A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA MEMORIALIZING THE BOARD'S APPROVAL OF THE
SUPPLEMENTAL JOINT PARTICIPATION AGREEMENT WITH THE FLORIDA
DEPARTMENT OF TRANSPORTATION TO PROVIDE FOR THE USE OF PASS-
THROUGH FUNDS FROM THE FEDERAL TRANSIT ADMINISTRATION'S (FTA)
SECTION 5311 PROGRAM IN OPERATING, ADMINISTRATIVE, AND
MANAGERIAL EXPENSES ASSOCIATED WITH THE PROVISION OF PUBLIC
TRANSPORTATION SERVICES IN THE NON-URBANIZED AREAS OF COLLIER
COUNTY AND AUTHORIZING THE CHAIRMAN TO SIGN THAT AGREEMENT.
WHEREAS, at the October 9, 2012, meeting of the Board of County Commissioners the
Board approved a Joint Participation Agreement (JPA: FM Project Number: 410120184 /
Contract Number: AQR01) with the Florida Department of Transportation to provide for the use
of pass-through funds from the FTA's Section 5311 program in operating, administrative, and
managerial expenses associated with the provision of public transportation services in the non-
urbanized areas of Collier County; and
WHEREAS, on December 20, 2013, the Florida Department of Transportation provided a
supplemental JPA to update the Disadvantaged Business Enterprise language contained within;
and
WHEREAS, the Florida Department of Transportation requires the Board provide a
resolution memorializing and confirming the Board's aforementioned affirmative vote to
approve the supplemental agreement and authorize its Chairman to execute the JPA.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,that:
1. On January 28, 2014, the Board of County Commissioners approved by majority vote
the aforementioned supplemental JPA and authorized its Chairman to execute that
agreement.
2. A certified copy of this Resolution will be forwarded by the Collier County Clerk to
FDOT along with the executed Agreement.

This supplement is to remove the first paragraph only of article 12.31 in the original Joint Participation Agreement in its
entirety and replace with the following language:
The contractor, sub recipient or subcontractor shall not discriminate on the basis of race,color, national origin, or sex in
the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR part 26 in the award
and administration of DOT-assisted contracts. Failure by the contractor to carry out these requirements is a material
breach of this contract,which may result in the termination of this contract or such other remedy as the recipient deems
