OBJECTIVE: To approve expenditure of funds in order to secure Q. Grady Minor and Associates, P.A. to provide professional design services for a three phase engineering design project for the construction of additional boardwalk and restroom facilities at Clam Pass Park. CONSIDERATION: On May 30, 2014, staff issued a Request for Proposal ("RFP") in accordance with Florida Statute Section 287.055, the Consultants Competitive Negotiation Act, to select a firm to prepare a conceptual design for the Clam Pass Park Facilities. The RFP was reviewed and approved by Collier County and various stakeholders, including the Pelican Bay Foundation. The RFP was for design services including: design, permitting, public meetings, construction documents, bidding, shop drawing review, and fmal certifications. E-mail notices were sent to one thousand four hundred and sixty (1,460) contact addresses with fifty seven (57) vendors requesting full solicitation packages, and three (3) proposals were received by the June 30, 2014 deadline. A publically noticed Selection Committee meeting was held on August 12, 2014 and after review and discussion, and by consensus of the members, the responding vendors were ranked in the following order: 1. Q Grady Minor and Associates,P.A. 2. CPH, Inc. 3. Parker/Mudgett/Smith Architects,Inc. In compliance with Section 287.055, the ranking and ability to negotiate a contract with Q. Grady Minor and Associates,P.A.was approved by the BCC on September 9,2014. FISCAL IMPACT: The source of funds is from Tourist Development revenues appropriated for this Project No. 90091 (Clam Pass Park Boardwalk and Restroom Facility) within the Parks and Recreation Beach Park Facilities Capital Fund 183 (TDC Beach Parking Facilities). GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to this action. ADVISORY BOARD RECOMMENDATION: The Parks and Recreation Advisory Board previously approved this project on May 16, 2007. The TDC approved this project on May 29, 2007. Collaboration with stakeholders including the Pelican Bay Foundation and Pelican Bay Services Division has produced an acceptable conceptual plan that has moved the project to the design phase. Just to give you a sense of what has happened regarding this RFP. Your correct in what has happened regarding public discussion of the concept. This project has been in the TDC budget for some time for Beach Park Facilities—you mentioned 2007, which sounds correct. Regarding my meetings you mentioned the ones that I have discussed this project. Just to clarify the project that is being considered is a redo of the Clam Pass Parking Lot, installation of the kayak launch and extension of a southern boardwalk from the existing boardwalk. Originally, I met with the Pelican Bay Foundation last fall to re-engage discussion of the concept. Park construction projects were being facilitated by Coastal Zone Management, but they were switched to our Facilities Management Department. My initial meeting with Pelican Bay was to seek approval of the conceptual plans for the improvements. I was asked at about that time by yourself to meet with the Pelican Bay Services Foundation, which I did to share with them the concept. As I understand,we require approval of the Foundation to make changes to Clam Pass Park and at the initial meeting they asked us to meet with a subcommittee to further look at the concept. We did so and agreed upon several suggestions, basically streamlining the project, removing the beach pavilions and shrinking the footprint of the bathrooms by the beach. I also met with the Mangrove Action Group and have received emails regarding concerns from that group on the boardwalk section of the project. For us to move forward with redoing the conceptual plan,we had to issue an RFP to select a consultant to work with the existing drawings. That is what you have now. The process for expending these monies is for us to bring the RFP forward to PARAB on November 19th,then to TDC in December,then to the BOCC in January. Will try and get you those dates as I understand them, but do encourage you to come to PARAB in November as this will be heard by them at that time. Let me know if you need more information. Yesterday, I was asked by two persons if I'm aware of RFP's for construction of additional boardwalks through a mangroves area and possibly other new construction projects at this park. As you know, I've often been a spokesperson for persons and groups who have very serious concerns about new construction projects being proposed to be located in Clam Pass Park because it exists within the footprint of the Clam Bay NRPA and, while Clam Pass Park is intended to provide public access to enjoy the flora and fauna of the Clam Bay NRPA and for recreation opportunities that are compatible with protection of the natural resources and species that occur within this NRPA, it is extremely important that efforts to improve public access to this park are planned and done in a manner that does not result in loss natural resources. Please reply to this email with detailed information that describes exactly ALL construction projects that are currently proposed, the status of the reviewing process-including correspondence and meetings with the Pelican Bay Foundation Chairperson and its CEO; Pelican Bay Services Division Board and its Administrator; Parks and Recreation Advisory Board;Tourist Development Council; Board of County Commissioners and the District Two Commissioner. I'd appreciate an organized way of providing requested information for meetings which included