~c. Transportation Services Administrator Archibald reported Staff is
process of doing the design of an overpass for S.R. 29 located
oflImmokalee, adjacent to Farm Workers Village and the new

an area where S.R. 29 will be relocated at some future point
· /He- said the consultant has advised Staff that he is aware of

Mike Arnold, Utilities Administrator, explained this item was con-
ttnued from the meeting of 11/13/90 in order to give the design engt-
Consoer, Townsend and Associates (CTA), an opportunity to bring
additional information regarding repairs found to be necessary
~xperts retained by Collier County. He stated the repairs consist
['iepoxy injection of the cracks, cutting additional control Joints in
~,plant walls and the addition of a liner to the inside of the tank
He informed that Staff has met with the design engineers and
y's outside legal counsel, with the result that the original
remain; however, the estimate for repairs has been
'~'dified from $330,000 to less than $150,000. He concluded by
that the Board authorize him to execute a change order in
not to exceed $150,000, in addition to the changes approved
the meeting of 11/13/90, and approve a budget amendment from
Littes Reserves to proceed.
answer to Commissioner Volpe, Mr. Arnold stated it is antici-
.ted that sewage will be introduced into the plant before Christmas.
William Townsend, Vice President of Consoer, Townsend and
read a letter into the record from his firm, stating their
of disagreement with some of the proposed repairs to the
|°Uth County Regional Wastewater Treatment Plant.
Commissioner Shanahan, for clarification, inquired if CTA's posi-
.is one of disagreement with the proposed new Joints in the walls,
which Mr. Townsend affirmed.
¥ Attorney Cuyler communicated his very strong recommendation
follow the recommendations of Staff, which are in large part
by the legal and engineering experts hired by the Board to
problem.
:County Manager Dorrill related that CTA and the County are in
only with the first element of repair, which is the pressure

of an epoxy material into various cracks in the walls. He
st&ted the second element of repair is the installation of a liner on
itha inside face of the tanks, and the third element is the recommen-
to put a "v" notch running vertically on the outside of the
..&t a designed location, as further assurance that there will not
continuing crack problem.
Oommissioner' Saunders mentioned that Mr. Townsend seems to have
y insulated himself and his firm from any responsibility in
future, if the County does not follow his recommendation.
County Attorney Cu¥1er explained that in the same respect, the
will be insulating itself by following the advice of Staff and
~atorino & Alam, Inc. (P&A), the experts retained.- He said if that
Lce is not correct, the County's action would be against them as
y Manager Dorrill added that part of the County's ~trategy in
he. future will require Mr. Pistorino to put his professional seal and
i~¢ense on the change order as the new engineer of record for this
In answer to Commissioner Hasse, Mx'. Dorrtll stated the Board will
to seek repair costs either through negotiated action with CTA or
Lble litigation.
Commissioner Hasse inquired if there is a failure of this tank
.the "v" notches are in place, will CTA be liable for repair of
· tank, when eTA has stated this is not the proper approach?
y Attorney Cuyler stated that, based on the expert advise
~'.
~ceived, the County will hold CTA responsible.
.'i' Gommissioner Saunders commented he is uncomfortable with changing
'ts from CTA to P&A in the middle of this project. He suggested
:~ng' the outside legal counsel to stand before the Board to advise,
~m'& 'legal standpoint, who will ultimately be responsible for future
if needed.
.'Commissioner Shanahan indicated his willingness to vote on this

Lssioner Volpe asked Mr. Townsend if he has discussed this
ret, with the contractor?
Townsend replied that he had, to a limited extent, but that
the discussions with the contractor have occurred with County
He stated that his firm retained four separate organizations
;lOok into the matter and give their expert opinions. He said their
is that the notches will create a plane of weakness which could
cracking that might not otherwise have occurred. He added that
repairs are properly made, the liner is also not necessary.
/~: George Keller, President of the Collier County Civic Organization,
qtxestioned the amount of research the County did prior to hiring CTA.
added his concern with relieving CTA of its responsibilities by
"ping to P&A. He asked Mr. Townsend if CTA w~11 guarantee the
to be workable for a certain period of time?
~Mr. Townsend replied his firm has never, in its history,
anything. He stated, however, the contractor has a perfor-
bond, in the name of the County, for a successful completion of
project which warranties that any repair or corrective work
~ired within a year's period of time is the responsibility of the
'Commissioner Volpe commented that the underlying assumption ts
was a design defect in this tank, to which County Attorney
er agreed.
i~i~ Mr. Townsend communicated that his firm has been in business for
ears and, although it does not guarantee anything, it will stand
behind its work. He said if anything developed that can be attached
ii~o~ething his firm did not address, they will not walk away from
