THIS CAUSE came on for public hearing before the Code Enforcement Board on October 23,2014, and the

all appropriate matters,hereupon issues its Findings of Fact and Order of the Code Enforcement Board,as follows:
FINDINGS OF FACT
1. Respondent,Black River Rock,LLC,is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at NO SITE ADDRESS,Naples,FL,Folio#726724107(Legal Description: 3 51
26 COMM AT NE CNR TR M-1,N87 DEG W 248.62 FT,NO2 DEG, E 271.35 FT., NO2 DEG E 35.84
FT, S 54 DEG E 236.49 FT, ELY 23.70 FT ALG ARC OF CURVE TO PT OF REVERSE CURVE, ELY
38.64 FT, SO4 DEG W 154.42 FT TO POB, LESS THAT PORTION DESC IN ORDER OF TAKING
"103FEE" OR 4891, PG 3845 FOR COLLIER BLVD. R/W), is in violation of Collier County Land
Development Code 04-41, as amended, Section 10.02.06(B)(1)(E) and 3.05.01(B) in the following
particulars:
An undeveloped parcel of 1.3 acres has been cleared of vegetation without required building or other permit;
54 loads of fill dirt/rock have been graded and/or placed on site without any building permit or other
authorization.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended, Section
10.02.06(B)(1)(E)and 3.05.01(B).
B. Respondent must abate the violation by applying for,and obtaining,all required Building Permits, Clearing
Permits and/or Vegetation Removal Permits for the removal of native and non-native vegetation from the
site OR removing all grading and fill materials from the site and restoring the parcel to a permitted state,
including restoring all vegetation via a Mitigation Plan,submitted and approved per Collier County
Ordinances on or before November 22,2014 or a fine of$250.00 per day will be imposed for each day the
violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.85 on
or before November 22,2014.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

4. The real property located at 365 Capri Blvd.,Naples,FL, Folio#52501800003 (Legal Description: Isles of
Capri Business Sect. Lot 498), is in violation of Collier County Land Development Code 04-41, as
amended, Sections 1.04.01(A)and 2.02.03 in the following particulars:
Recreational vehicles/equipment stored at location not approved for such use.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,
Sections 1.04.01(A)and 2.02.03.
B. Respondent must abate the violation by ceasing and removing all unauthorized vehicles and equipment
from the property to an area designated for such use on or before July 20,2015 or a fine of$150.00 per
day will be imposed for each day the violation remains thereafter.
C. Respondent is additionally ordered that she shall place no other trailers or other recreational
vehicles/equipment on the property during the abatement period.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$62.49 on
or before November 22,2014.
F. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

Demolished existing mobile home and set up new mobile home on improved property without first applying
for and obtaining the required building permit(s), inspections and certificate of completion/occupancy.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44, as amended,it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41, as amended,
Section 10.02.06(B)(1)(A).
B. Respondent must abate the violation by obtaining all required Collier County building permits or
demolition permit, inspections and Certificate of Completion/Occupancy on or before February 20,2015
or a fine of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.01 on
or before November 22,2014.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

FINDINGS OF FACT
1. Respondent,Pedro Baigorria, is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at 2197 456 St. SW, Naples, FL, Folio # 35742520004 (Legal Description:
GOLDEN GATE UNIT 2, BLK 18, LOT 17), is in violation of Collier County Land Development Code
04-41, as amended, Section 2.02.03 in the following particulars:
Selling vehicles which are unlicensed and not registered to the property.
5. The violation has not been abated as of the date of the public hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted
in Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent's Motion for Continuance of this case is denied.
B. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,
Section 2.02.03.
C. Respondent must cease the prohibited use of displaying unlicensed vehicles for sale from a residentially
zoned property on or before November 22,2014 or a fine of$100.00 per day will be imposed for each
day the violation remains thereafter.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance. If necessary,the County may
request the services of the Collier County Sheriffs Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.01 on
or before November 22,2014.
F. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.
