatingwasadded;otherwise,nosignificantchangesatthedragstrip. 8 Observations 1)Itdoesnotappearrecreationalvehiclesandgocarttrackoperationsand/orrelated structures(i.e.pitarea)areapermitteduseintheAirportOperationsTractandoperations havenotreceivedFAAapproval. BCCOrdinance2010-07fortheImmokaleeRegionalAirport–AirportOperationsPlannedUnitDevelopment (PUD)ExhibitCseparatestheareasaroundclosedRunway4/22intotwosectionsincludingtheAirportOperations TracttothewestoftheclosedrunwayandtheIndustrialDevelopmentTracttotheeastoftheclosedrunway.The gocarttrackhasaportionofthegocartoperationsineachtract. PUDSectionIA1dfortheAirportOperationsTract-PermittedUses–PrincipalUsesindicates“Vehicleracing, limitedtotheexisting1/8miletracklengthandassociatedracetrackactivitiesandoperations(Group7948)…”and SectionIA2B1AccessoryUses–ConditionalUsesindicates“Vehicleracing,includingassociatedracetrack activitiesandoperations(Group7948).” TheUnitedStatesDepartmentofLaborOccupationalSafetyandHealthAdministrationStandardIndustrial Classifications(SIC)Group7948Racingincludingtrackoperationincludesracetrackoperations.Group7999 AmusementandRecreationServicesincludesgocartracewayoperations.Itdoesnotappeargocarttrackoperations areincludedinSICGroup7948.ItdoesnotappeargocarttrackoperationsareanalloweduseintheAirport OperationsTract. PUDSectionIIA1lfortheIndustrialDevelopmentTract–PermittedUses–PrincipalUsesindicates“Services (Groups…7948…7999).”ItappearsthegocarttrackintheIndustrialDevelopmentTractisanallowedlanduse. OnJanuary22,2014,theImmokaleeRegionalRacewayownerindicatedcustomersforthedragstripoperations frequentlystayedattheImmokaleeRegionalAirportovernightinself-containedmotorhomes(i.e.recreational vehicles).Theareawherethevisitorsparkthemotorhomesisoutsidetheleaseoperationareaforthedragstrip. TheSICGroup7948doesnotincludethistypeofactivity.PUDSectionIA2kfortheAirportOperationTractand PUDSectionIIA2k–AccessoryUses–indicates“Recreationalvehiclecampgroundandancillarysupportfacilities wheninconjunctionwithvehicleracing…Recreationalvehicles,tents,andotherstructuresandfacilitiesallowedin thecampground…”Itdoesnotappearovernightguestsand/ormotorhomesareallowedoutsideofthecampground. TheFAAdoesnotappeartohaveapprovedthenon-aeronauticaluseforrecreationalvehiclesand/orgocarttrack/ operationsorthestructuresconstructed/addedtothearea(i.e.pitarea,constructionofthegocarttrack,etc.). Whennon-aeronauticalactivitiesareconductedonairsideland,theoperationsmustobtainFAAapprovalpriorto commencingoperations. Itdoesnotappearrecreationalvehiclesandgocarttrackoperationsand/orrelatedstructures(i.e.pitarea)area permitteduseintheAirportOperationsTract. Recommendations: IftheCountydeterminesgocartoperationswillbeallowed,theCountyshouldobtainacomparableuse determinationletterfortheportionofthegocarttrackintheAirportOperationsTract. ThePUDmayneedamendedtoincluderecreationalvehiclesandgocarttrackoperations(Group7999)asan alloweduseattheImmokaleeRegionalAirportintheAirportOperationsTract. OperationsnotpermittedbythePUDshouldnotbeconductedattheImmokaleeRegionalAirport. TheImmokaleeRegionalAirportMasterPlanandAirportLayoutPlanshouldbeupdatedtoincludeauthorized usesofland. FAAapprovalshouldbeobtainedfortherecreationalvehicleactivitiesandgocarttrack/operationsasanon- aeronauticaluseofairsideland,iftheCountyallowsoperations. 9 CountyManagementResponse : “Thecounty,inconjunctionwithguidancefromtheBoardofCountyCommissioners,iscurrentlyreviewingall aspectsoftheracewayandgo-cartoperationsasallowableactivities. Thisreviewshallinclude,butisnotlimitedto,zoning,permitting,leaseandgrantorcomplianceissues.Staffwill reviewthelanduselimitationsandworkwiththetenanttofacilitatetheproperapplication. Thego-cartingoperationshavebeenceasedatthistime,pertherequestoftheGrowthManagementDivision administration.TheCodeEnforcementDepartmenthasbeencontactedandisworkingwiththetenanttoachieve compliance,asperBCCdirectiononFebruary11,2014. CountystaffwillensurecompliancewithFAArequirementsfortheImmokaleeRegionalAirportMasterPlanand