THIS CAUSE came on for public hearing before the Code Enforcement Board on January 22,2015,and the
Code Enforcement Board,having considered Respondents' Motion for Continuance and being duly advised in the
premises,hereupon issues its Findings of Fact, Conclusions of Law, and Order of the Code Enforcement Board,as
follows:
FINDINGS OF FACT
1. Respondent is charged with violation of Code of Laws and Ordinances, Chapter 22,Article VI, Section 22-
236 and Collier County Land Development Code 04-41, as amended, Section 10.02.06(B)O(A),in the
following particulars:
Primary structure with unpermitted alterations in poor condition and an unpermitted two-story storage
structure in poor condition.
ORDER
Based upon the foregoing,and pursuant to the authority granted in Chapter 162,Florida Statutes, and
Collier County Ordinance No. 07-44, as amended, it is hereby ORDERED:
A. The Respondent's Motion for Continuance of this case is GRANTED until July 21,2015.
B. All parties shall be re-noticed for the subsequent hearing date.
D. Fines shall accrue during the Continuance period

THIS CAUSE came on for public hearing before the Code Enforcement Board on January 22,2015, and the
Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective to
all appropriate matters,hereupon issues its Findings of Fact and Order of the Code Enforcement Board,as follows:
FINDINGS OF FACT
1. Respondent, Chile Caliente, L.L.C., is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent,through its representative, Jacob Gallegos, entered into a Stipulation,
which is attached hereto as Exhibit"A". The Stipulation is adopted as an Order of the Code Enforcement
Board and the Respondent is Ordered to comply.
4. The real property located at 208 Boston Avenue, Immokalee, FL, Folio#25630440002 (Legal Description:
Carsons Add BLK 8 W1/2 of Lot 1 and all of Lots 2,3 &4,Less W 2FT of Lot 4),is in violation of Collier
County Land Development Code 04-41, as Amended, Section 10.02.06(B)(1)(A) in the following
particulars:
A commercial Building altered and added to without first obtaining the authorization of the
required permit(s),inspections and certificate of occupancy.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41, as Amended,
Section 10.02.06(B)(1)(A).
B. Respondent must abate the violation by obtaining all required Collier County building permits or
demolition permit, inspections and Certificate of Completion/Occupancy on or before May 22,2015 or a
fine of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.85 on
or before February 21, 2015.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

COMES NOW, the undersigned, Jacob Gallegos, on behalf of himself and as representative for Respondent
Chile Caliente enters into this Stipulation and Agreement with Collier County as to the resolution of Notices of
Violation in reference (case) number CESD201400153 9 dated the 12 day of August, 2014.
In consideration of the disposition and resolutierfi of-thhee matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for )-2Z-0-to promote efficiency in the administration of the code enforcement

Board has jurisdiction of this matter.
3. Respondent,having been duly notified, did appear through her designated representative,Luis Alberto
Cerillo,at the public hearing. The Respondent is deceased and her son,Luis, is her only remaining
descendant per his testimony.
4. The real property located at 908 Glades St., Immokalee, FL, Folio #63858720003 (Legal Description:
NEWMARKET SUBD. BLK 28, Lots 1-2)), is in violation of Collier County Land Development Code 04-
41,as Amended, Section 10.02.06(B)(1)(A)in the following particulars:
Four structures erected without first obtaining Collier County Building Permits.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as Amended,
Section 10.02.06(B)(1)(A).
B. Respondent must abate the violation by obtaining all required Collier County building permits or
demolition permit, inspections and Certificate of Completion/Occupancy on or before July 22,2015 or a
fine of$100.00 per day will be imposed for each day the violation remains thereafter.
C. Respondent shall, additionally,provide updates to the Code Enforcement Investigator at least every sixty
(60)days.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.43 on
or before February 21,2015.
F. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

A. Respondents are found guilty of violating Collier County Code of Laws and Ordinances, Chapter 110,
Section 110-31(A).
B. Respondents must abate the violation by obtaining all required Collier County Right-of-Way
permit(s)and inspections through final approval on or before February 21,2015 or a fine of
$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondents fail to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.