discussions of ALL proposed Clam Pass Park projects-such as a timeline which provides the dates of meetings that included Clam Pass construction projects within the past fiscal year. Also, please provide the same information about the status and details of the scope of work and contracts that have been proposed for such construction projects. I searched my email database and found an email from you that is dated January 6, 2014 that had attachments (see below)which depicted various projects, but not all of those projects were being fully vetted at that time and I believe I had requested that you present the PBSD with a presentation similar to what had been presented to the PB Foundation. You subsequently did a presentation to the PBSD a few months later(don't have that date at my fingertips). I believe that both the members of the PB Foundation Board and the members of the PBSD Board had expressed support for a handicapped kayak launch area, but had concerns and did not support any other new construction being proposed in the Clam Pass Park. I am not aware of another presentation(s)with further discussion by either of those two boards. Were there any subsequent meetings of either of these two boards that you attended for further discussions or to answer questions /concerns about new construction being proposed in sensitive resources ? Lastly, are ALL of the projects depicted in the attachments of the Jan.6, 2014 email going forward with RFPs for construction bids, etc.? If so,there are serious concerns which have been previously expressed about new construction projects in Clam Pass Park to various county staff by affected persons/groups that may not have been adequately addressed prior to getting to this stage. Collier County residents may obtain a beach parking permit at no charge. Permits will be valid for one year. Vehicles with permits will be exempt from daily parking fees at all beach parking facilities. This permit will be permanently affixed on the bottom, inside, driver's side of the windshield. b. Properly licensed commercial entities may purchase annual permits to transport and drop off visitors and equipment, including but not limited to, paddleboards, canoes, etc., at County beaches utilizing alternative modes of high capacity transportation such as, but not limited to buses, vans and pontoon boats. Annual permits may be purchased at the Collier County Parks and Recreation Department Administration Office — Exhibit Hall for a cost of $1,500.00 per vehicle. Permits will be valid one year from date purchased. 2. Boat Launch Facilities Fees a. Boat launch facilities, including and not limited to, Caxambas Park, Cocohatchee River Park, Collier Boulevard Boating Park, Port of the islands, Goodland Boat Park, Isles of Capri Paddlecraft park and Bayview Park, shall have a launch fee, inclusive of sales tax, at a rate of $8.00 per launch per day for motorized vessels and $4.00 per launch_per day for non-motorized vessels. Residents and visitors may purchase recreational 7 vessel launch permits for an annual fee of $100 for motorized vessels and $50 for non-motorized vessels.. b Overnight parking may be permitted at the following marina locations. (1) Port of the Isles Marina, and (2) Collier Boulevard Boat Ramp, The overnight parking fee is $10,00 per night. The boat launch fee is $8 00 per vessel per launch A permit is required. Overnight permits for designated marina locations may be acquired at the Collier County Parks and Recreation Department Administration Office. c. Annual Commercial Launch Permits are required for any commercial activity conducted at all Collier County Boat Launch Facilities. Commercial Launch Permits must be purchased at the Collier County Parks and Recreation Department Administration Office — Exhibit Hall for a cost of $100.00 per tow vehicle Additionally, permit holders will be required to pay the applicable daily launch fee per vessel, per launch for motorized and non-motorized vessels directly involved in commercial activity. The user shall be responsible for submitting plans for security, crowd control, traffic, refuse, garbage, debris, and sewage disposal before, during and after operation of the event. Such plans should be submitted to the County Manager or his designee, for review and approval. B. The user shall clean up all debris, extinguish all fires when such fires are permitted, and leave the premises in good order, and the facilities in a neat and 23 sanitary condition. No person shall dump, deposit, or leave any bottles, broken glass, ashes, paper or other trash anywhere on the ground of the preserves other than in proper receptacles provided therefore, and no such refuse or trash shall be placed in any waters in or contiguous to the park. While receptacles are provided, all rubbish or waste generated by the event shall be carried away from Collier County Preserve Lands by the person responsible for its presence, and properly disposed of elsewhere. C. If sanitary service is not available at Preserve Lands, the user will be responsible for hiring a licensed sewage disposal business. D. The user shall be responsible for hiring necessary personnel to handle security, crowd control and traffic. E. Estimated attendance with groups of 30 or more must have $300,000 liability insurance and Board of Collier County Commissioners must be named as co- insured. F. If the facility and/or grounds are not returned in the condition they were found, the security deposit will be retained up to the amount necessary to return the facility to the condition found.
