Resolution 1986-001 , • 0 January 7, 1986 • RESOLUTION NO. - 86-1 aooK 091 PACE 554 A RESOLUTION REQUESTING THE DEPARTMENT OF NATURAL RESOURCES, DIVISION OF MARINE RESOURCES, STATE OF FLORIDA, TO ESTABLISH CERTAIN AREAS WITHIN THE NAVIGABLE WATERWAYS OF COLLIER COUNTY, FLORIDA AS RESTRICTED ZONES FOR THE PURPOSE OF REGULATING BOAT SPEEDS AND WAKES IN SUCH AREAS WHEREAS, the Board of County Commissioners of Collier County, Florida, has passed Ordinance 79-8, the Collier County Vessel Control ' Ordinance, for the purpose of promoting safety in the operation of vessels on waterways within Collier County, and to prevent injuries and property damages caused by the negligent operation of such vessels; and • 1 WHEREAS, said ordinance provides that the Board of County • Commissioners may, by Resolution, adopt at a public hearing upon at • • least fifteen (15) days notice of such hearing published in a newspaper of general circulation in Collier County, Florida, designated areas as "No Wake - Idle Speed Only" areas; and WHEREAS, in an effort to reduce boat and property damage resulting from excessive boat wakes, it is deemed advisable that certain navigable waterways and heavily traveled channels be designated as restricted areas for the purpose of placing such regulatory markers therein; and WHEREAS, the required advertisement has been accomplished; and WHEREAS, Chapter 327.46 F.S. requires that after designation of said areas by the governing body of the County, application be made to the Department of Natural Resources for the establishment of said • restricted areas; and WHEREAS, upon the establishment of the restricted areas by the Division of Marine Resources of the Department of Natural Resources, the Board of County Commissioners of Collier County will accept responsibility for placement and maintenance of regulatory markers. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: 1. The following described areas are designated as restricted areas within Collier County for the purpose of placing " No-Wake-Idle Speed" markers thereon, such areas being: .�...�. ur,rnwr January 7, 1986 a. Marco River: The existing regulatory No Wake - Idle Speed Zone shall be expanded to include a portion of Capri Pass because of substantial development, dock instal- t. . lations, and increased boating activity along Capri Point. The sign installation, location, and type are as shown on Attachment 1. b. Marco River: A shoal condition in Factory Bay is posing a serious threat to navigation and safety for boaters at this location. Pilings with signs shall be installed and maintained to warn boaters of the shoal area. The sign locations are as shown on Attachment 2. 2. The Public Works Administrator and the Transportation Department Director are authorized to execute the necessary permit applications as required by the State of Florida Department of- Natural Resources.
