Recommendation to approve the partial release of 55 code enforcement liens with a combined
accrued value of $10,108.85 for payment of $1,091.21, in the Code Enforcement actions entitled
Board of County Commissioners vs. Capri International, Inc., Special Magistrate Case Nos.
CENA20120012920, CENA20120012922, CENA20120012918, CENA20130003493,
CENA20130003492, CENA20130003495, CENA20130007036, CENA20130007231,
CENA20130007218 and CENA20130007230, relating to property known as 1410 Marion Lane,
Collier County,Florida.
OBJECTIVE: That the Board of County Commissioners (Board) approve the partial release of a
code enforcement lien with an accrued value of $10,108.85, for payment of $1,091.21, as to
property known as 1410 Marion Lane only, in relation to Code Enforcement Special Magistrate
Case Nos. CENA20120012920, CENA20120012922, CENA20120012918, CENA20130003493,
CENA20130003492, CENA20130003495, CENA20130007036, CENA20130007231,
CENA20130007218 and CENA20130007230.
CONSIDERATIONS: As a result of nuisance abatement violations at properties identified as
Folios 60182840005, 60182880007, 6018280003, 73181480000, the Code Enforcement Special
Magistrate ordered the imposition of 55 liens against Capri International, Inc. The liens were
recorded in the Official Public Records as shown below. These liens will continue to accrue
interest of twelve percent (12%)per annum until they are paid in full.

While these liens were for various violations on property owned by Capri International, Inc., this
request for a partial release is for a different property, 1410 Marion Lane (Immokalee), which
contains no code violations. This latter parcel was encumbered by the liens as a result of
common ownership by Capri International, Inc. This property is under contract and the lien
continues to encumber the property due to the fact that it was owned by Capri International, Inc.
at the time of lien imposition.
FISCAL IMPACT: Payment of$1,091.21 has been made, consisting of 55 partial payments of
$19.84 for the 55 orders imposing liens. If approved by the Board, fines in the amount of
$9,017.64 would be waived with respect to 1410 Marion Lane only. The lien balances would
continue to encumber all other properties owned by Capri International, Inc.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and
approved it as to form and legality. Majority support is required for approval. This item
conforms to the Board's policy contained in Resolution 2012-46. KN

RECOMMENDATION: That the Board of County Commissioners waive the fines in the
amount of $9,017.64 with respect to 1410 Marion Lane only, accept payment of $1,091.21,
partially release the liens as described above, and authorize the Chairman to sign the attached
partial releases for recording in the Official Public Records.
