(Whenever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument and their respective heirs, successors or assigns.) Purchaser will make best efforts to make sure the properties are sold such that they will be owner occupied or occupied by seasonal residents. Building Time-Frame Phase One: Building shall commence on first two lots within 30 days of closing. Phase Two: Building shall commence on next four lots within 6 months of closing. Phase Three: Building shall commence on six additional lots within one year of closing. Phase Four: Building shall commence on remaining six lots within 18 months of closing. Buildings shall be deemed complete when a certificate of occupancy is issued. Subject to force majeure, parcels not receiving a certificate of occupancy within 24 months of close and settlement shall automatically revert to Seller or its successors or assigns, without the necessity of Seller or its successors or assigns taking any affirmative action to effectuate the reverter. Force Majeure: Fire, flood, earthquake or hurricane or for any other cause similar to those enumerated.