AirportLayoutPlan. ThecountywillworkwiththeFAAtoobtainapprovalforanyactivities/operations/structures/usesoflandfor anythingnotcurrentlyapprovedinwritingbythatagency.” InternalAuditResponsetoCountyManagementResponse: OnFebruary18,2014,WestCoastCartingupdatedtheirwebsiteandpostednoticesforthenextracetobeheldat theImmokaleegocarttrackonMarch2,2014.Additionally,thewebsiteindicatesdrivinglessonsandtrackrentals arecurrentlyavailable.ThewebsitedoesnotindicatetheracescheduledforFebruary16,2014wascancelled and/orthatoperationshavebeenhalted;however,CountyManagementverifiedtheactivitydidnotoccur.The countyshouldcontinuetomonitoroperationsuntiltheinsurance,leaseagreement,andFAAorotheragency requirementsissuesareresolved. 2)Airportoperationshavelackedoversight. Airportoperationsdonotappeartohavebeenproperlyoverseenbymanagement.Itappearsthereareoperations thatarenotpermittedbythePUD,individualshavebeenoperatingprivatebusinessonCCAApropertywithouta leaseorinsurance,renthasnotbeenreceivedfromtheuseoftheland,landimprovements/structureshavebeen constructedwithoutpermitsandproperapproval,andaccesshasnotbeenlimitedtoauthorizedindividuals/lessors. TheCountyhasnotproperlymanagedgocartoperationsconductedattheImmokaleeRegionalAirport.Asaresult, thereisnoleasewiththetenantandnoinsuranceontheactivity.TheImmokaleeRegionalRacewayhasallowed visitorstostayovernightinself-containedmotorhomes(i.e.recreationalvehicles)inareasoutsideoftheirlease operationarea.TheImmokaleeRegionalRacewaysellsfoodandbeveragesfromaconcessionsvehicleandsells merchandise(i.e.t-shirts)forevents,whichdoesnotappeartobeincludedasoperationswithinthelease.The ImmokaleeRegionalRacewaymaynothavesufficientinsurancecoverageforallactivitiesassociatedwiththedrag strip(raceway).ThismayexposetheCountytopossibleliabilityandloss. OnJanuary12,2011,theExecutiveAirportDirectorprovidedalettertotheFAAformallyrequestingpermissionto useclosedRunway4/22fornon-aeronauticaluseasadragstrip.Airportmanagementfailedtoincludegocarttrack operationsandmotorhomesintherequestforpermissionlettersenttotheFAA. TheCountyhaslostrevenuesonthepropertybeingusedbyindividualswithoutaleaseinplaceandbynot collectingmonthlypaymentsforuseoftheland.ThishasexposedtheCountytolostrevenuesandincreasedrisk. InApril1999,theCCAAenteredintoanagreementtoallowImmokaleeRegionalRacewaytousetheclosed4/22 runwayasadragstrip.TheCCAAdidnotproperlynotifyandrequestpermissionfromtheFAAofthenon- aeronauticaluseonairsidelandviolatingtheFAAassurances. 11 OnDecember7,2010,theFAAcontactedtheAirportExecutiveDirectorregardingairportairsidelandusagefora dragstrip.TheFAAindicatedtheywereunawareofprovidingapprovalforthenon-aeronauticaluseofthelandasa dragstrip.TheFAAindicatedlandwouldneedFAAapprovalfornon-aeronauticaluseonairsideland,tobeleased atfairmarketvalue,theleaseapprovedbytheFAA,andtheAirportLayoutPlan(ALP)updatedtoreflectthe propertyusage.OnDecember9,2010,theExecutiveAirportDirector,acknowledgedtheFAAconcernand indicatedaresponsewouldbeprovidedwithin30days. OnFebruary22,2011,theFAAcommunicatedtotheCCAA,“Wedonotobjecttothecontinueduseofthisairport propertyfordragstrip,providedthefollowing: Anythingverticalorhorizontalthatwasconstructedforthisoperationmustbesubmittedtothisofficefor airspaceapprovalasanALPchange. Theoperationmustnotconstituteahazardtoairnavigationorinterferewiththeoperationoftheairportin anyway. Thecompensationoutlined…istreatedasairportrevenueanddepositedintotheairportfund. Thetermsoftheagreementareonamonth-to-monthinterimbasis,andthepropertywillreverttoan aeronauticaluserifrequiredtomeetaeronauticaldemand. TheuseagreementwillnotbeamendedorrenewedinthefuturewithoutFAAconcurrence.” ItdoesnotappeartheALPhasbeenupdatedtoincludetheconstructedstructures(i.e.bathhouse,twostory building,etc.)usedfordragstripoperations. OnJanuary12,2011,theExecutiveAirportDirectorsubmittedalettertotheFAAdetailingthetermsoftheSecond AmendmenttotheLicenseAgreementwiththeImmokaleeRegionalRacewayandformallyrequestingpermission