RESOLUTION NO. 91- 155
RESOLUTION CREATING THE EUCLID AND LAKELAND
AVENUES ROADSIDE IMPROVEMENTS MUNICIPAL SERVICE
BENEFIT UNIT; DESCRIBING THE AREA INCLUDED WITHIN
THE UNIT; PROVIDING THAT THE NATURE OF THE PROPOSED
PROJECT IS THE CONSTRUCTION OF ROADSIDE IMPROVEMENTS
TO REPLACE THE OPEN ROADSIDE DITCHES AND THE
CONSTRUCTION OF BIKEPATHS AND PROVIDING THAT THE
COSTS OF THE IMPROVEMENTS SHALL BE PAID FROM SPECIAL
ASSESSMENTS AGAINST THE BENEFITED PROPERTIES WITHIN
THE UNIT.
WHEREAS, the Board of County Commissioners on June 7, 1988
accepted a petition from the residents of the Willoughby Acres
Area requesting drainage improvements along Euclid and Lakeland
Avenues and the construction of bikepaths along Euclid and
Lakeland Avenues; and
WHEREAS, the Board of County Commissioners on June 7, 1988
approved the creation of an assessment district for these
improvements with a per dwelling unit assessment method; and
WHEREAS, the Board has determined and found that the creation
of the Euclid and Lakeland Avenues Roadside Improvements Municipal
Service Benefit Unit is needed for health, safety and to enhance
the general area.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

,Section One. This resolution is adopted pursuant to the i
provisions of Collier County Ordinance No. 88-23 and other
applicable provisions of law.
,Section Two. It is hereby found and determined as follows: •
A. The municipal service benefit unit created shall be
officially known as the Euclid and Lakeland Avenues Roadside •
Improvements Municipal Service Benefit Unit (hereinafter referred
to as "Unit") .
B. It is necessary for the continued preservation of the
health, welfare, convenience and safety of the citizens and
inhabitants of the Willoughby Acres Area to provide for the
construction of roadside improvements (the "Project") described in �.
the Exhibit "A" attached hereto and incorporated herein.
Section Three. Description of the Unit.
The unit shall comprise all those lands located in Collier •

County, Florida, being more specifically described as:

All of Section 24, Township 48 South, Range 25 East, Collier
County, Florida, less the following four described areas of
said Section 24:
1. The East 1/4 of the East 1/2.
2. The Northwest 1/4 of the Northwest 1/4.
3. The West 1/2 of the Southwest 1/4 of the Northwest 1/4.
4. The North 1/2 of the Northwest 1/4 of the Northwest 1/4
of the Southwest 1/4.
Section Four. All objections, if any, to the adoption of this
Resolution creating the Euclid and Lakeland Avenues Roadside
Improvements Municipal Service Benefit Unit shall be made in
writing and filed with the Clerk at or before the time or
adjourned time of the public hearing. The adoption of this •
Resolution shall be the final adjudication of the issues presented
thereby unless proper steps shall be initiated in a court of
competent jurisdiction to secure relief within twenty (20) days
from the date of the Board action of this Resolution.
,Section Five. The Clerk is hereby ordered and directed to spread
this resolution in full among the minutes of this meeting for
permanent record in his office.

The roadside improvements to be constructed consist of
approximately 7,000 lineal feet of drainage pipe with associated
catchbasins, fill, bikepaths, and road and utility repairs.
