Ordinance 2001-049~.~1%~Lto~~N~$1'~AN ORDINANCE ESTABLISHING A COLLIER COUNTY ~ COMMUNITY OF CHARACTER COUNCIL; PROVIDING FOR APPOINTMENT AND COMPOSITION; SETTING FORTH THE TERMS OF OFFICE; PROVIDING FOR REMOVAL FROM OFFICE, FAILURE TO ATTEND MEETINGS; PROVIDING FOR OFFICERS, QUORUM AND RULES OF PROCEDURE; PROVIDING FOR REIMBURSEMENT OF EXPENSES; SETTING FORTH THE FUNCTIONS, POWERS AND DUTIES OF THE COUNCIL; SETTING FORTH THE DUTIES OF THE COUNTY MANAGER'S OFFICE; PROVIDING FOR REVIEW; PROVIDING FOR CONFLICT AND SEVERABILIT~L ~ ~ PROVIDING FOR INCLUSION IN THE CODE OF LAWS AN~~, ~ ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATI~J:i:-~, oo ~'~'~ ~E~AS, Resolution 99-42S was adopted on December 14, 1999, by ~B~ County Gommissioners of Collier Gounty, Florida, pledging a ~ommi~nt to ~h~r ~ th~ people of Collier Coun~ ' ' ' · -'~ ~ ~d dojng all in ~ts power to become a co~umty ~n ~ a Community of Character; ~d ~E~AS, the Bo~d of County Co~issioners h~ requested that a council be established to achieve this goal. NOW, THE~FO~, BE IT O~NED BY THE BOA~ OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLO~DA, that: SECTION ONE: Creation and Purpose of the Collier CounW CommuniW of Character Council. The Board of County Commissioners hereby establishes the Collier CounW Community of Ch~acter Council (hereinafter the "Council") to desi~, implement, ~d govern activities that will empower our citizens to become a model Community of Ch~acter. The Co~cil shall be a "bo~d" as that te~ is defined in Collier CounW Ordinate No. 86-41, as ~ended. SECTION TWO: Appointment and Composition. A. The Council shall consist of fiReen (15) members. Membership of the Council shall include representatives from the City of Naples, City of M~co, Collier County Public Schools, the Collier County Co~ission, ~d the CounW ShefiWs Agency. The remaining members of the Council shall be co--unity leaders representing religious org~izations, youth org~izations, rehabilitation centers, local media, local businesses ~d other comm~W org~izations. B. Members of the Council shall be appointed by ~d se~e at the pleasure of the Bo~d of County Commissioners. Said members shall be pe~anent residents and electors of Collier County. C. Appoin~ent of members to the Council shall be by resolution of the Bo~d of County Co~issioners, which resolution shall set forth the date of appoin~ent ~d the te~ of o~ee. SECTION THEE: Terms of O~ce. The initial te~s of office of the Council shall be as follows: A. Four (4) members shall be appointed for a te~ of one (1) ye~. B. Four (4) members shall be appointed for a te~ of~o (2) ye~s C. Four (4) members shall be appointed for a term of three (3) years. D. Three (3) members shall be appointed for a term of four (4) years. Thereat~er, each appointment or reappointment shall be for a term of four (4) years. Appointments to fill any vacancies on the Council shall be for the remainder of the unexpired term of office. SECTION FOUR: Removal From Office: Failure to Attend l~Ieetings. Committee member attendance requirements, including failure to attend meetings and member removal from office are governed by Collier County Ordinance No. 86-41, as amended, or by its successor ordinance. SECTION FIVE: Officers; Quorum; and Rules of Procedure. A) At its earliest opportunity, the membership of the Council shall elect a chairman and vice chairman fi.om among the members. Officers' terms shall be for one (1) year, with eligibility for reelection. B) The presence of nine (9) or more members shall constitute a quorum of the Council necessary to take action and transaqt business. C) The Council shall, by majority vote of the entire membership, adopt rules of procedure for the transaction of business and shall keep a written record of meetings, resolutions, findings and determinations. Copies of all Council minutes, resolutions, reports, and exhibits shall be submitted to the Board of County Commissioners. SECTION SIX: Compensation and Reimbursement of Expenses. Members of the Council shall serve without compensation, but may be entitled to receive reimbursement for expenses reasonably incurred in the performance of their duties upon prior approval of the Board of County Commissioners. SECTION SEVEN: Functions, Powers and Duties of the Council. The functions, powers and duties of the Council shall be as follows: A) To aid and assist the Board of County Commissioners in creating a Community of Character. B) To prepare and recommend to the Board of County Commissioners an itemized budget of the amount of money required to carry out the business recommended by the Council for the next fiscal year. In carrying out this responsibility, the Council shall, no later than June 1 st of each year submit to the Board of County Commissioners those projects which the Council wishes to see accomplished during the next fiscal year. This proposed budget shall then be reviewed by the Board of County Commissioners and approved in accordance with the procedures for the adoption of budgets set forth under general law and Board of County Commissioners' policy. Should the Council fail to approve a budget by May 1 st of each year, the County Manager shall be authorized to submit a proposed budget to the Board of County Commissioners. C) To advise the Board of County Commissioners as to specific community activities to be implemented that will empower our citizens to become a model Community of Character. 2 SECTION EIGHT: Review Process. This Council shall be reviewed once every four (4) years, with the first such review to take place in 2005 in accordance with the procedures contained in Ordinance No. 86-41, as amended, or any successor ordinance. SECTION NINE: Conflict and Severability. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION TEN: Inclusion in the Code of Laws and Ordinances. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION ELEVEN: Effective Date. This Ordinance shall become effective upon receipt of notice fi.om the Secretary of State that this Ordinance has been filed with the Department of State.