touseclosedRunway4/22fornon-aeronauticaluseasadragstrip.TheletterindicatedtheownerofImmokalee RegionalRaceway“…doesnothaveapermanentbuildingstructure;therefore,hewouldbegivensixty(60)daysto removeallequipmentandmaterialsfromthelocation…”Structureswereevidencedin2006.Indicatingtherewere nopermanentstructuresappearsamisrepresentationofconstructionactivities.TheSecondAmendmenttothe LicenseAgreementindicates“…Tenantwillbegivensix(6)monthstovacatethepremisesandremoveallofits improvementsandfixtures…” WhentheFAAdoesnotprovideadvanceapprovalfornon-aeronauticallanduses,theCCAAviolatesFAA assurances.IftheCCAAviolatesFAAassurances/requirementsfor“noobjection”,theFAAmaydeemthe operationsinviolationoftheirrequirements.Whenassurances/requirementsarebreachedorthereareviolations, theFAAmay,atitsoption:discontinueanyFAAfundingorrequirerepaymentofpreviouslyreceivedfunds. Whenthebathhousewasrelocatedtothedragstrip,itdoesnotappeartheImmokaleeRegionalRacewayagreement wasamendedtoincludetheuseoftheCountyasset.Thelocationofthebathhouseisoutsideofthedragstrip operationarea(1,500feetby250feet–ReferenceExhibitA )anddoesnotappeartobeinsuredbythelessee.When assetsareusedbytenants,theassetallowedusageshouldbeincorporatedintoaleasetoensureclearresponsibilities ofeachparty,toidentifythepropertybeingusedbythelessee,andprovideinsuranceonthepropertyinuse. PriortotheCountyallowingoperations/useofCountyassets,leasesshouldbeinplacetolimittheCounty’s liabilityandrisk.Whenlandusageisallowedwithoutapropertylease,theCountyisexposedtoliabilityand potentiallawsuits. Recommendations: TheImmokaleeRegionalRacewayagreementshouldbeamendedtoincludetheresponsibilitiesofeachparty fortheusageofthebathhouseandtoincludethelandbeingusedbythelessee. StructuresusedbytheImmokaleeRegionalRacewayshouldbeincorporatedintotheiragreement. ThebathhousewasconstructedaspartofanIndustrialParkInfrastructureImprovementsproject(ReferenceAudit Report2014-3 ).TheprojectwasfundedbyanEconomicDevelopmentAdministration(EDA)grantfromtheU.S. DepartmentofCommerce,aFloridaDepartmentofTransportation(FDOT)grant,andaCountymatch(providedby theBCC).TheconstructionofthebathhousewaspaidforwiththeCountymatch.Thetotalcostofthebathhouse was$94,285.13includingelectricpaidforwithEDAgrantfunds. OnNovember13,2006,theExecutiveAirportDirectorprovidedanupdatetotheCCAA.TheExecutiveAirport Directorindicatedthebathhouseatthecampgroundwouldneedrelocatedinordertoproceedwithdevelopmentof theairport.TheownerofImmokaleeRegionalRacewayexpressedinterestinrelocatingthebathhousetothedrag striparea.TheExecutiveDirectorindicatedaletterwouldbeprovidedtotheownerwithpermissiontorelocatethe 13 bathhouseconditionedontheownerobtainingallthenecessarypermits.ItdoesnotappeartheCCAAformally approvedtherelocation.ItdoesnotappeartheCCAAobtainedapprovalfromthegrantoragenciesforthe relocationofthebathhouse. OnDecember11,2006,thepriorImmokaleeRegionalAirportManager,providedtheowneroftheImmokalee RegionalRacewayaletterapprovingtherelocationofthebathhousetothedragstrip.Theletterindicatedthe bathhouse“…mustbedestroyed…”andrelocationofthebathhousewouldbeallowedattheImmokaleeRegional Raceway’sexpense.Theletterindicates“…AsperourdiscussioninNovember2006,itwasagreedthatall expensesassociatedwiththebathhouserelocation,aswellasobtainingallnecessarypermits…becomesyoursole responsibilitypriortothefacilitybeingrelocated.”Properpermitswerenotobtainedfortherelocationofthe bathhouse. Whenassetsareobtainedthroughgrantprojects,appropriateauthorityshouldbeobtainedpriortorelocatingassets ormodifyingtheuseoftheassets.Failuretocomplywithgrantorrequirementsmayresultin:auditfindings, jeopardizecurrentandfuturegrantfunding,requirerepaymentofgrantfunds,and/orresultinliabilityforthe County. FailuretocomplywithFAAassurancesand/orgrantorrequirementsmay:resultinfindings,jeopardizecurrentand futurefunding,resultindisbarmentfromreceivingfederalfunding,requirerepaymentofpriorreceivedfunds, resultinterminationofthecurrentfunding,impactfuturefunding,resultinliabilityfordamagesfor misrepresentation,and/orcausesafetyconcerns.
