Mary advised that she was going into the Horn Family issurance place of business with her leashed dog. From previous visits she was aware that the family usually brings their dogs to work, so she figured she bring her dog along. As she was walking in both dogs came runnig toward her dog and actual bit him on the neck and tail (both minor puncture wounds). As Mary was trying to pick up her dog, both "Peanut" and "Brutus" started attacking Mary and latched on to both her arms. Mary recieved multiple puncture wounds to both arms. No sutures of stiches required. The owner Ilene did take Mary to the Urgent Care on Livingston where she recieved antiobiotic and wound care. I did make contact with dog owner at her of business. Both the dogs were at home. I went over the quarantine rules with the owner. This the second incident involving her dogs. I drove to the owners home, saw both dogs in the window and placed on quarantine. I did make contact with the victim Mary a second time and advised that the dogs was placed on quarantine. I did inform her that this is the second incident involving the dogs. Mary is willing to fill out an affidavit. Her arms are completely wrapped and she does not feel comfortable taking the bandages off to take pictures. I will drop off an affidavit to Mary as she is she does not have an email. She will also attach the vet report to the affidavit. 129/SW 10/18/2014 10.18.14 Unable to make contact with anyone at the residence. Left an affidavit and my card taped to the door. 129/SW 10/20/2014 10/20/14 Affidavit received from caller/victim Mary Walsh regarding the incident that occured. Responding officer to contact Ms Walsh &see if she wants to pursue the possibility for a Dangerous Dog investigation; if she does, photographs of the injuries and medical records are required for both herself& her dog, to determine if the injuries meet the definition. Responding officer to also provide affidavits to attacking dog owner Ilene Horn regarding the incident, photograph & attach pictures to AIDs of both attacking dogs. 125/KL 10/24/2014 10/24/14 12:14 Arrived at 823 Buttonbush Ln. to release both "PEANUT" (A164219) & "BRUTUS" (A164218) from home quarantine. I did not make contact with the homeowner/dog owner but was able to visibly see both dogs in the front window of the residence alive and well. Both dogs released from quarantine. I posted a notice of the quarantine release along with an affidavit asper 125/KL. I made contact with Victim Mary Walsh via phone to notify her of the dogs quarantine release and that both dogs were alive and well. Ms. Walsh and I discussed the possibility of a Dangerous Dog Investigation and she does in fact want for us to pursue the investigation. I explained of her the process and what information we would need. She advised that she would be going to the doctor again for a follow up in a couple days. She was driving at the time I called and asked if i would call her back and leave a voicemail with the information we required, and she would be sure to get it back to us as soon as possible. 132/]Bosch Print Date: 11/17/2014 11/01/2014 11/01/14 09:15 I made contact with Mary Walsh (P064716) who advised that she had all her medical records together, but unfortunately she did not have any photos. She stated the wounds all close to being healed up now. She stated she was going to bring the medical records by the shelter today. I provided Ms. Walsh with the Activity # and advised her to notify the front desk staff that she was providing us with the records in reference to a Dangerous Dog Investigation (DDI) and if front desk staff had any questions to provide them the activity # as reference. 132/JBosch 11/01/14 11:25 Ms Walsh brought her medical records in and I have pictures of the injuries. The wounds are healed and there is just pink marks on the skin. I will attach the pictures on sunday, November 2nd, 2014. I put the medical records in 132/ JB mailbox. 110/AM 11/06/2014 11/6/14 1315 We arrived at the office to create and gather all the proper forms for the Dangerous Dog investigation. Upon completion of this we left for the Michael Horn Insurance Company where Mrs. Ilene Horn was working. We arrived at Michael Horn Insurance Co. We made contact with Ilene Horn who was with a client. We waited for her to finish with her client. We spoke with her face to face and her husband Michael over the phone. We presented them with the Chapter 14-36 Dangerous Dog Ordinance, copies of the notification of investigation, Dangerous Dog Applications for each dog. Mrs. Horn agreed to sign the paperwork and we educated her on the process of investigation and what it means if the dogs were declared dangerous. We discussed with her that she has a right to contest any findings that her dogs are dangerous and have a hearing in front of a magistrate. 133/mg 11/13/2014 11/13/14 1308 We called Mr. and Mrs. Horn. They were confused about the affidavit and did not fill it out. The will fill it out and get it notarized then fax it in. DD pending direction from CCAO. *Note: Message received from CCSO Records Bereau: CCSO Report 14-011462 is for an incident that occured prior to that report & has nothing to do with a dog park incident. No additional information found. 125/KL 11/13/2014 11/13/14 Made contact with Assistant County Attorney Kevin Noelle regarding this case; Mr. Noelle believes that both "Peanut" & "Brutus" do qualify as a Dangerous Dog as per: Chapter 14 Article II Sec. 14-36. Dangerous dogs; definitions and procedures. 1. Definitions. A. Dangerous dog means any dog that according to the records of the appropriate authority: (1) Has aggressively bitten, attacked, or endangered or has inflicted severe injury on a human being on public or private property With the direction of Mr Noelle and the wish to proceed from victim Mary Walsh, both "Peanut" and "Brutus" are going to be declared Dangerous at this time. Activity re-sequenced to deliver Sufficient Cause Letters, Acknowledgement notice, and a copy of the Dangerous Dog Ordinance. If an appeal is not submitted with Seven calendar days of receipt of the letter, the declaration will stand and both "Peanut" & "Brutus" are subject to all Dangerous Dog registration and procedures. 125/KL 11/14/2014 11/14/14 1900 We arrived at 823 Buttonbush to meet with Mr. and Mrs. Horn about the declaration of their dogs as dangerous. We educated them on the process, provided paperwork and the letter with highlighted sections related to their dogs and this situation. I did see both French Bull dogs in the window. I left a notice on the garage door requesting contact. I was also unable to make contact with the caller to get a better understanding of the situation. I left a voicemail requesting contact. 129/SW 1100 I received a call back from the victim. Barbara informed me that the owners two dogs attacked one dog in the park. One dog was holding on to another dogs tail. A friend smacked the dog to get it off of the other dog and it went after Barbara. She does not know which dog bit her (attacking dogs "Brutus" or "Peanut"). She did not go to the hospital but says that the bite was pretty severe. She also does not know the date of the incident but says that it happen a week ago. She filed a report because she feels that the owner was arrogant and showed back up to the dog park and did not apologize for the incident. She said that the lady never reported the incident, she does not know her name and she has not come back to the dog park since the incident. Barbara's dog was not injured. She will email me pictures of the injuries and contact the police dept for an exact date and time. 129/SW 03/05/2014 3.5.14 I was able to make contact with the dig owner Ilene. Ilene told me that the dog "Lucy" was barking and creating a ruckus, drawing many of the dogs to her including "Brutus". A woman (assuming Barbara) leaned down and picked up "Lucy" and "Brutus" did bite "Lucy" on the tail as she was being picked up. Another woman smakced "Brutus" and he went flying. Ilene told me that she did not see "Brutus" bite anyone, but it is possible with all the commotion going on that she missed it. Ilene believed that her dogs are not aggressive. However, I did point out to her that if she blantantly admitted that her dog bit another dog, that does show signs of aggression. Illene told me that she does not ever plan on going back to that dog park (Veterans). I placed/released both dogs from quarantine (Brutus and Peanut) , as Barbara was unsure of which dog bit her.
