HEX Final Decision 2015-02 HEX NO. 2015—02 HEARING EXAMINER DECISION PETITION NO. CU-PL20140000921 —Marco Island Congregation of Jehovah's Witnesses, Naples, FL, Inc. requests a Conditional Use to allow a church within a Agricultural (A) zoning district pursuant to Section 2.03.01.A.1.c.7 of the Collier County Land Development Code for property located on the south side of Tamiami Trail East, one quarter mile east of Manatee Road, in Section 11, Township 51 South, Range 26 East, Collier County, Florida. DATE OF HEARING: January 22, 2015 STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the public, and the recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section 10.08.00 D of the Land Development Code has been met and the petition should be approved. ANALYSIS: Staff report mistakenly referenced the worship hall as approximately 10,000 square feet. The applicant and staff acknowledged that the facility requested is 4,556 square feet. No members of the public were present to speak in opposition. One email was received in opposition that mistakenly believed this application was for land within the adjoining Fiddler's Creek Planned Unit Development (PUD). The application is adjacent to, but not part of any PUD. DECISION: Petition Number CU-PL20140000921, filed by H.L. Bennett & Associates, Inc. representing Marco Island Congregation of Jehovah's Witnesses, Naples, FL, Inc., with respect to the property hereinafter described in Exhibit "A", is hereby approved for a Conditional Use for a church within a Agricultural (A) zoning district pursuant to Section 2.03.01.A.1.c.7 of the Collier County Land Development Code in accordance with the Conceptual Site Plan described in Exhibit "B", and subject to the condition(s) set forth below.
