AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is entered into this a day of
/12i;L , 2015, by and between COLLIER COUNTY COMMUNITY
REDEVELOPMENT AGENCY, its successors and assigns, whose mailing address is
3299 Tamiami Trail E., Naples, FL 34112 (hereinafter referred to as "Seller"), and
FORTINO CONSTRUCTION & DEVELOPMENT, LLC., a Florida limited liability
company, its successors and assigns, whose mailing address is PO Box 10102, Naples,
Florida 34101, (hereinafter referred to as "Purchaser").
WITNESSETH
WHEREAS, the Purchaser and Seller have previously entered into an Agreement
for Sale and Purchase for the Redevelopment of the Gateway Mini-Triangle
("Agreement") dated November 18, 2014 for a certain parcel of land ("Property"); and
WHEREAS, the Purchaser has requested to amend the time for Closing to
continue developing the financing for the purchase; and
WHEREAS, the Purchaser and the Seller are desirous of amending said
Agreement to extend the time for Closing of the transaction for an additional period of
sixty (60) days, up to and including July 13, 2015.
WHEREAS, Section 3.01 of the Agreement allows the Manager of the Real
Property Management Section or Designee to enter into such mutual written agreement
on behalf of the County for extensions of up to an additional sixty (60) days without
further approval of the Board of County Commissioners.
NOW THEREFORE, in consideration of the mutual covenants and obligations
provided within the said Agreement dated November 18, 2014 and other valuable
consideration, the said Agreement is hereby amended to extend the time for Closing of
the transaction to and including July 13, 2015.
Except as expressly amended herein the said Agreement between the Purchaser and
Seller remains in full force and effect according to the terms and conditions contained
therein, and said terms and conditions are applicable hereto except as expressly
provided otherwise herein.
IN WITNESS WHEREOF, the Purchaser and Seller have hereto executed this
Addendum the day and year first above written.
