HEX Final Decision 2014-40 HEX NO. 2014—40 HEARING EXAMINER DECISION PETITION NO. VA-PL20140001160 — Niels Mierendorff requests a variance from Section 4.02.03.A, Table 3 of the Land Development Code to reduce the minimum front yard accessory structure setback line for a single family home in the RMF-6 zoning district from 25 feet to 12.38 feet to accommodate an existing carport that encroaches 12.62 feet into the front yard accessory structure setback on property located at Naples Park Unit 4, Block 45, Lot 46 in Section 33, Township 48 South, Range 25 East, Collier County, Florida. DATE OF HEARING: December 11, 2014. STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant, and the recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in Section 9.04.03 of the Land Development Code has been met and the petition should be.approved. ANALYSIS: After a building permit was issued and construction had been completed, the final survey revealed that the attached carport had been erroneously permitted to encroach 12.62 feet into the front yard accessory structure setback. The homeowner sought relief from the setback encroachment with this variance, and obtained letters of support from the adjacent property owners as well as property owners from across the street. One property owner(two houses to the west) objected by email to this variance request. There were no members of the public, other than the applicant and his representative, in attendance for this application. A revised boundary survey was provided, attached as Exhibit "A", which shows that the carport is 12.38 feet from the front yard property line, but more than 32 feet from the edge of the road way. DECISION: The Hearing Examiner hereby approves Petition No. VA-PL20140001160 filed by Steven J. Bracci, Esq., on behalf of Niels Mierendorff, for a variance from LDC Section 4.02.03.A, Table 3 of the Land Development Code to reduce the minimum front yard accessory structure setback line for a single family home in the RMF-6 zoning district from 25 feet to 12.38 feet, to accommodate an existing carport that encroaches 12.62 feet into the front yard accessory structure setback on property located at 580 93rd Avenue North, Naples, Florida, as shown in the Boundary Survey Sketch attached as Exhibit "A", and as subject to the condition(s) set forth below. CONDITIONS: 1. This variance is granted only for the carport as it currently exists, with no walls. 2. If the carport is destroyed, damaged or altered by more than 50 percent of its replacement value,this variance shall no longer apply. APPEALS: This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners, Collier County.
