WHEREAS, pursuant to Resolution 2013-166, Petitioner, Richard Ibach, of Q. Grady
Minor and Associates, P.A., on behalf of the property owner, has requested the vacation of the
County and the Public interest in the 15-foot drainage easement as shown in Official Record
Book 4387, Page 956 et seq, of the public records of Collier County, Florida, located in Section
11, Township 51 South, Range 26 East, Collier County, Florida, being more specifically shown
in Exhibit A, attached hereto; and
WHEREAS, the Board of County Commissioners, on this day, held a public hearing to
consider the petitioner's request and notice of said public hearing was given as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and public
interest in the 15-foot drainage easement as shown in Official Record Book 4387, Page 956 et
seq, of the public records of Collier County, Florida, located in Section 11, Township 51 South,
Range 26 East, Collier County, Florida, being more specifically shown in Exhibit A, is hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to be in the public
interest and for the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records of Collier County,
Florida.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring

WHEREAS, pursuant to Resolution 2013-166, Petitioner, Richard Ibach, of Q. Grady
Minor and Associates, P.A., on behalf of the property owner, has requested the vacation of the
County and the Public interest in the 15-foot drainage easement as shown in Official Record
Book 4387, Page 956 et seq, of the public records of Collier County, Florida, located in Section
11, Township 51 South, Range 26 East, Collier County, Florida, being more specifically shown
in Exhibit A, attached hereto; and
WHEREAS, the Board of County Commissioners, on this day, held a public hearing to
consider the petitioner's request and notice of said public hearing was given as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and public
interest in the 15-foot drainage easement as shown in Official Record Book 4387, Page 956 et
seq, of the public records of Collier County, Florida, located in Section 11, Township 51 South,
Range 26 East, Collier County, Florida, being more specifically shown in Exhibit A, is hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to be in the public
interest and for the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records of Collier County,
Florida.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring

•THIS GRANT OF DRAINAGE EASEMENT, made and executed this a day
of Mal , 2015, by and between LENNAR HOMES, LLC, a Florida limited
liability company (hereinafter "Lennar"), and COPPER COVE PRESERVE
COMMUNITY ASSOCIATION,INC., a Florida corporation not for profit (hereinafter
"Association") (sometimes herewith referred to collectively as "Grantors") and
COLLIER COUNTY, a political subdivision of the State of Florida, without
responsibility for maintenance(hereinafter"County")
WITNESSETH:
1. In consideration of the sum of Ten and 00/100 Dollar ($10.00), and other
good and valuable consideration, the receipt of which is hereby acknowledged, Grantors,
as their interests may appear, hereby grant in perpetuity to County, its successors or
assigns, a nonexclusive easement for drainage purposes, over and across certain property
as more particularly described in Exhibit"A"(the Easement Area").
2. Lennar hereby grants to Association and Association hereby reserves to
itself, a nonexclusive easement for drainage purposes, over and across the Easement
Area. Association shall be responsible for maintenance of the Easement Area.
3. The Easement Area shall include the purposes of water drainage,
management, and control on, over, across and through the Easement Area, together with
the right of ingress and egress over, across, upon, and through the Easement Area for
purposes of effectuating this grant of Easement, as well as any construction, maintenance,
repair, installation, excavation, or reconstruction of any stormwater facilities which are
deemed necessary or desirable by the Association or County.
4. The easement granted herein is intended to replace that certain Drainage
Easement recorded in Official Records Book 4387, Page 956, Public Records of Collier
County,Florida and

same to be executed by its representatives, thereunto duly authorized, on the day and year
first above written.
