I am not familiar with this advertising process but per the attached advertising request the vendor is Naples Daily News
however
I cannot use the vendor numbers in the Purchasing system designated for the Naples Daily News. My purchasing group
cannot use

Do you know if the Naples Daily News is the vendor or if I am supposed to use another vendor and who

I have also contacted purchasing regarding this problem but since you are the source of this request I want to make
Sure I open the PO with the right vendor.
I received an e-mail from purchasing Randy Jones suggested I use vendor 120876 Scripps Media Inc.
He said this is used for all legal advertising. If you give me the go ahead I will open the PO under that
Vendor if not I will have to contact Naples Daily News for information to enter them into the system.

In order to advertise these Ordinances for the 2/24/15 BCC Meeting, we should get the ad request process going this
week. I started the request form (see attached). The titles match those from the Ordinances on Sire. Please confirm,
however, as it is very important that the correct titles are advertised. I filled in the advertising date of 2/13/15 which
will comply with the 10-day notice requirement. I have also attached scanned versions the Ordinances signed by Scott
Teach.
Please fill in the highlighted areas. Approximate cost of the ad for the P.O. is$500. Both titles will run in the same ad
which will save some money. Print a hard copy of the ad request, sign and date. Then email a scanned version of the
signed and completed ad request, a Word version of the ad request(so the Clerk's Office d,oesnot have tore-key the
Ordinance titles), and the scanned versions of the proposed Ordinances to
MinutesandRecords@collierclerk.com. Please copy me and Mary Jo in the County Manager's Office. This should be
completed this week or early next week(earlier the better) in order for it to be advertised on the 13th. Should the Board
not authorize the Ordinance, I will contact Minutes and Records to stop the process.
Our Office will keep the original Ordinances and will route them for the Chair's signature after Board adoption. I am

The Ordinances that you attached have typos in the titles. I corrected these on Tuesday, had Scott Teach sign, and
forwarded scanned copies of them to Len Price along with the advertising instructions. The titles in the ad request are
correct, however, and Minutes and Records can use the attached corrected and signed Ordinances with this ad
request. We will keep the originals for routing after BCC adoption.
I also just noticed that the versions with the typos are still on Sire.

THE ISLES OF CAPRI MUNICIPAL RESCUE AND FIRE
SERVICES TAXING DISTRICT; AMENDING COLLIER
COUNTY CODE OF LAWS AND ORDINANCES SECTION
122-606, CREATED BOUNDARIES, TO REMOVE THE
FIDDLER'S CREEK COMMUNITY DEVELOPMENT
DISTRICT #2 FROM WITHIN THE MSTU'S BOUNDARIES;
PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND
ORDINANCES; PROVIDING FOR CONFLICT AND
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 122-610 of the Collier County Code of Laws and Ordinances,
presently provides that the boundaries of the Isles of Capri Municipal Fires Services' Taxing
District may be changed by an amendment to the Ordinance; and
WHEREAS, on November 4, 2014, as a result of a referendum presented to the voters
in the East Naples and Golden Gate Fire Districts, those independent fire districts were
merged to create the Greater Naples Fire Rescue District; and
WHEREAS, the Collier County Board of County Commissioners as the governing
body of the Isles of Capri Municipal Rescue and Fire Services Taxing District wishes to
change the boundaries of the Isles of Capri's MSTU District by removing the Fiddler's Creek
Development District #2 from within that MSTU's existing boundaries, and provide for fire
services to the residents of Fiddler's Creek by establishing a new, separate MSTU and
entering into an Interlocal Agreement whereby the Greater Naples Fire Rescue District would
provide fire and rescue services to the residents of Fiddler's Creek.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Section 122-606 of the
Collier County Code of Laws and Ordinances is amended as follows:
SECTION ONE:
Sec. 122-606. Created,boundaries.
(a) Pursuant to F.S. ch. 125, the Isles of Capri Municipal Rescue and Fire Services
Taxing Districts is hereby created for the purpose of providing rescue and fire
control services to the residents of the area hereinafter described:
(b) All that land located in the county and specifically described as:
Sections 19, 20, 21, 22, 27, 28,29, 30, 31, 32, 33 and 34 of Township 51 South,
Range 26 East, and those portions of Sections 4, 5 and 6 of Township 52 South,
Range 26 East, which lie north of the Marco River. Less the North '/2 (N '/2) of
Section 22,Township 51 South,Range 26 East.
SECTION TWO: INCLUSION IN THE CODE OF LAWS AND ORDINANCES
The provision of this Ordinance shall become and be made part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be
renumbered or re-lettered to accomplish such, and the word"ordinance"may be changed to
"section,""article,"or any other appropriate word.
SECTION THREE: CONFLICT AND SEVERABILTIY
In the event this Ordinance conflicts with any other Ordinance of Collier County or
any other applicable law, the more restrictive shall apply. If any phrase or portion of the
Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portion.

