Collier County Planning Commission Mark Strain, Chairman June 12,2015 No.231121346 _ — --- June 23, 2015 Mark Strain Collier County Government Dear Mr Strain: The purpose of this letter is to state our opposition to the amended proposal from Standard-Pacific to construct 27 new boat docks on the south side of Haldeman Creek. There are a number of reasons. First and most importantly is that the creek simply isn't wide enough or deep enough to accommodate that level of intrusion into the main channel. The creek is so shallow that it required a massive dredging project about six or seven years ago. The end product of that dredging accomplished a minimum depth of only four feet at mean tide but only for the center 15 to 20 feet of the waterway. Anytime opposing boat traffic forces another boat to steer toward the bank,that boat is in jeopardy of having to clear areas that are too shallow to pass. This forces boats to pass each other way too closely. This will be exacerbated if petitioner is allowed to build docks as close to the south-bound channel east of their property as they have requested. It will create a huge blind spot on that corner. Secondly, the addition of more than 27 slips will invariably create additional noise throughout the days and evenings that are frequently above acceptable levels already. Partying boaters seldom have a full appreciation for how easily noise travels on water. Also, the property owner on the north side of the proposed development has six docks already approved. We believe that the approval of those docks demonstrates that information supplied by petitioner and its engineering firm regarding their"ownership of underwater lands" is incorrect. We do not believe they own any underwater property. Verification of that would require a different application for different variances since property lines are involved. The same engineering firm was used for both petitions. Both of them cannot be correct. At a mean tide, we measure about 140 feet from bank to bank. If one developer is allowed a 32-foot extension totaling 52 feet(20 plus 32) and the other docks are built to 42 feet, the total intrusion into what will become a massive bottle neck would be 94 of just 140 total feet. This is not adequate for a busy waterway that feeds so many homes and businesses upstream. Bear in mind that this creek is not merely a residential waterway serving just small boats from private homes. My wife and I are in a unique location to view the daily use of the creek. It serves at least two full- sized, full-service marinas that daily put very large cruisers and barges in the traffic flow. Just one of these barges or large cruisers can consume the entire width of the center dredge done some six years ago. Allowing perpendicular dockage will create a dangerous bottleneck just west of the confluence of all traffic from: 1. Three60 Market (traffic has increased since they've opened) and Naples Marina, and 2. The canals south of Haldeman Creek including traffic from Gulf Shore Marina and residents by the pond that abuts petitioner's property, and 3. Residents from east of Bayshore Drive including Walker Marina, and the side canals adjacent to Becca Avenue. As it is, the boat works down the canal from us has daily traffic including huge cabin cruisers in excess of 40 or 50 feet in length. My understanding is that these boats have to wait for a higher tide to get to their destination even after the dredging of several years ago. Yet another reason is that docks in this location have the potential of creating an enormous drainage problem for runoff waters created by regular rains storms and, more dangerously, a named storm. The addition of so many pilings on the main creek has the potential of creating an actual dam of debris from areas upstream as far away as the weir by the Wal-Mart Store. This could precipitate enormous flooding problems between Haldeman Creek and Rt. 41. And since the property is clearly part of the Windstar development, it seems that developers have alternative options to construct docks out closer to Naples Bay where Windstar currently has eight docks (two to four of which have been empty for several years.) And finally, I continue to have concerns about two operational elements of the petition. 1. Including only those within 500 feet of the proposed project excludes many other homeowners and businesses that will definitely be affected by the final decision on the project. 2. Timing these hearings in the summer so that many of us cannot easily attend might give commissioners the impression that we do not object. We appreciate the need for Naples to grow and the efforts that commissioners take to carefully analyze specific growths proposals. We do not believe this is one that should be approved. In summary, FDOT is saying that they have found no indication of having direct authority relating to regulating activities within Haldeman Creek.FDOT has reviewed the proposed dock plans with associated dredging along with the existing approved environmental permits and found that the hydraulic function of the waterway will be maintained. (2) Obstruction of Waterway During Extreme Storm Events a. As you are well aware,the extreme storm event that the Federal,State and Local Governments use as a benchmark to establish base flood elevations throughout the country is the 100-yr, 3-day storm event. The flood elevation established in the 2012 FEMA flood map revision for the Haldeman's Landings project site and adjacent portion of Haldeman Creek is Zone AE, Elevation 9.3' NGVD (8.0' NAVD); Firmette attached. Reference to the NGVD elevation datum is used here,as the original plans for the drainage channel were all designed in NGVD and all of the existing permits for the Haldeman Creek project reference NGVD. For the proposed HL docks,the top of dock elevation is approximately 4.0' NGVD and the top of piling elevation is approximately 10.4' NGVD.Therefore,during the 100-yr,3-day storm the top of dock will be approximately 5'underwater and the top of pilings will be protruding from the surface of the water about 1'.Clearly,the top of dock will not cause any obstruction to the flow-way 2 and the 1' protrusion of the top of pilings will not be a significant enough protrusion to take hold of any floating debris. b. Additionally,the flow-way at the location where the proposed Sanctuary docks(potential future development)are located across the creek from the Hl_docks is just over 83'wide of open waterway. There is no cogent,feasible reason to deduce that 1'high protrusions from pilings 83'apart will cause obstruction to the flow-way. c. During the 100-yr,3-day storm event with the floodwaters at elevation 9.3'NGVD and the designed top of bank (existing natural grade at the time)for the designed channel within the drainage easement was at about elevation 1.0'+/-NGVD. Therefore,the banks of the channel flow-way will be overflown by far, even when considering present day bank elevations.Additionally, most of the older homes in the surrounding community will be under feet of water during the 100-yr,3-day storm event in the present day situation. For instance,the crown of road along Lakeview Drive is at approximate elevation 5.4' NGVD and most of the older homes are not far above crown of road. Please review the above and attached. Based on my review of the proposed work along with the knowledge of the existing approved environmental permits, it appears that hydraulic function of the terway will be maintained for this portion of the waterway. The hydraulic impacts need to be modeled using,at a minimum,a 2-D tidal model to ensure the flows within the waterway are not impacted by the new docks and boat launches. The bigger concern will be associated with sediment transport within the waterway and where the material will be prone to either accumulation or erosion new due to the shoreline modifications.