base of the vegetation remains. This order of the board shall be completed on or before February 21,
2015 or a fine of$100.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may

follows:
FINDINGS OF FACT
1. Respondent is charged with violation of Collier County Land Development Code, Section
10.02.06(B)(1)(a), 10.02.06(B)(1)(e)and 10.02.06(B)(1)(e)(i)in the following particulars:
Building a dock without the proper Collier County Permits.
ORDER
Based upon the foregoing, and pursuant to the authority granted in Chapter 162,Florida Statutes, and
Collier County Ordinance No. 07-44, as amended, it is hereby ORDERED:
A. The Respondent's Motion for Continuance of this case is GRANTED until May 22,2015.
B. All parties shall be re-noticed for the subsequent hearing date.
C. Fines shall accrue during the Continuance period
D. Respondent is ordered to pay the operational costs incurred in prosecuting this case in the
amount of$62.60 on or before February 21,2015.

FINDINGS OF FACT
1. Respondent,Frank Civale., is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at 3800 29th Ave. SW, Naples, FL, Folio #38051800001 (Legal Description:
Golden Gate Est. Unit 28 E 180 Ft. of Tr. 120), is in violation of Collier County Land Development Code
04-41,as Amended, Section 1.04.01 (A)and Section 2.02.03 in the following particulars:
Estates zoned property being utilized as multi-family by renting the guest house
and other accessory structures.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as Amended,
Section 1.04.01 (A)and Section 2.02.03.
B. Respondent must abate the violation by ceasing all unpermitted lodging activities(including
advertisements)associated with this Estates zoned property on or before February 21,2015 or a fine of
$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$64.59 on
or before February 21,2015.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

3. Operational costs of$65.01 incurred by the County in the prosecution of this case have been paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion, did appear
at the public hearing,through his representative,Genarro Silguero,and no legal defense to the Motion was
presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely
filed.
6 The violation has been abated as December 31,2014.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida

B. Respondent must abate the violation by ceasing the storage of any and all recreational vehicles not owned
by the property owner and/or disconnect any and all utility hook-ups and cease using recreational vehicle(s)
for living, sleeping or housekeeping on or before February 21,2015 or a fine of$50.00 per day will be
imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.01 on
or before February 21,2015.

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came before the Code Enforcement Board upon the Petitioner's Motion for Imposition
Fines/Liens on 22"d day of January,2015, and the Code Enforcement Board,having heard argument respective to all
appropriate matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
1. On April 24,2014,Respondent was found guilty of violating Ordinance 04-41, as amended,the Collier
County Land Deelopment Code, Section 10.02.06(B)(1)(A)and Collier County Code of Laws and
Ordinances,Chapter 110, Section 110-31(A),which violation occurred on the property located at 2260
Tamiami Trail East, Naples, FL,Folio#51690680009(Legal Description: Lots 4 and 5, Block B,Inoman
Sudivision,as per plat thereof recorded in Plat Book 2,Page 82,of the Public Records of Collier County,
Florida.
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before July 23,2014,or a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5039,PG 3262-3263).
3. Operational costs of$125.88 incurred by the County in the prosecution of this case have been paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did appear
at the public hearing,and no legal defense to the Motion was presented.
5. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely
filed.
6 The violation has been abated as December 9,2014.
ORDER
Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44, as amended,it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is denied based on the mitigating circumstances
presented by Respondent and no accrued fines are imposed.

THIS CAUSE came on for public hearing before the Code Enforcement Board on January 22,2015,and the
Code Enforcement Board,having considered Respondents' Motion for Continuance and being duly advised in the
premises,hereupon issues its Findings of Fact, Conclusions of Law,and Order of the Code Enforcement Board, as
follows:
FINDINGS OF FACT
1. Respondent is charged with violation of Code of Laws and Ordinances, Chapter 22,Buildings and
Building Regulations,Article VI,Property Maintenance Code, Section 22-231, sub-section(12)(i), in the
following particulars:
Broken windows on E/S of building.
ORDER
Based upon the foregoing,and pursuant to the authority granted in Chapter 162,Florida Statutes,and
Collier County Ordinance No. 07-44, as amended, it is hereby ORDERED:
A. The Respondent's Motion for Continuance of this case is GRANTED until March 23,2015.
B. Respondent shall pay the abatement costs for boarding the property by March 23,2015.
C. All parties shall be re-noticed for the subsequent hearing date.
D. Fines shall accrue during the Continuance period
E. Respondent is ordered to pay the operational costs incurred in prosecuting this case in the
amount of$63.75 on or before February 21,2015.