SECTION FOUR: EFFECTIVE DATE
This Ordinance shall be come effective upon filing with the Department of State.

Pursuant to Chapter 125 of the Florida Statutes,the Fiddler's Creek Municipal Rescue
and Fire Services Taxing Unit (the"MSTU") is hereby created for the purpose of providing
fire control services to the residents of the area hereinafter described:
All that land located in Collier County, Florida, and specifically described as:
The North '/z (N '''A)of Section 22, Township 51 South, Range 26 East.
SECTION TWO: Governing Body.
The governing body of the MSTU shall be ex officio the Board of County
Commissioners of Collier County, Florida.
SECTION THREE: Purpose.
The MSTU is formed for the purpose of providing and maintaining fire department
services within the MSTU through an interlocal agreement with another Fire Service
Agency located within the County.

SECTION FOUR: Funding and Levy of Taxes.
For the purpose of implementing this article, the Collier County Board of County
Commissioners shall annually, at the time required by general budgetary law, make an itemized
estimate of the amount of money required to carry out the business of the MSTU for the next
fiscal year, which shall be from October 1 to and including September 30 following. The
estimate shall describe the purpose for which the moneys are required and the amount necessary
to be raised by taxation within the MSTU. At the time and place for fixing the annual rate of
taxation for county purposes, the Board of County Commissioners shall fix and cause to be
levied on all properties within the MSTU, subject to taxation, a millage rate not to exceed 1.5
mils per year.
SECTION FIVE: Boundary changes.
The boundaries of this MSTU or the lands included within said MSTU may be changed
by an amendment to this Ordinance.
SECTION SIX: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or

The draft ordinance provided as backup to the subject agenda item is not correct. All
references to Fiddler's Creek Community Development District#2 should be removed from
this draft ordinance. The approximately 280 properties in Fiddler's Creek that are now served
by the Isles of Capri Fire Rescue District are actually a part of CDD#1, not CDD#2. CDD#2 is
currently served 100% by Greater Naples Fire Rescue District. Having said that, I don't know
why the Community Development District, as such, even comes into play in this proposed
ordinance. I have already advised Len Price and the GNFRD of the same problem with the
draft ILA.
Perhaps there is a legal reason to use that terminology in the proposed ordinance but I don't
know what it would be. In any case, it is totally confusing and on its surface is absolutely not
correct in referencing Fiddler's Creek Community Development District#2 from any
perspective.

BOUNDARIES OF THE MSTU; PROVIDING FOR THE
GOVERNING BODY OF THE MSTU; PROVIDING FOR A
PURPOSE; AUTHORIZING A TAX LEVY OF 1.5 MILLS;

INCLUSION IN THE CODE OF LAWS AND ORDINANCES;
PROVIDING FOR CONFLICT AND SEVERABILITY; AND

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA:
SECTION ONE: Creation, boundaries.
Pursuant to Chapter 125 of the Florida Statutes, the Fiddler's Creek Municipal Rescue
and Fire Services Taxing Unit (the "MSTU") is hereby created for the purpose of providing
fire control services to the residents of the area hereinafter described:
All that land located in Collier County, Florida, and specifically described as:
The North '/2 (N '/2)of Section 22, Township 51 South, Range 26 East.
SECTION TWO: Governing Body.
The governing body of the MSTU shall be ex officio the Board of County
Commissioners of Collier County,Florida.
SECTION THREE: Purpose.
The MSTU is formed for the purpose of providing and maintaining fire department
services within the MSTU through an interlocal agreement with another Fire Service
Agency located within the County.

