ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came on for public hearing before the Code Enforcement Board on November 21, 2014, and
the Code Enforcement Board, having heard testimony under oath, received evidence and heard argument respective
to all appropriate matters, hereupon issues its Findings of Fact and Order of the Code Enforcement Board, as
follows:
FINDINGS OF FACT
1. Respondent,GILVERTO GENDEJAS, is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. At the hearing,the Respondent entered into a Stipulation,which is attached hereto as Exhibit"A". The
Stipulation is adopted as an Order of the Code Enforcement Board and the Respondent is Ordered to
comply.
4. The real property located at 325 New Market Road W., Immokalee, FL, Folio #6385912000 (Legal
Description: NEWMARKET SUBD BLK 30 LOTS 1-10) is in violation of Collier County Land
Development Code 04-441,as amended, Section 10.02.06(B)(1)(A)in the following particulars:
Demolition permit has expired for removal of unpermitted alterations without having received required
inspections and certificate of occupancy/completion as required.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,
Section 10.02.06(B)(1)(A).
B. Respondent must abate the violation by obtaining all required Collier County building permits or
demolition permit,inspections and Certificate of Completion/Occupancy on or before December 21,2014
or a fine of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.01 on
or before December 21,2014.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

violation of Collier County Code of Laws and Ordinances, Chapter 110 Roads and Bridges, Article II
Construction in right-of-way, division 1 generally,section 110-31(A)in the following particulars:
No permit for damaged culvert that requires replacement.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162, Florida Statutes, and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Code of Laws and Ordinances,Chapter 110 Roads
and Bridges, Article II Construction in right-of-way,division 1 generally, section 110-31(A).
B. Respondent must abate the violation by obtaining all required Collier County Right-Of-Way permits and
inspections through final approval, and/or removing all offending materials from the right-of-way for any
activity not permitted with a valid Collier County Right-of-Way permit on or before March 21,2015 or a
fine of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.43 on
or before December 21,2014.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

FINDINGS OF FACT
1. On August 22,2013,Respondent was found guilty of violation Collier County Land Development Code
04-41,as amended, Section 10.02.06(B)(1)(a)for permit number 20120203549 for interior remodeling of
unit B,expired without Collier County Permit,also, interior remodeling of unit A being conducted without
first applying for a Collier County Building Permit,which violation occurred on the property located at
8085 Bayshore Drive,Naples,FL 34112,Folio#48783840002 (Legal Description: Lot 104,
HALLENDALE, according to the plat thereof, as recorded in Plat Book 4,Page 25,of the public Records
of Collier County,Florida).
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before February 18,2014,or a fine of$250 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 4962, PG 792).
3. Operational costs of$207.77 incurred by the County in the prosecution of this case have been paid.
4. Previously assessed costs of$65.43 will be paid on November 21,2014.
5. Respondent,having been duly noticed for the public hearing regarding the County's Motion,did appear
at the public hearing, and legal defenses to the Motion were presented.
6. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44,as amended,has been timely
filed.
7. The violation has been abated as of October 1,2014.
ORDER
Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No. 2007-44,as amended, it is hereby ORDERED:

THIS CAUSE came before the Code Enforcement Board upon the Petitioner's Motion for Imposition
Fines/Liens on November 21,2014,and the Code Enforcement Board,having heard argument respective to all
appropriate matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
1. On January 24,2013,Respondent was found guilty of violation of Ordinance 04-41, as amended,the
Collier County Land Developmenmt Code, Section 10.02.06(B)(1)(a)for having a partially constructed
home without completed Collier County Building Permiats,inspections and Certificate of
Completion/Occupancy,which violation occurred on the property located at 5220 40th St.N.E.,Naples,FL,
Folio#39020880006(Legal Description:the South 75 feet of the North 150 feet of Tract Number 24,
GOLDEN GATE ESTATES,UNIT 45,as recorded in Plat Book 7, Page 30,of the Public Records of
Collier County,Florida)
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before March 25,2013,or a fine of$300.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 4883,PG 3233).
3. Operational costs of$211.18 incurred by the County in the prosecution of this case have been paid.
4. Respondent,having been duly noticed for the public hearing regarding the County's Motion, did appear
at the public hearing, and legal defenses to the Motion were presented.
6. No Request for Re-hearing or Appeal pursuant to Ordinance 2007-44, as amended,has been timely
filed.
7. The violation has been abated as of November 17,2014.
ORDER
Based upon the foregoing Findings of Fact, and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Petitioner's Motion for Imposition of Fines/Liens is denied based on the mitigating circumstances
presented by Respondent and no accrued fines are imposed.

FINDINGS OF FACT
1. Respondent,Deborah L. Hutt lin, is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at II Pebble Beach Blvd., Naples, Florida, Folio #54950880009 (Legal
Description: LELY GOLF EST UNIT 2 BLK 7 LOT 2),is in violation of Collier County Code of Laws and
Ordinances,Article VI,Chapter 22,Section 22-242 in the following particulars:
Left side entry door in state of disrepair—bottom of door missing.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Code of Laws and Ordinances,Article VI,Chapter
22,Section 22-242.
B. Respondent must abate the violation by obtaining all required Collier County building permits or
demolition permit,inspections and Certificate of Completion/Occupancy necessary to repair/replace broken
or missing doors,windows or other openings and secure property on or before December 21,2014 or a
fine of$250.00 per day will be imposed for each day the violation remains thereafter;OR
Obtain a Collier County Boarding Certificate and board the structure to required specifications on or
before November 24,2014,and obtain all required Collier County Building Permit(s)or demolition
permit,inspections and certificate of completion/occupancy on or before December 21,2014 or a fine of
$250.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.01 on
or before December 21,2014.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.