SECTION FOUR: Funding and Levy of Taxes.
For the purpose of implementing this article, the Collier County Board of County
Commissioners shall annually, at the time required by general budgetary law, make an itemized
estimate of the amount of money required to carry out the business of the MSTU for the next
fiscal year, which shall be from October 1 to and including September 30 following. The
estimate shall describe the purpose for which the moneys are required and the amount necessary
to be raised by taxation within the MSTU. At the time and place for fixing the annual rate of
taxation for county purposes, the Board of County Commissioners shall fix and cause to be
levied on all properties within the MSTU, subject to taxation, a millage rate not to exceed 1.5
mils per year.
SECTION FIVE: Boundary changes.
The boundaries of this MSTU or the lands included within said MSTU may be changed
by an amendment to this Ordinance.
SECTION SIX: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or
re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article"
or any other appropriate word.
SECTION SEVEN: Conflict and Severability.
In the event this Ordinance conflicts with any other Ordinance of Collier County or any
other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance
is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and such holding shall not affect the
validity of the remaining portion.
SECTION NINE: EFFECTIVE DATE
This Ordinance shall be come effective upon filing with the Department of State.

AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE
ISLES OF CAPRI MUNICPAL RESCUE AND FIRE SERVICES
TAXING DISTRICT; AMENDING COLLIER COUNTY CODE OF
LAWS AND ORDINANCES SECTION 122-606, CREATED
BOUNDARIES, TO REMOVE FIDDLER'S CREEK FROM WITHIN
THE MSTU'S BOUNDARIES; PROVIDING FOR INCLUSION IN
THE CODE OF LAWS AND ORDINANCES; PROVIDING FOR
CONFLICT AND SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 122-610 of the Collier County Code of Laws and Ordinances,
presently provides that the boundaries of the Isles of Capri Municipal Fires Services' Taxing
District may be changed by an amendment to the Ordinance; and
WHEREAS, on November 4, 2014, as a result of a referendum presented to the voters
in the East Naples and Golden Gate Fire Districts, those independent fire districts were
merged to create the Greater Naples Fire Rescue District; and
WHEREAS, the Collier County Board of County Commissioners as the governing
body of the Isles of Capri Municipal Rescue and Fire Services Taxing District wishes to
change the boundaries of the Isles of Capri's MSTU District by removing Fiddler's Creek
from within that MSTU's existing boundaries, and provide for fire services to the residents of
Fiddler's Creek by establishing a new, separate MSTU and entering into an Interlocal
Agreement whereby the Greater Naples Fire Rescue District would provide fire and rescue
services to the residents '

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Section 122-606 of the
Collier County Code of Laws and Ordinances is amended as follows:
SECTION ONE:
Sec. 122-606. Created, boundaries.
(a) Pursuant to F.S. ch. 125, the Isles of Capri Municipal Rescue and Fire Services
Taxing Districts is hereby created for the purpose of providing rescue and fire
control services to the residents of the area hereinafter described:
(b) All that land located in the county and specifically described as:
Sections 19, 20, 21, 22, 27, 28, 29, 30, 31, 32, 33 and 34 of Township 51 South,
Range 26 East, and those portions of Sections 4, 5 and 6 of Township 52 South,
Range 26 East, which lie north of the Marco River. Less the North '/z (N '/z) of
Section 22, Township 51 South, Range 26 East.
SECTION TWO: INCLUSION IN THE CODE OF LAWS AND ORDINANCES

The provision of this Ordinance shall become and be made part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be
renumbered or re-lettered to accomplish such, and the word "ordinance" may be changed to
"section,""article,"or any other appropriate word.
SECTION THREE: CONFLICT AND SEVERABILTIY
In the event this Ordinance conflicts with any other Ordinance of Collier County or
any other applicable law, the more restrictive shall apply. If any phrase or portion of the
Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portion.

SECTION FOUR: EFFECTIVE DATE
This Ordinance shall be come effective upon filing with the Department of State.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF

The governing body of the MSTU shall be ex officio the Board of County

SECTION THREE: Purpose.
The MSTU is formed for the purpose of providing and maintaining fire department
services within the MSTU through an interlocal agreement with another Fire Service
Agency located within the County.

SECTION FOUR: Funding and Levy of Taxes.
For the purpose of implementing this article, the Collier County Board of County
Commissioners shall annually, at the time required by general budgetary law, make an itemized
estimate of the amount of money required to carry out the business of the MSTU for the next
fiscal year, which shall be from October 1 to and including September 30 following. The
estimate shall describe the purpose for which the moneys are required and the amount necessary
to be raised by taxation within the MSTU. At the time and place for fixing the annual rate of
taxation for county purposes, the Board of County Commissioners shall fix and cause to be
levied on all properties within the MSTU, subject to taxation, a millage rate not to exceed 1.5
mils per year.
SECTION FIVE: Boundary changes.
The boundaries of this MSTU or the lands included within said MSTU may be changed
by an amendment to this Ordinance.
SECTION SIX: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or
re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article"
or any other appropriate word.
SECTION SEVEN: Conflict and Severability.

INTERLOCAL AGREEMENT FOR FIRE AND RESCUE SERVICES
This Agreement, made and entered into this z4- of 2015 by and between the Board of
County Commissioners of Collier County, Florida, as the Govekling Board of the Fiddler's Creek
Municipal Rescue and Fire Services Taxing Unit (the "MSTU") (hereinafter collectively referred to as the
"COUNTY"), and the Greater Naples Fire Rescue District,whose District Headquarters is located at 14575
Collier Boulevard, Naples, Florida 34119, (hereinafter referred to as "GNFRD").
WHEREAS, it is the desire of the COUNTY to provide fire protection to the Fiddler's Creek Municipal
Rescue and Fire Services Taxing Unit in Collier County, Florida, as more specifically identified in the
Service Area map attached hereto as Exhibit"A;" and
WHEREAS, the COUNTY desires to provide said fire protection to a portion of unincorporated Collier
County by agreement with the GNFRD to provide such services,and;
WHEREAS, the above referenced portion of the COUNTY shall hereinafter be referred to as the "Service
Area," as further delineated on the Service Area map attached as Exhibit "A." The Service Area shall be
within the following boundaries:The North 1/2 (N Y2)of Section 22,Township 51 South, Range 26 East.
NOW THEREFORE,
In consideration of the mutual covenants contained herein the parties hereby agree as follows:
1. TERM OF AGREEMENT: This Agreement shall commence on October 1, 2015 and will continue
for a period of three (3) years ending on September 30, 2018. Thereafter, this agreement may be
renewed for three (3) additional one (1) year terms under the same covenants, terms and conditions,
unless either party desires to terminate or renegotiate this agreement. In the event either party desires
to terminate or renegotiate this agreement, it shall provide written notice of its intention to the other
party not less than ninety(90) days prior. If the GNFRD terminates,the GNFRD will continue such service
for a reasonable period of time to allow the COUNTY to provide alternative fire and rescue protection.
The maximum length of such reasonable period shall be six (6) months after the termination of the
Contract by the GNFRD. Payment for services during the six(6) month period beyond the expiration date
will be based on the monthly prorated amount of the annual contract period. In the absence of the
ninety (90) day prior written notice of intent to terminate the Agreement by either party, the Contract
shall continue in force until written notice is given, or until the Contract is renegotiated on terms
mutually agreed upon by the parties.
2. TERMS OF PAYMENT: The COUNTY agrees to pay the GNFRD for the provision of the services
contained within Section 3 "Service Level," in two separate payments during each fiscal year this
agreement is in effect. The County will remit the first payment during the month of April, prior to April
30th, and the second payment during the month of September, prior to the close of the fiscal year on
September 30th. The payment amount shall be that sum collected annually from the adopted millage
rate for the Fiddler's Creek Municipal Rescue and Fire Services Taxing Unit, as set by the Collier County
Board of County Commissioners, minus any administrative fees, and net of costs required to be paid to
the property appraiser, tax collector as well as any other associated fees and cost. The millage rate set
by the Board of County Commissioners each year will equal that which is levied by the GNFRD and is
subject to the ordained millage cap for the MSTU.

Each year of the Agreement, COUNTY will notify the GNFRD of the adopted annual millage rate in
September; with notice of the adopted annual millage rate in a form consistent with Exhibit "B" which
states the current adopted millage rate.
3. SERVICE LEVEL: The GNFRD agrees to provide fire protection and rescue services to the Service
Area at the time of any emergency call. All decisions on manpower and equipment will be made by the
GNFRD Fire Chief, or in his absence, by one of his assistants. The GNFRD shall perform the services with
modern firefighting practices and consistent with the services generally being provided to its other
service areas. Fire protection and rescue services provided by the GNFRD will include all emergency and
non-emergency services normally performed by the Fire Department, including all those services
required by law. This Agreement does not alter any existing Mutual Aid Agreement(s) or the County's
Comprehensive Emergency Management Plan between the GNFRD and COUNTY.
4. COMMAND AT FIRE SCENE: The GNFRD Fire Chief, or in his absence, one of his assistants, shall
assume control and responsibility of all fire or other applicable emergencies in the Service Area where
the GNFRD has responded.
5. EQUIPMENT AND PERSONNEL: The GNFRD shall maintain equipment and personnel necessary
to provide adequate fire protection and rescue services to the service area. The GNFRD shall be
responsible for properly training all of said personnel.
6. RECORDS: The GNFRD agrees to maintain records on all responses and provide statistics as
necessary.
7. BREACH OF CONTRACT: Non-compliance with any provision of this Agreement by either party
shall constitute a material breach. The breaching party shall have seven (7) days after receipt of written
notice of any breach to correct that breach, or if corrections cannot be made within the seven (7) day
period, a reasonable agreed upon time shall be given to correct the breach. In the event the breach
cannot be cured within such time periods, the non-breaching party may declare the contract
terminated, and shall so notify the other party in writing. In such event, an adjustment in the contract
payment shall be made based upon a monthly-prorated amount of the annual contract payment.
8. CONSENT OF THE PARTIES: The GNFRD hereby agrees not to enter into a contract for fire
protection and rescue services with any individuals or organizations within the service area of Collier
County without the written consent of the COUNTY.
9. INDEMNITY AND INSURANCE:
A. INDEMNIFICATION. While operating under the terms of this Agreement, each Party
shall bear liability as provided by applicable law and the terms of this Agreement. Each Party shall be
liable for its own actions and negligence and,to the extent permitted by law, each Party shall indemnify,
defend and hold harmless the other Party against any actions, claims or damages arising out of their
negligence in connection with the performance of the Agreement. The foregoing indemnification shall
not constitute a waiver of sovereign immunity beyond the limits set forth in Section 768.28, Fla. Stat.,
nor shall the same be construed to constitute agreement by either Party to indemnify the other Party
for such other Party's negligent,willful or intentional acts or omissions.

B. LIABILITY INSURANCE. The GNFRD covenants to keep in force during the period of this
agreement adequate public liability insurance and property damage insurance.
10. NON-APPROPRIATIONS CLAUSE: If for any reason the GNFRD or COUNTY's governing
body does not approve the funds to implement this contract in any given fiscal year, the contract shall
be null and void.
11. NOTICES: Any notices permitted or required by this Agreement shall be in writing and
submitted by certified mail, return receipt requested,to one of the following addresses,as appropriate
a) Notices from the GNFRD to the COUNTY shall be sent to: Leo E. Ochs, Jr., County
Manager, 3299 E.Tamiami Trail, Building F,Suite 202 Naples, Florida 34112.
b) Notices from the COUNTY to the GNFRD shall be sent to: Chief Kingman Schuldt, 14575
Collier Boulevard, Naples, Florida 34119.
